On November 24, 2021, a complaint was received stating that on November 20, 2021, Child A came home and said a yellow Pikachu hit him and grabbed him by the arm. He was playing with a red car and everyone laughed at him. On November 26, 2021, I interviewed Child A's Mother via telephone. She stated that on November 20, 2021, Child A came home from the center and said that a Pikachu had hit him at school. When further prompted, he did not give any more explanation. He did not want to go back to the center. He had an "owie" on his arm and pointed to it. He was asked what a Pikachu is, and he said "Miss Nikki." Child A's Mother immediately contacted the center and spoke with the assistant director Dorothy Earegood. When told what happened, Ms. Earegood informed her that they are a non- hitting facility and that they only use time-out, so it could not have happened. She stated that she would look into it and call her back. Ms. Earegood never called her back or gave her an explanation for why Child A would say that. She did not take Child A for any medical treatment because he did not have any visible injuries. Child A has not returned to the center since that time and will not return. On November 30, 2021, I completed an unannounced onsite inspection at the center. I interviewed Marcy Hadsall, the program director. Ms. Hadsall stated that Child A had only recently started attending the program. He had only attended 6 times prior to the complaint being made. He had not had any behaviors and is a good child. She recalled that his mother seemed to be upset about him not being able to bring his favorite snack (some kind of chips) while at the center. The center provides the meals and snacks, and it became an issue with him being upset and obsessed about his snacks. So initially they had to address him not having his snacks with him while there. Then there was an issue with payment and when they could pay the center. Ms. Hadsall had to reiterate their payment requirements to her. Now that this allegation has been made, Ms. Hadsall feels like it is retaliation of some sort. She is not sure why the family would make up such an allegation, and she is not sure that the child even said that. None of her staff hit the children and this would never be allowed. They only use time-outs and positive reinforcement. Ms. Myers is a great worker and would not have done this. In addition, Ms. Earegood works in that room with her, and she is hardly ever alone with the children. Ms. Earegood would know if she ever mistreated a child. On November 30, 2021, I interviewed Ms. Earegood during the onsite inspection. Ms. Earegood acknowledged that she is the one who took the phone call from Child A's Mother when she informed them of the allegations. She immediately reassured her that they do not hit children in the center and that it must have been a misunderstanding of what he said. She did recall telling them she would look into it, but she did not get back with them. Since they never brought him back to the center, she did not have a follow-up conversation with them about it. In hindsight, she should have followed up and would had been able to 3 explain Ms. Myer's response. Ms. Earegood reiterated Ms. Hadsall's statements about Ms. Myers being a good worker and their discipline policy. On November 30, 2021, I reviewed Ms. Myer's personnel file. She did not have any previous discipline action against her. She had completed a fingerprint background check and is eligible to work in a childcare center. She has completed all the required trainings for a caregiver. On November 30, 2021, I interviewed Ms. Myers via telephone. She denied hitting Child A for any reason. Physical discipline is not allowed, per the center's discipline policy. She stated that Child A is very smart, verbal, and well-behaved. He had barely just started attending the program. She denied wearing any Pikachu clothing and had no idea where that information came from. They wear smocks over
