On 07/26/2023 I spoke with Child A’s Mother via telephone. Child A’s Mother reported that the incident involving Child A wandering away from his group was reported to Child A’s Father the day it happened, but she was not sure who told him. She said that Child A walked away from his classroom, around the building and another parent found him. She did not know exactly where Child A was found. This incident happened in the spring, but she did not know the exact date. She did not receive an incident report. She explained that sometimes children play outside of the playground fence on the side of the building. The area is a grassy hill that is adjacent to the center and to the parking lot. There is no fence or other barrier to prevent children from accessing the parking lot or walking to the road. She did not know the name of minor child care staff member caring for Child A when the incident occurred or the name of the parent who found him. She said that Child Care Staff Member 1 (CCSM 1) was the lead caregiver at the time but no longer works at the center. She said that she was concerned about the center kicking Child A out because he had some behavior issues including hitting, spitting, and throwing toys. Child A’s Mother said that the center had threatened to kick him out and she had seen three or four other children released from care. He has since been disenrolled by the center. On 07/26/2023, I completed an unannounced on-site inspection and interviewed program director Katelyn Egnatuk. Katelyn Egnatuk reported that the incident happened when Child A’s classroom was playing on the playground and Child A got the gate open. He was chased by a child care staff member to the front of the building and brought back to the playground. Katelyn Egnatuk said that the playground gate is now zip tied to prevent children from opening them. She said that it happened in the afternoon. She said that she may have talked to Child A’s Father, but it was not an eventful incident because Child A was being followed. It happened when CCSM 1 was the lead caregiver, and she is no longer employed at the center. Child A was disenrolled from the center due to his behavior. They discussed his behavior with his parents and told them he was not doing well in a group setting and recommended one on one care for him. Katelyn Egnatuk looked at her records and reported that CCSM 3 was working when the incident occurred. 3 I interviewed CCSM 3 utilizing Forensic Interviewing Protocol after receiving verbal permission from CCSM 3’s Mother via telephone. CCSM 3 said that she remembered the incident and explained that Child A got out of the fenced area by climbing the fence and pushing the level down to open the gate. She saw him opening the gate but was on the other side of the playground. She ran after Child A and caught up with him before he made it to the parking lot. She took him inside the building through the front door She said that no parents were involved in the incident to her knowledge and no parent brought him inside. CCSM 3 explained that Child B’s Mother was coming in the door to pick up Child B as she made it to the parking lot. She recalled that it happened in the afternoon between 4:00 and 4:45 PM because that is when they go outside. She was working with CCSM 8 and CCSM 43 at the time and they were all outside. On 09/07/2023, I spoke with Child B’s Mother who said that she recalled the incident with Child A. She was picking up her children when she saw him. Child A and Child B were playing outside of the fenced playground area when she arrived. When they walked out to go to the car, Child A was wandering in the front of the center by the sidewalk. She went to the door and told a child care staff member, whose name she did not know, that Child A was out there unsupervised. During the spring, while playing outside and under the supervision of a minor child care staff member, Child A (male, 3 years old) wandered away from his group and was found by a parent who brought him to the center’s front door.

On 10/14/2022, I interviewed center director Jessica Verwoert who denied the allegations. Ms. Verwoert reported that the center employs nine minor child care staff members. She explained that none of the minor CCSMs work in classrooms with children by themselves. Ms. Verwoert provided the names of eight CCSMs that were minors. I interviewed CCSM 1 who reported that minor CCSMs never work by themselves, and they always work in "doubles." She leaves at 3:00 PM every day and she is not sure of the ages of the CCSMs that are working after she leaves. She provided names of the pairs of CCSMs that cover her classroom. None of the pairs were both minors per the list that Ms. Verwoert provided. I interviewed CCSM 2 who reported that the minor CCSMs work in the afternoons. She leaves around 3PM or 4PM and the minor CCSMs will be working when she leaves. I requested copies of staff and children's attendance records. I received staff attendance records while on-site and the children's records were emailed to me. The Department of Labor and Economic Opportunity (LEO), Wage and Hour Division was notified to investigate compliance with the Youth Employment Standards Act (YESA), PA 90. On 2/16/2023, I spoke with center director Katelyn Egnatuk who reported that the minor CCSMs do not work alone and are supervised by an adult CCSM. I asked Ms. Egnatuk about the outcome of the investigation by LEO. She reported that the center did not have work permits for any of the minor CCSMs. A former CCSM, CCSM 37 walked off the job and left a minor CCSM alone in the classroom. Ms. Egnatuk reported that LEO told her that since CCSM 37's employment was terminated and there were adult staff in the building and available it was not a violation. On 3/2/2023, I interviewed CCSM 33 who had no knowledge of minor CCSMs working without an adult present. She said that administration makes sure they know their birthdates. CCSM 34 said that she does not work with minor CCSMs and leave before their work time. She explained that she would not know their birth dates and that the center directors are responsible for that. CCSM 35 reported that there is always an adult CCSM in the classroom with the minor CCSMs. She does not know the ages of the CCSMs but the center directors do all the staffing. 3 CCSM 36 had no knowledge of minor CCSMs working without an adult CCSM present. She said that there is always an adult CCSM in the room. On 3/14/2023, I interviewed CCSM 38, CCSM 39, CCSM 40 and CCSM 2. All of the CCSMs interviewed reported that they had no knowledge of minor CCSMs working without an adult CCSM supervising them.

