    R 400.8125 · R 400.8125 Staff; volunteer; requirements. (1) All staff and volunteers shall provide appropriate care and supervision of children at all times.

    On 02/02/2023, the center reported the incident to their assigned licensing consultant Dawnita Diaz via email. An incident report was received from the center on 02/20/2023. On 02/07/2023, I spoke with Child A's Father via telephone. He reported that he was informed at pick up on 01/30/2023 that there was an issue with Child A being with a child who pulled their pants down. That evening he received a phone call from center director Kathleen Kokot who informed him that Child B was reporting that Child A had touched his penis. Child A's Father reported that he asked Child A twice, and he denied touching Child B. He asked Child A again when speaking with Ms. Kokot and he said he had touched him. He asked Child A again and Child A said that he did not touch Child B and Child B did not touch him. He asked him again and Child A said that he had touched Child B's penis. I asked Child A's Father what he thinks happened and he said he did not know. He understood from speaking with Ms. Kokot that Child A ran and told her that Child B's pants were down and that he did not like that. He said that Child A has no history of inappropriate contact. He spoke with Ms. Kokot and the president of the cooperative board, and they told him that sometimes the children use the bathroom sink for handwashing before snack and that sometimes children will suddenly have to go to the bathroom. He reported that Child A was unenrolled from the center on Friday because Child B's parents were not comfortable with him continuing to attend the center. On 02/08/2023, I spoke with Child B's Mother who reported that when she picked Child B up from the center on 01/30/2023, she was informed that her son had pulled his pants down in front of another child. She thought this behavior was out of character for Child B, so she asked him what happened. She said that Child B told her that Child A had "touched my wiener." She said that Child B told her that he was in the bathroom and Child A came in and touched him. She said that Child B told her that Child A is "always peeking on me." Child B's Mother said that she called Ms. Kokot and told her about it. Child B's Mother reported that Ms. Kokot told her that Child A was on speaker phone with her, and he admitted to going into the bathroom and touching Child B. She said that Child A was going to the bathroom when this happened. She said that the children were washing their hands and her son went to use the toilet. Child B's Mother said that no one saw the children go into or come out of the bathroom together. She said that her son was pretty upset when telling her and was crying and ran into the closet and hid. She asked him if he wanted to talk about what happened and he told her no. She said that there was a child care staff member and a volunteer present, but she can see how it could happen if they were super busy and turned their head for a second. 3 On 02/09/2023, I completed an unannounced on-site inspection at the center. The center was having a party with parents in attendance, so I did not complete any interviews. I viewed the classroom and bathroom. On 02/09/2023, I spoke with center director Kathleen Kokot who reported that Child A told her and the Unsupervised Volunteer that Child B pulled his pants down. She spoke with both children about the inappropriateness of that behavior and neither child said anything about touching at that time. She told both Child A's Father and Child B's Father about it when they picked their children up at the end of the session. Child A told her about this happening at snack time. The rest of the day after she spoke with the children was normal. Ms. Kokot explained that the child care staff members stand at the doorway of the snack room and supervise children that are washing their hands. They have sinks in the hallway and in the two single stall bathrooms. Ms. Kokot was working with the Child Care Staff Member (CCSM) that day and CCSM was supervising the children while Ms. Kokot was
