    R 400.8125 · R 400.8125 Staff; volunteer; requirements. (1) All staff and volunteers shall provide appropriate care and supervision of children at all times.

    On 02/01/2023, I received a telephone call from program director Amanda Maynard. Child A told her mother on the evening of 01/31/2023 that Child B had crawled under the restroom stall at the center and then touched her vagina. I advised Ms. Maynard to report the incident to the Michigan Department of Health 2 and Human Services (DHHS) and received a text message confirmation that she had. Later, I received a written incident report from Ms. Maynard. On 02/09/2023, I interviewed Child A's Mother who stated that Child A told her on the evening of 01/31/2023 that earlier that day, a little girl at the center crawled under the bathroom stall and stuck her fingers into her vagina. Child A told her "She touched my butt," then pointed to her vagina. Child A's Mother explained that she calls her vagina her butt. She added that Child A's vagina was irritated and red and showed a picture of such to child care staff member (CCSM) LaShona Clark. When she came into the center on 02/01/2023 she notified the teachers in the room and later they met with Ms. Maynard. She did not take Child A for medical treatment. Child A still attends the center. On 02/13/2023, I completed an unannounced onsite inspection at the center from 12:55 pm - 3:15 pm and interviewed Ms. Maynard and CCSM's Kontiqueia Allen, Ms. Clark, Laquietta Tillis, and health technician Monica Giles. Ms. Maynard stated that Child A's Mother reported the incident to the center on 02/01/2023. Child A's Mother came into the center and asked to talk to someone and was referred to the teachers. Ms. Clark spoke to her in the foyer area of the center and then left to complete an errand and would be returning. At this time, Ms. Clark reported to Ms. Maynard that Child A's Mother said that Child B went under the bathroom stall and into Child A's stall and then touched her on her privates. When Child A's Mother returned to the center, Ms. Maynard, Ms. Clark, and Ms. Giles met with her in a separate room within the center, to further discuss the incident. Child A's Mother provided them with a written statement. She told Child A's Mother that she reported the incident to the department, and it was being investigated. She does not feel that the incident occurred at the center, as the CCSM's closely monitor the bathroom and can clearly see if children are not in their own stalls. Ms. Allen works in the room with Child A and Child B. She never spoke to Child A's Mother about the incident and heard about it from Ms. Clark. She explained that the bathroom has 5 stalls in a single row. She took me to the bathroom and showed me the layout and area where the CCSM stands in the bathroom shows a clear view of all stalls and one can see the lower part of the child's legs and feet. A CCSM would clearly see if a child crawled under one of the stalls and into another stall. She accessed the application (Child Plus) that the center utilizes and confirmed that Child A arrived at 9:50 am on 01/31/2023. Therefore, Child A would have missed group bathroom time at 9:00 am. She would have gone to the bathroom by herself after breakfast. Child A didn't go with the group at lunch time, either, as she was eating slowly and went alone after the group. The first time that she would have gone to the bathroom with the group on 01/31/2023 was following afternoon snack. Ms. Tillis would have taken the group at that time. Ms. Allen added that Child A is very vocal when she is bothered, touched, or injured. She is comfortable with telling the CCSM's when another child says or does something to her. Child A will cry out if 3 hurt. If it had occurred, Child A and all of the other children would have notified the CCSM's as they do with everything. She clarified that all of the children in the room are currently going through a phase where they are "tattling" on each other about everything.     On 07/14/2022 I left a voicemail message for complaint source 1. On 07/14/2022, I completed an unannounced onsite inspection at the facility from 1:00 pm — 4:30 pm and interviewed program director Amanda Maynard, child care staff members (CCSM's) 1-10. Ms. Maynard stated that the room referenced in the allegations is room 119 and is used for children aged birth-2.5 years. She was not aware of a crack in the foundation. She was made aware by CCSM's that when they moved into the building two years ago there was grass growing up the side of one of the walls in the room. She explained that the week prior, there were no children present in the building as it was summer break. The carpets in all of the rooms were cleaned. All of the items for room 119 were placed back into the room on Friday 7/8/2022. On 7/11/2022, when they returned to the building there was an odor in the building, specifically room 119. CCSM10 lifted the office chair protector from the carpet and there appeared to be mildew. Ms. Maynard notified Head Start coordinator Tricia Hughes, operations coordinator Troy Dean, and director of operations Jeff Jansen all with the Genesee Intermediate School District (GISD). They did not feel it was an issue with the entire building, only room 119. The children were in attendance but not in room 119. They have not been present in that room since 06/30/2022. The carpets were re-cleaned and OdoBan was used to absorb the odor. They believe that the items were placed back into the room when the carpets weren't completely dry, causing a potential for mildew growth. On 07/12/2022, when they arrived at the building the smell was stronger, as you could smell it from down the hall. She notified Mr. Dean and Ms. Hughes that there remained an issue. It was reported to her that maintenance was to arrive at the facility that morning prior to the children arriving, yet they did not show. She called health services coordinator with the GISD Rhonda Tata and notified her of the smell and they determined the children could attend for the day, as the smell was not overwhelming. Mr. Dean arrived at approximately 10:00 am and placed a dehumidifier in room 119. They also emptied the room and when the door was opened the odor was stronger. By 10:30 am all of the children were sent home for the day. By 10:51 am all of the staff members were sent to another facility for the day. Later that day the carpets were recleaned and OdoBan was used again. On 07/13/2022, staff members were told to report at their regular start time. She and Ms. Hughes went to room 119, which had the door closed overnight, and they could smell the odor but it was significantly better. Mr. Jansen came and agreed that it was safe for the children to attend yet they'd keep room 119 closed. 3 Ms. Maynard was aware that a few CCSM's reported health-related symptoms from the odor and some left for the day. On 07/14/2022, I interviewed CCSM1 who confirmed that she worked 7/11/2022 and 07/12/2022. She explained that when you walked in the building on 07/12/2022 there was a bad smell. After approximately one hour she obtained a pounding headache and her eyes were burning. She left for another facility at 10:30 am. She returned to the building on 07/13/2022 and the odor was significantly better. She was told by other CCSM's that when they moved into the building there was grassy vines growing up one of the walls in room 119. The only thing she observed in 06/2021 were "little white mushroom things" on the carpet in that room. She explained that room 119 often smells when it is humid. On 07/14/2022, I interviewed CCSM2 who reported that she never had an issue with an odor previous to this incident. She was not aware of a crack in the foundation or saw grassy vines growing on the wall in room 119. However, she did notice mold under the office chair protector when the carpets were cleaned. The odor was very strong on 07/12/2022. She had allergy and asthma related issues from the odor. On 07/
