(1) Except as provided in section 5n(14) and (15), a child care center, group child care home, or family child care home shall not allow an individual to be a child care staff member without requesting a criminal history check as required by section 5n.
On 02/02/2021 the department received a complaint regarding Mrs. Blair allowing Ms. Bart to work in the home as a CCSM prior to being found eligible to work in a child care home. There were also allegations that Mrs. Blair did not have the following documents for Ms. Bart on file prior to her working with child care children: a statement showing she is free of communicable TB, valid CPR and first aid training, a signed statement from a physician attesting to her mental and physical health, and proof of safe sleep training. On 02/04/2021 I spoke to Rebecca Bart by phone. She stated she first went to Mrs. Blair's home on 01/24/2021 to complete some of the paperwork and trainings. She identified that on Monday 01/25/2021 at around 8:25am she started working at Mrs. Blair's home with child care children. She stated that at times she was left alone unattended with child care children while Mrs. Blair was in other places of the home. Ms. Bart confirmed that her comprehensive background fingerprint appointment was scheduled for 4:35pm on 01/25/2021. She stated that on 01/25/2021 she took the children outside to play for approximately 50 minutes while Mrs. Blair remained in the home. She confirmed that she did not provide Mrs. Blair with a copy of a statement showing she was free of communicable TB, a statement from her physician attesting to her mental and physical health, and proof of valid CPR and first aid training. She also stated she did not complete safe sleep training prior to watching infants. She identified that while she worked in Mrs. Blairs home there would be times that Mr. and Mrs. Blair would leave the home and go on walks in the neighborhood leaving her alone with six children. Ms. Bart stated she only worked at Mrs. Blair's home from 01/25/2021-01/27/2021 and on 02/01/2021 before resigning from her position. On 02/04/2021 I completed an unannounced onsite inspection at Mrs. Blair's home. Some children were already placed in pack and plays while others were making their nap cots. Mrs. Blair was wiping tables following lunch service. Mrs. Blair stated that Ms. Bart come over on Sunday 01/24/2021 to start paperwork and some of her trainings. She identified that Ms. Bart's first official day in the home with child care children was on 01/25/2021. She stated that Ms. Bart completed her comprehensive fingerprint appointment on 01/25/2021 towards the end of the day. She denied ever leaving Ms. Bart unattended. Mrs. Blair provided me with a copy of Ms. Bart's eligibility letter that was dated 1/27/2021 stating that Ms. Bart was found eligible to work in a child care home. Ms. Blair was informed that CCSM's should not be 3 working in the home until they are found eligible and she has received this notification. Mrs. Blair provided a copy of Ms. Bart's MiRegistry training transcripts. I verified that Ms. Bart completed Infant Safe Sleep training on 01/25/2021. The transcript did not provide a time of day when this training was completed. Mrs. Blair stated she did not have a copy of Ms. Bart's CPR and first aid training. She stated she was under the impression that Ms. Bart had 90 days to complete this training. She was looking at an outdated form from the department and it stated CCSM's had 90 days to complete this requirement. Mrs. Blair was informed that this requirement changed when the child care licensing rules changed on 12/13/2019 Mrs. Blair stated she was always in the home while Ms. Bart was present. Mrs. Blair denied having a signed statement from a physician attesting to Ms. Bart's mental and physical health and a statement showing she was free of communicable TB. She stated that Ms. Bart had these documents completed but was not able to get copies from her doctor's office right away. Mrs. Blair stated she thought this was not a current requirement due to the Covid-19 pandemic. She stated that she spoke to her Licensing Consultant Mary Dufon and was under the impression the department was allowing providers extended
Mrs. Blair allowed child care staff member (CCSM) Rebecca Bart to start working with children prior to having her required paperwork submitted and comprehensive background check completed.

On 03/15/2021 I spoke to Ms. Schoonbeck by phone. Ms. Schoonbeck stated that she had no concerns regarding Mrs. Blair and the meal program she followed. She stated Mrs. Blair did a great job with the food program and she never observed anything concerning. Ms. Shoonbeck stated that Mrs. Blair is aware that some foods that may be easily choked on need to be cut up in smaller pieces. She stated this was a common practice at Mrs. Blair's home. On 3/15/2021 I spoke to Ms. Vasquez by phone. She stated she always observed Mrs. Blair cutting up the food for the younger children. She observed Mrs. Blair serving children all the food groups and did not have any concerns regarding food service. On 3/15/2021 I spoke to Ms. Carballo by phone. She identified that the food served at Mrs. Blair's home was adequate and met the requirements of the food program. She stated that Mrs. Blair would always cut up food for the younger children to ensure there was no choking hazards. On 03/19/2021 I spoke to Noemi Guizar from the Child and Adult Care Food Program. Ms. Guizar stated she has worked with Mrs. Blair for approximately two years. She identified that she has completed unannounced onsite inspections at Mrs. Blair's home and observed lunch service. She did not observe any issues with Mrs. Blair's food menu's or concerns with the meals Mrs. Blair is serving at her child care group home.

(1) A licensee shall ensure that all of the following requirements are met: (a) Each child shall be provided with nutritional and sufficient food pursuant to the minimum meal requirements of the child care food program, as administered by the Michigan department of education.
