R 400.1911 · R 400.1911 1 Care; supervision; children. (3) A licensee and child care staff members shall be up and awake at all times when children are in care, except as provided in R 400.1922(2) of these rules.

The complainant reported that the complainant does not have firsthand knowledge of Ms. Emory sleeping while children are in care. However, the information was received from a household member (HHM), who witnessed it. It was reported to the complainant by the household member that the HHM left the home, and when the HHM arrived back at home, Ms. Emory was sleeping while children were in care. During my onsite inspection on 03/27/2023, Ms. Emory denied that she has ever slept while children are in care, including early mornings. She reported that she has never fallen asleep while there have been children in care. I spoke to HHM1 on 05/19/2023. HHM1 denies ever seeing Ms. Emory sleeping while there were child care children in Ms. Emory's care. Child A's Father, Child B's Mother and Child C's Father all deny having any knowledge of Ms. Emory sleeping while children were in care.

There is not sufficient evidence that Ms. Emory allows children to walk to school unsupervised.

R 400.1932 · R 400.1932 Home maintenance and safety. (1) The structure, premises, and furnishings of a child care home must be in good repair and maintained in a clean, safe, and comfortable condition.

Ms. Emory did not ensure that her child care home is maintained in a clean, safe and comfortable condition. The home was observed to have excessive clutter in it, as well as animal feces on the floor where children pass through.
