On 02/05/2021, I spoke with the center's licensing consultant Stacia Thrower about the investigation. The center reported notified Ms. Thrower of Child A's injury and medical care and sent her an incident report. Ms. Thrower spoke with Child A's Mother who reported that she had no concerns about the center or the cause of injury. On 02/08/2021, I completed an unannounced on-site inspection to initiate the investigation. The center director, Tera Fracala, was not present. I spoke with assistant director Mimi Tribble about the incident. Ms. Tribble explained that she was 2 not in the classroom when Child A was injured but was called down to the classroom when the staff members had a concern about her leg. Ms. Tribble checked Child A out and called her mom after she observed that Child A would not walk. She reported that Child Care Staff Members (CCSM) Sadie Harpst, Annalisa Contreras and Deborah Petkus were working in the classroom when Child A was injured. There were ten children present at the time. Ms. Tribble explained that her understanding of the incident was that Ms. Harpst was sitting on the floor interacting with children and redirected Child A for pulling on another child's shirt. Child A then fell to the floor. Ms. Harpst attempted to comfort her, but Child A got up and ran across the room. Child A went by the classroom door and fell to her side. Ms. Contreras then picked her up, took her to the bathroom to change her and have her use the toilet and then noticed that she would not put any weight on her leg. I interviewed CCSM Sadie Harpst about the incident. Ms. Harpst explained that during free play time, she was sitting on the floor interacting with children and had one child sitting in her lap. She observed Child A holding onto another child's shirt, so she intervened, told Child A to stop and moved Child A's hand. Child A got upset and started crying and fell to her knees., She was still trying to interact with her, but Child A got up and ran to towards the door still crying and threw herself on the ground again. Ms. Harpst did not see Child A throw herself to the ground because there was a shelf in the way. There were no toys on the floor that Child A fell on or over. She believes Ms. Contreras was coming out of the bathroom at that time and saw Child A fall. Ms. Contreras picked Child A up and took her into the bathroom; Child A was still crying. A couple minutes later, Ms. Contreras came back out into the classroom holding Child A and asked if they had noticed that Child A did not want to put any weight on her left foot, but she had not. She took Child A from Ms. Contreras and held Child A down by the ground to see if she would stand up but Child A held her leg up. They then called the office and Ms. Tribble came, called Child A's Mother, and cared for Child A until she was picked up. Ms. Harpst explained that she tried to talk to the children when they are having meltdowns to try to figure out what is wrong. If a child in inconsolable, she puts them in a place away from other children where they cannot hurt themselves or the others. She explained that most of the children calm down but if they do not, the staff will comfort them. She will try to distract children with a toy, a baby doll or read them a book. She also rubs their backs, bounces, and pats them on the back or has them sit on her lap. Ms. Harpst reported that there is one child in the classroom who plops down on their buttocks and falls backwards when upset. They try to prevent him from hitting his head and have him sit on their lap instead. Ms. Harpst described Child A as having a super sweet personality who does not talk much. She said that Child A has meltdowns where she drops or throws herself to the ground but not every day. On 2/3/2021, Child A (female, 2 years old) suffered a fractured Tibia (left) while in care. The fracture is spiral in nature.

On 12/8/2020, I received an incident report from Tera Fracala. The report stated that on 12/4/2020, Emily Timmer may have improperly restrained Child A causing a 2 scratch on his arm. Ms. Timmer was attempting to stop Child A from fleeing the center's gymnasium. I contacted Tera Fracala via telephone on 12/8/2020 regarding the allegation. Ms. Fracala explained that on 12/4/2020 Child A's arm was scratched but it was unclear how the injury occurred. On 12/8/2020, Ms. Fracala learned that Child A was attempting to leave the gymnasium unattended on 12/4/2020 and Ms. Timmer intervened to prevent Child A from leaving. Ms. Fracala stated it was reported to her that Child A was sat down roughly during the restraint. Ms. Fracala reported speaking to Ms. Timmer regarding the allegation. Ms. Timmer denied scratching Child A. She stated that if she scratched Child A, she did not intend to. I conducted an unannounced onsite inspection on 12/8/2020. I interviewed Gabby Sillman, child care staff member, regarding the allegation. She reported that on 12/4/2020, she and Ms. Timmer had taken the classroom children to the gymnasium at approximately 5:30PM as they awaited parents for pick up. Upon arrival, Child A attempted to leave the gymnasium alone. She explained that Child A did not want to go inside of the gym and the center's assistant director, Mimi Tribble helped Ms. Timmer bring Child A into the gym. Ms. Sillman stated that Ms. Tribble picked Child A up underneath his arms and carried him into the gym on her hip. Once inside of the gym, Ms. Timmer sat with Child A on the floor and talked with him. Child A began hitting and kicking Ms. Timmer. Ms. Timmer remained seated on the floor, but Child A stood up and continued to kick Ms. Timmer. While seated, Ms. Timmer reached around Child A to hold him under his arms and sit him down. However, Child A continued to punch and kick Ms. Timmer and when she attempted to sit him down, he "plopped" onto the floor. Approximately 20 minutes later, Ms. Sillman stated that she observed two scratches on the inside of Child A's right arm. The scratches were fresh and red in color, but they were not bleeding and not very deep. Ms. Sillman reported asking Child A what happened, and he replied, "They're from Ms. Emily." I was unable to interview Ms. Timmer during the onsite inspection. Ms. Fracala reported that Ms. Timmer was on vacation for the next three weeks. I interviewed Emily Timmer regarding the allegation via telephone on 1/14/2021. She stated that on 12/4/2020, she and Ms. Sillman were taking the classroom children to the center's gym prior to pick up time. Child A did not want to go into the gym. Child A stood against a wall in the hallway stating that he did not want to go inside. Ms. Tribble was in the hallway near the parent check — out table. She came over to Child A and asked him to go into the gym, but Child A still refused. Ms. Tribble carried Child A into the gym, but once they were inside Child A immediately tried to leave out of the gymnasium doors. Ms. Timmer explained that she put her arm out to prevent Child A from running out of the gym. Ms. Timmer stated that the other children were playing with toys, and she went to a wall to sit down for a second. Child A walked over to her and started hitting her as she sat on the floor. Ms. Timmer stated that Child A hit her three times in her face. She explained that 3 she then picked Child A up underneath his armpits and sat him down next to her on the floor. Child A then "flung himself' onto on his side. Ms. Timmer stated that Child A wasn't crying, and he got up after approximately 10 seconds and went to play with the other children. Ms. Timmer stated that she did not observe any scratches on Child A's arm, and Child A did not report being scratched to her. Ms. Timmer was not present when Child A was picked up on 12/4/2020, but she denied handling him improperly. I also interviewed Mimi Tribble regarding the allegation via telephone on 1/14/
