The video shows Teacher 3 grabbing Child G's shoulder when he grabbed across the table towards Child K and Child L. Child G was able to slip out of Teacher 3's grasp with no difficulty. It is not apparent that Teacher 3 was grabbing firmly onto Child G. Technical assistance has been provided concerning comments about Teacher 3's use of a loud voice.

On 08/312022, 1 received a voicemail from Program Director Melisa Ricketson- Bowman stating that they had an incident at the center that evening which involved a 2 year old child being left in a classroom for over three minutes during the transition to close down the room. That same evening, I received the incident report, which stated that child care staff member Xuan Pham completed the Two's classroom's name to face sheet, and that Child A went to the corner of the room. Ms. Pham then transitioned the children to the Toddler Two room, leaving Child A in the Two's classroom. Around three minutes later, Toddler Two room child care staff member Judy Schoenhofen entered the Two's room to clean, and found Child A. On 09/01/2022 I completed an unannounced on-site at the center. Ms. Ricketson- Bowman stated that the child care staff member responsible for the incident, Xuan Pham, resigned her position earlier that morning. Ms. Pham had been working at the center for around a year and had no previous incidents or supervision concerns. On 08/31/2022, Ms. Pham was in the Two's room and moved to combine with Toddler 2 Two. The two rooms are connected through a bathroom, and instead of going out the door of the classroom into the hallway to change rooms, Ms. Pham went through the connecting bathroom to transition the children. "That's not how they are supposed to transition, they need to use the hallway and cross the doorway threshold." Ms. Pham moved two children into the Toddler Two room, leaving Child A behind playing on the other side of the room. She did not realize he was not with her. "He was signed out of the Two's classroom and into Toddler Two." Ms. Pham said later that she "thought Child A was with her when they went through the bathroom, and he went back through to the Two's room without her noticing, but we pulled the videotape, and he was left behind." Judy Schoenhofen, who was in the Toddler Two room during the transition, then went into the Two's room to clean, and saw Child A. "They timed it on the video, and he was alone in the room for 3 minutes and 48 seconds." I asked Ms. Ricketson-Bowman what the process is for staff when an incident like this occurs, and she said "It's either a final write-up if it's the first time it has occurred, or termination, because of the severity. But she quit instead." When asked what the usual process is for transitions, she stated, "They are supposed to do the name to face sheet, use the walking rope, and use the hallway so that they are crossing the doorway threshold. She did the short cut. She signed them out, walked through the bathroom, and signed them back in." Ms. Ricketson-Bowman said she spent hours with Ms. Pham last night going over the process after the incident. They also scheduled a training for September 22 where they will be going over the entire process with all of the staff, and she already has sent a memo to all of the staff. "Everyone knows about it, and we've been reviewing policies and procedures and giving them lots of reminders." Ms. Ricketson-Bowman said she contacted Child A's Mother to let her know about the incident and "she wasn't concerned." Judy Schoenhofen explained she is an assistant staff member who floats around the center, and this week is in Toddler Two. She was in the classroom at the time of the incident. Ms. Pham "came in with two kids. She did the name to face sheet and said she was all set, so I signed out on the name to face. I brought an incident report up to the front office and then went into the Two's classroom to clean. I didn't see anyone but heard a child, so I walked over to the other side of the room and Child A was sitting on a little couch talking to himself and playing. The couch is in a little blind spot from the doorway, so I couldn't see him until I walked over there a little bit. He wasn't upset at all; he was having a ball. He came with me back into the classroom and Ms. Pham said "Oh, [Child A]!" "She was surprised to see him.

On 08/12/2021 I contacted Program Director Melisa Ricketson- Bowman regarding an incident report that was sent to child care licensing consultant Rachel Arens. Mrs. Ricketson-Bowman stated that Child A (Male, ) was on a field trip with the school age children. The children went to Maplewood ash Pad in Jenison, Michigan. While playing in the splash pad, Child A exposed his to Child B (Female, ). Child B ran and told staff members who were at the splash pad what happened. Staff asked Child A what happened, and Child A admitted that he had exposed himself to Child B to be funny. It started to rain so all the children got on the bus and went back to the center. Child A and Child B remained separated the rest of the day until it was time to be picked up. When Child B was picked up, Child B's Mother stated that Child B had disclosed that the previous week Child A had pinched Child B on the buttocks. Mrs. Ricketson- Bowman was not aware of any incident previously between Child A and Child B. On 08/17/2021 I completed an on-site inspection at the child care facility. I met with Program Director Melisa Ricketson-Bowman. Mrs. Ricketson-Bowman verified the incident report with me. She stated while Child B was being picked up, Child B's Mother stated that Child B had told her that Child A asked her to show him her "penis". When Child B said she would not, Child A pinched Child B on the buttocks and ran away. Mrs. Ricketson-Bowman did not hear about this previous incident before the incident at the splash pad. She stated there were not staff members who heard of the previous incident as well. She stated Child B was very vocal and feels that if something like that happened, she would tell someone immediately. Mrs. Ricketson-Bowman stated Child B is no longer attending the center and has gone back to school. She stated Child A is here for the rest of this week and then will be returning to school. She stated since the incident happened at the splash pad, Child A and Child B were not together. Mrs. Ricketson-Bowman stated there were no other observed incidents between Child A and Child B in the past. She stated Child A was very upset at what he did and knew that he was wrong. Child A's parents were also appropriate in their response and were concerned of this behavior. I interviewed staff member David Harnish. Mr. Harnish stated the children went on a field trip to the splash pad at Maplewood Park. The children were all running around playing in the water. The field trip was getting close to an end and as staff were getting children and getting ready to leave, Child B came over and stated that Child A had pulled out his while standing in a water fountain and showed Child B. Child B stated she did not like that Child A did this. Mr. Harnish stated he walked Child B over to staff members Mikaila DeMyer and Ambre Calhoun and told them what happened. Mr. Harnish stated staff members were standing around the 3 perimeter of the splash pad and were all able to see children as they were playing. It began to rain, so all the children were asked to get on the bus. Child A and Child B were separated during the bus ride back to the center. Mr. Harnish further explained that when everyone arrived at the center, Child A admitted he had exposed himself and he said he did it to be funny. Child B was upset about what he did. When Child B was picked up, Child B's Mother stated there was another incident between Child A and Child B the previous week. Mr. Harnish stated he was not aware of any other incident ever happening. Mr. Harnish stated Child B does not attend the center anymore and is in school. Child A will be returning to school this week. I interviewed staff member Mikaila DeMyer. Ms. DeMyer stated the school age children went on a field trip to Maplewood Park to use their splash pad. While at the splash pad, Child B was brought over by Mr. Harnish. Child B stated that while she was playing in the water, Child A had pulled out his and showed her. Child
