On June 28, 2023, I received an incident report from the center indicating Child A had sustained a fracture to her ankle while playing in a bounce house. She was "on a slide and slide down and tumbled down and her ankle got twisted in her roll." CCSM2 provided first aid to her and put an ice pack on it immediately. They contacted her mother right afterwards, she was taken and treated at Genesys emergency room. On June 30, 2023, I interviewed Child A's Mother. She stated that she was contacted by the child care center on June 28, 2023, letting her know that Child A had hurt her ankle while playing in a bounce house. It was around 9:30am, so she came to the center to pick her up and she was subsequently treated at the emergency room. She was aware they were going to use the bounce house and signed a permission slip for it. It was an accident, and she didn't have any concerns about the care or supervision of the staff. Child A was diagnosed with a fractured ankle and has to wear a cast while it heals. She has since returned to the center. On June 30, 2023, I contacted the center to confirm the bounce house was located onsite when the incident occurred. I interviewed CCSM1, who confirmed that it was followed up with an email to program director Holly Spittler regarding the rule and bounce house requirements. On July 07, 2023, Ms. Spittler emailed me stating that she was unaware of the bounce house rule, and they will definitely not have one again. On July 11, 2023, I completed an unannounced onsite inspection at the child care center from 10:45am to 11:45am. Ms. Spittler was present and working in the center. She acknowledged that the incident had occurred while playing in a bounce house they had onsite. She was unaware that they were not allowed to have that equipment in a center. They had brought one in for the little children since they do not get to go on field trips where they might have them. They even had the parents sign permission slips to use them. Child A's Mother was not upset at all. She has stated before that she is very rambunctious and a "climber." During the inspection, I observed Child A playing in her classroom. She was wearing a leg cast. Ms. Spittler agreed that they would not have any more bonce houses at the center. On July 11, 2023, I completed an exit conference with Ms. Spittler. She completed a corrective action plan during the onsite inspection. 3

On 10/25/2022, I conducted an interview with child care consultant Lisa Gundry. In September she received the incident report and she spoke with Child A's mother, child care staff member 1 Morgen Sergent, child care staff member 3 Aiden Trout, child care staff member 4, Chloe Sands, program director Tasia Bierbusse, and assistant director Jordan Davison. At that time, there was not a reason to open a special investigation. On 10/27/2022, I completed an unannounced onsite inspection at Circle of Friends Child care, 5318 Lapeer Road Burton MI. I met with Program director Tasia Bierbusse and assistant director Jordan Davison. This incident happened a month or so ago. When Child A's mom pulled into the parking lot, the children were still outside on the playground. One child was "tickling" Child A under the chin but instead of "tickling" him, the child turned their head away and accidently hit Child A in mouth area. Initially Child A was fine, and the other child was tearful because they thought they hurt their friend. When Child A's mother walked up and she was told what happened, Child A began to cry and scream, which was bout 5-10 minutes after the initial incident had happened. Child A's mother brought him inside and the third in charge Hailey Rowe was present. Child A's mother requested an incident report, and even though Hailey did not see what happened, she wrote mom an incident report, according to what Child A's mother said happened. The child care staff members who were present on the playground were child care staff member 3, Aiden Trout, and child care staff member 4, Chloe Sands. Child A left with their mom, and the next morning Child A's mother called up to the center and was cussing and threatening child care staff member 1 Morgan Sergent with calling CPS on her, having her own personal children removed from her care. Child A's mother was very rude, she was yelling and said she was recording the conversation. This is when program director felt she had to draw the line and so she called Child A's mother to check in on Child A. Child A's mother reported she had taken him to the dentist, and they told her nothing was wrong. She then said she took him to an urgent care, and nothing was wrong either, so she took him to the hospital, and nothing was wrong with him. Ms. Bierbusse informed Child A's mother he could no longer come to child care due to the way she spoke with Ms. Sergent this morning. However, Child A's mother wanted to bring him back the next day, they declined to allow him to return. She was told her child's belongings