R 400.1908 · R 400.1908 Capacity. ................................................. ............................................ (1) The licensee shall ensure that the actual number of unrelated children in care at any 1 time does not exceed the number of children for which the child care home is licensed, not more than 6 children for a family child care home and not more than 12 children for a group child care home.
On 07/25/2022, I conducted an unannounced on-site inspection. Upon my arrival I asked to speak to Ms. Clark, Ms. Clark's sister, Devonne Piebenga answered the door, at which time she informed me that Ms. Clarks ran out to pick up her daughter from soccer camp but she would be right back. I asked her if Ms. Clark was operating her child care today. She said yes, she was and that it was in the basement at which time she allowed me to come. I observed three older children 2 upstairs with Ms. Clark's sister. She stated that Ms. Clark's child care staff member was in the basement with the child care children and that I could go down there to speak to her if I needed to. I observed Child Care Staff Member Sara Bailey caring for 5 children. I informed Ms. Bailey of the complaint and asked if I could speak to her about it. After reviewing the complaint Ms. Bailey denied that they operate over capacity. She stated that most days they have under 12 children. She said that they have between 9-11 on most days. She stated that she doesn't know why anyone would say that unless they are including Ms. Clarks older children that are sometimes present in the home but not for child care. She stated that Ms. Clark has two step-sons ages 8 and 10 who 1/2 1/2 are home with them every other week and Ms. Clark's daughter age 10 who is '/2 home with them every other week as well. I spoke with Ms. Clark via phone as she was not home at the time of my on-site inspection. She said she is never over capacity and that she never leaves employees with 12 plus children. On 02/24/2023, I spoke with Child Care Staff Member Ashley Elliott. She stated that she has been working at Jo Jo's Child Care for 3 years. She that they never have more than 12 children at a time. I spoke with Child A's Mother regarding the complaint. She stated that she has never seen more than twelve children at the child care home since she has been bringing her daughter there.
Ms. Clark is caring for more children than her license capacity. The child care family home is operating over capacity. Ms. Clark is not maintaining the required personnel to child ratio. Ms. Clark is not providing appropriate care and supervision. She picks children up by their arms and won't set them down nicely. She also yells at children.

The ratio must include all children in care who are not related to any personnel and any of the following children who are less than 6 years of age: (a) Children of the licensee. (b) Children of a child care staff member or child care assistant. (c) Children related to any member of the household by blood, marriage, or adoption.
Ms. Bailey denied the allegation that staff members are left alone to care for more that 12 plus children. She pointed out that she was alone at the time of my visit and there were only six children present. There were 2 children 3 under the age of 18 months and 4 under the age of 30 months. She stated Ms. Clark never leaves staff with more than six children and usually there are three child care staff members present on most days. Ms. Clark stated that she only leaves if the required personnel to child ratio is met and maintained. She said that she always maintains ratio and she has two employees who work with her almost every day. On 02/24/2023, I spoke with Child Care Staff Member, Ashley Elliott regarding the complaint. She said Child Care Staff Member are never left alone with children especially not more than twelve because that is too many children for one person to take care alone. I spoke with Child A's Mother regarding the complaint. She stated that she has never seen one staff member caring for twelve children. She said that there is always at least 2-3 adults there every day.

Ms. Bailey denies that anyone yells at the children and she denied ever seeing anyone picking up child care children by one arm. I asked Ms. Clark if she or her staff members were picking up children by one are and/ yelling at them. She stated that she does not pick children up by one arm or yell at them. This equipment must meet all of the following requirements: a) Cribs, porta-cribs and play yards must comply with the product safety standards issued by the Consumer Product Safety Commission, 16 CFR 1219 (2019), 16 CFR 1220 (2019), and 16 CFR 1221 (2019), which are available at http://www.cpsc.gov.
