(1) The licensee shall ensure that the actual number of unrelated children in care at any 1 time does not exceed the number of children for which the child care home is licensed, not more than 6 children for a family child care home and not more than 12 children for a group child care home.
On 06/28/2023 I completed an unannounced on-site inspection at licensee Jamie Bristor’s home. She had seven children in care, and two of her own children present, ages 10 and 13 years old. Jamie Bristor has been granted an increased capacity from six to seven children and currently holds a variance to R400.1910(1) which allows her personnel to child ratio of one to seven. When asked about her ratio and capacity, Jamie Bristor stated that about one day a week in the summer, she will go over her capacity and ratio of seven and her own children help care for the school aged children who are present. “My kids are responsible for the older kids who are 8 or 9 years old.” She said her kids also help clean up dishes, play outside with the older children in care, and just help out. “It’s like a summer job for them, they get paid a little.” “Sometimes I might have over seven, but then my kids are here helping with them.” I asked for her attendance records and she said, “I don’t have any 2 attendance. I have not been taking it, I know I’ve been failing at that.” She did not produce any attendance records during my visit. I spoke to Gerald Bristor, adult household member, at the time of the on-site and he stated that their children do help with the older child care children. He did not know the total number of children Jamie Bristor had in care at any given time. I informed Jamie Bristor that her children are not approved child care staff members, and can not be included in ratio at any time. They are not able to provide for the care and supervision of school aged children in care. If her children are helping out with child care children, she remains at a 1:7 ratio. On 06/28/2023 I attempted to call Child A; Mother and Child B’s Mother but was unable to reach them.

The ratio must include all children in care who are not related to any personnel and any of the following children who are less than 6 years of age: (a) Children of the licensee. (b) Children of a child care staff member or child care assistant. (c) Children related to any member of the household by blood, marriage, or adoption. 3
I asked Jamie Bristor about the allegation that she pulled a child’s hair. She replied, “That would be MHM1(female, 10 years), and it was probably three weeks ago.” Jamie Bristor said they have been having some difficult family dynamics recently, and they are trying to work through it all. MHM1 was in the kitchen and exhibiting some difficult behavior. “I tried to pull on her shirt so I could get closer to her, and I accidentally grabbed her hair. When it hurt her, I think she fell down. I felt so horrible. I apologized over and over. That is not my normal parenting style, it was a total accident. We’ve been having a hard time in the family lately, and we are working through it. I’ve never intentionally hurt my children or any children in care.” She said it happened when no children were in care, late in the evening. I spoke with the licensee’s husband, Gerold Bristor. He said he was home on the day that Jamie Bristor pulled MHM1’s hair. “I wasn’t in the room; I was wrapping up my day and heard some yelling. I ran upstairs and MHM1 was upset. MHM1 was going at Jaime, that’s been happening a lot, she’s always going after her. She said she tried to grab her shirt but got her hair.” He stated that he hasn’t had any concerns about how Jamie Bristor interacts with any children in care or her own kids.

Part of the initial complaint was that in the afternoon, Jamie Bristor sometimes “goes outside to talk on the phone for approximately 10 -20 minutes, and children are possibly unattended.”Jamie Bristor stated that the three youngest children that she has enrolled all nap in the afternoon for about an hour and a half to two hours. At that time, the older children rest. “During rest, I have my lunch, clean up, I might walk out into the sunshine for a few minutes and prep stuff for when the kids get up.” She said it’s possible she has taken a call at that time as well. “I have cameras set up in all of my napping areas, and the feed comes to my phone.” Jamie Bristor 5 showed me the live feed on her phone. She stated that she frequently checks on the napping and resting children through the video feed and in-person at least every 10 minutes. “I’m in and out and all around during naptime, so I’m always nearby and checking on them.” “If I have certain kids present that need closer monitoring, then I won’t step out. It depends on who is here.” Gerald Bristor said he works in the basement of the home and doesn’t see or hear a lot when children are in care. He said he has seen her walk outside sometimes but didn’t notice if she’s out there for long periods of time.

Jamie Bristor stated that when she exceeds the number of children she is licensed for approximately weekly during the summer, she has her own children provide care for school aged children. Jamie Bristor's children are not personnel, therefore cannot help to maintain required ratio.
