During the on-site inspection on 05/14/2021, CCSM 2 stated that on 05/12/021 at about 11:15am or 11:30 am, Child A picked pieces of a bun from another child's sandwich to eat and CCSM 1 smacked his hand because of that. CCSM 2 saw and heard the smack and it was not a tap. It was a smack. CCSM 1 kept saying that it was just a tap that day, but CCSM 2 said that was incorrect and indicated that CCSM 2 knew it was a smack. CCSM 2 stated that he/she checked for a mark on Child A's hand. CCSM 2 did not see a mark, but Child A did cry. CCSM 2 4 told licensee designee Ms. Debbie Blake immediately by telephone and texted Child A's Mother. CCSM 2 forwarded me text messages which contained screen shots of notification of the incident to Child A's Mother. Ms. Blake responded by saying that if CCSM 1 did not come to her by the end of the day, she would handle it. CCSM 2 also stated that CCSM 1 also uses a raised voice with children at times. I telephoned Ms. Blake while I was at the center. She stated that CCSM 1 had indeed lost his/her patience because the other child care staff members were not assisting and she (Ms. Blake) was aware of the incident. CCSM 1 had admitted that he/she tapped or smacked Child A's hand. Ms. Blake stated that CCSM 1 had been written up. I asked Ms. Blake why she had not reported the incident to the department or Child A's parent. She stated that she did not realize she needed to report the incident to the department and Child A's parent was notified by a staff member. I reviewed the rule requiring Ms. Blake to report to the department and a child's parent within 24 hours of an incident involving an allegation of inappropriate contact. I spoke with Child A's Mother by telephone. She stated that she emailed Ms. Blake on 05/12/2021 regarding the incident. Ms. Blake had responded and agreed that there were other ways to handle these situations with children and she would take care of the situation. Child A's Mother was aware that sometimes CCSMs were rough on children at the center. She explained that being rough on children included things like grabbing the children by the hand in a rough manner and yanking them out of chairs if they were not listening as expected. Child A's Mother had made another CCSM who had been acting as a program director aware of these concerns sometime around January 2021. I spoke with Child A's Father. He stated that he had witnessed a situation where CCSM 1 had placed a child into a crib in a manner that was more aggressive than necessary because the child was getting into something. He described the action as tossing a child into a crib and the child's bottom kind of bounced due to the aggressive manner in which the child was placed in the crib. CCSM 4 stated that CCSM 1 was rougher with children than he/she would have liked, but it was not abusive. CCSM 4 had discussed this concern with CCSM 1 and Ms. Blake. Ms. Blake told CCSM 4 that she would talk with CCSM 1 about the concern. CCSM 4 was not aware of any training that had been offered or required by Ms. Blake to improve the situation. Regarding aggressively placing children in cribs, CCSM 4 explained that CCSM 1 was possibly more aggressive toward male children. CCSM 4 has seen CCSM 1 toss children aggressively into cribs and the parents were never notified. CCSM 4 stated that he/she felt that if he/she had told parents, Ms. Blake would fire him/her or phase his/her hours down. CCSM 5 stated that CCSM 2 had previously blown a different issue out of proportion and CCSM 2 talks horribly to the children. CCSM 2 says things like, "I'll fight you, dude," and CCSM 2 spends 80% of his/her time on her phone. CCSM 5 has not 5 seen children moved around in a rough manner and CCSM 1 would never intentionally hurt a child. If there is a problem at the center, the CCSMs are supposed to go to Ms. Blake about it, but Ms. Blake does not do anything. CCSM 5 stated that children may be placed in a crib for a minute or so when staff are getting other

Ms. Blake did not ensure that hitting was prohibited as a form of discipline. On 05/12/2021, CCSM 1 slapped or smacked Child B's hand as a form of discipline when he touched another child's food.

Ms. Blake and CCSM 1 did not ensure daily learning experiences were appropriate to the developmental level of the children in care. The overall program plan and majority of experiences provided to children are appropriate for infants and toddlers. However, preschool-age children are also in attendance. CCSM 1 provided one writing experience during the inspection on 06/21/2021 which was appropriate to the development of the preschool-age children in the classroom and has attempted to provide developmentally appropriate experiences to Child E since the inspection on 06/21/2021. However, CCSM 1 stated that the program itself was not appropriate to the development of Child E before obtaining the materials and this was part of the cause of behavioral issues which had frustrated him/her.

Ms. Blake did not ensure all staff provided appropriate care and supervision of children at all times. CCCSM 8 left Child C alone in a classroom for approximately two minutes until CCSM 6 realized that had occurred and went to the classroom to provide Child C with supervision. Also, multiple CCSMs and a parent stated that CCSM 8 used harsh and/or aggressive language with children. Therefore, appropriate care and supervision was not provided to children at all times when Child C was left alone and harsh and/or aggressive language was used by CCSM 8.

Ms. Blake did not ensure all incidents of children being left unsupervised were reported to the department. Ms. Blake did not report when Child C was left alone by CCSM 8 at the end of March 2021 or beginning of April 2021.

Ms. Blake did not ensure that a program director is present in the center not less than 6 hours per day. CCSM 1 stated that he/she is usually present 5.5 hours on Mondays, Wednesday, and Fridays.

Ms. Blake did not ensure all program directors are responsible for the general management of the center. CCSM 1 is named as a substitute program director; however, he/she not responsible for the general management of the center. Interviews with CCSM 5 and CCSM 7 indicate that Ms. Blake acts as the program director of the center. CCSM 1 stated that he/she is the acting program director, however, she cannot perform the duties of a program director regarding day-to-day operations as she is not able to address staff issues in Room 309 because she was unable to identify a lead caregiver for the room. CCSM 8 stated that there was a time this previous spring when no individual was responsible and in charge at the center. I