Ms. Verwoert denied that the center is using time out with children under 3 years old. She explained that the center uses "take a break" as a discipline technique. CCSMs will take a child to the side and talk to the child at their level. CCSM 1 is a lead caregiver of the Little Movers classroom which includes children who are under 3 years old. She reported that she tries to redirect children and will pull them to the side if their behavior is harming. She will have them "take a break" and talk to them for 30 seconds before they resume playing. She said that she will have children sit and count to 10 in order to calm down. She does not view this as time out and is aware that time out with children under 3 years old is prohibited. CCSM 2 is a lead caregiver in the Little Adventurer classroom which includes children under 3 years old. CCSM 2 explained that the center uses "take a break" as their discipline. She has the children sit off to the side, talk about what happened and redirect them. The center's discipline policy that was approved in September states, "Little Fliers believes children learn best through positive play, experiences, and examples. Using consistent, easy to follow rules will help children to develop self-discipline skills. Team members will celebrate children's positive behavior, encourage positive redirection, and offer positive guidance for learning. The following behavior techniques will be used: • Model appropriate behavior for children to observe • Encourage conversations to reflect on choices • Redirection, provide alternative choices • Classroom modification to prevent problems • Listen to children • "Take a Break"- individual quiet play-time at a table. One minute per year of age for ages three years and up. Redirection will be used for under three years of age. • Note on child's daily report sheet • Phone call to parents/guardians • Conference with guardian + teacher to create a cohesive action plan • Termination of care". On 03/02/2023, I interviewed CCSM 33, CCSM 34. CCSM 35 and CCSM 36 who all reported that they have not seen time out used for children under 3 years old. On 03/04/2023, I interviewed CCSM 38, CCSM 39, CCSM 40, and CCSM 2 who all reported that they have not seen time out used for children under 3 years old.

(1) Food and beverages provided by a center must be of sufficient quantity and nutritional quality to provide for the dietary needs of each child according to the minimum meal requirements of the child and adult care food program (CACFP), as administered by the Michigan department of education, based on 7 CFR part 226, 1-1-18 edition, (2018) of the United States Department of Agriculture, Food and Nutrition Service, CACFP, and is hereby adopted by reference. Ms. Verwoert denied that any classrooms have operated out of ratio. The center employs more staff than they need right now, and they also have a substitute list in case they are short staffed. Once a classroom is at ratio, they will send another CCSM to the classroom when the next child arrives. Ms. Verwoert provided copies of attendance records for 9/26/22-10/14/22. I did not identify any times that the classrooms were out of ratio. CCSM 1 reported that they follow a ratio of 1 CCSM to 8 children in her classroom and they do not operate out of ratio. CCSM 2 reported that her classroom operates in ratio. She has no knowledge of any classrooms operating out of ratio. I walked through the center and each room was operating within the required CCSM to child ratio. 5 On 03/02/2023, I interviewed CCSM 33, CCSM 34. CCSM 35 and CCSM 36 who all reported that they had no knowledge of any classrooms operating out of ratio. On 03/04/2023, I interviewed CCSM 38, CCSM 39, CCSM 40, and CCSM 2 who all reported that they had no knowledge of any classrooms operating out of ratio.

Ms. Verwoert reported that the center always has extra food if a child already ate their serving and wanted more. The center has had no issues with running out of food since the center opened last month. Ms. Verwoert reported that the center did not have measuring cups the first week they were open but that did not impact the children being served enough food. Ms. Verwoert said she had no idea why someone would report that the center did not have enough food. CCSM 1 and CCSM 2 both reported that their classrooms have always had enough food. Ms. Egnatuk reported that the center has always followed the CACFP quantity guidelines. On 03/02/2023, I interviewed CCSM 33, CCSM 34. CCSM 35 and CCSM 36 who all reported that the center serves more than enough food, but they always have other food they can offer if they run out. On 03/04/2023, I interviewed CCSM 38 CCSM 39 CCSM 40, and CCSM 2 who all reported that the center serves more than enough food, but they always have other food they can offer if they run out. I interviewed CCSM 5 who is the person who cooks the food for the center. CCSM 5 has a printout of the CACFP requirements that details the serving sizes. She always sends more than the minimum required food to the classrooms. The center also has additional food like crackers if they run out of what was served.