would be by the front door in a bag, but he was no longer allowed to return to child care. Child A's mother told Ms. Bierbusse she would be calling the police. An officer with the Burton Police Department did come out to the center. Ms. Bierbusse stated she was confused as to why he was there, but Child A's mother wanted to press charges against the little boy who had hit Child A in the mouth. Child A was withdrawn from care on 09/14/2022, the incident happened 09/13/2022. There was another time Child A's mother claimed the center was not feeding her child the lunch she sent with him. This incident involving the lunch was explained to mom that one of the other children at the center was returning home to his biological family and it was his last day the center and the foster family had sponsored a pizza party for the center to celebrate, so Child A had eaten pizza instead of the packet lunch. They have not received anything from Child A's mother regarding an injury, from a dentist or doctor. 5 On 10/27/2022, I interviewed child care staff member 1, Morgan Sergent. Ms. Sergent has been employed at the center for around five years. She is the lead in the preschool classroom; however, she has worked in every classroom in the center when they need her to. On July 20, 2022, I interviewed the complainant. The complainant stated that recently the center has been remodeling their windows and they busted out the front windows. The playground is blocked. There are power tools laying around that are unsafe for the children to be around. Staff had informed the director Tasia Bierbusse not to do it doing child care hours but she did anyways. Now the children have to walk right by it and it is not safe. They have not observed anyone get hurt but it is not a good idea to begin with. On July 26, 2022, I completed an unannounced onsite inspection. Upon arrival, I observed two men working on the front windows that run alongside the hallway in the center. They had built a temporary wall between the hallway and the windows while 2 they worked. The wall was ten feet high and there were no power tools in the hallway. Ms. Bierbusse was present and interviewed. She acknowledged that they are replacing the windows and some of the repairs are being completed during child care hours. She is not happy that it has to happen during that time because it is noisy and disruptive at times; however, she does not have much of a choice. She has requested that they stop during nap time and do quiet tasks if possible. She denied that the tools have been in the child care areas and they have taken extra precaution to block of the whole area. She gave me a tour of the whole area and I viewed the inside and outside areas where they have been working. They started a couple weeks ago actually and no one has complained or said anything. There have been no injuries or incidents as a result. The playground is accessible and they children go around the mess. One parent expressed a dislike that it could be disruptive. Ms. Bierbusse agreed and explained they are doing their best. The windows will be a large improvement. They recently modified the building to include another classroom. They have had both the health department and fire safety inspectors out and there were no health and safety violations. On July 26, 2022, I interviewed child care staff members Camryn Sabin, Madison Groulx, and Jennifer Dawson and Holly Spittler. All of them denied that the children have been exposed to unsafe conditions as a result of the renovation. The tools are put away and they children are nowhere near the mess.

On July 20, 2022, I interviewed the complainant. The complainant stated that Ms. Bierbusse is not in the center as much as she should be. She was recently on vacation and not in the center much before that. She arrives there late, most the time not even until noon. On July 26, 2022, Ms. Bierbusse was present in the center when I arrived for an unannounced onsite inspection. Ms. Bierbusse stated that she is present in the center typically every day of the week. She denied that she is not there at least 50% of the time. She is the driver for many of the field trips or routine transportation that they provide, so she is in and out daily. The center is opened from 6am to 6pm, for 12 hours 3 per day. That requires her to be present six hours total each day. She usually does not arrive until around 10:00am and then will stay until closing time. She is not an opener so many of her parents do not see her during drop off, but she is there during pick-up. She indicated that she was unexpectedly on a medical leave for two weeks at the end of 27th May. She consulted her calendar and confirmed that she was off from May until June 13, 2022. She had an appointed designee, her assistant Jordan Clark, in her absence who was running the center. Even during that time, she was still involved and doing things, but just from home. She was off for vacation from June 27th through July 03, 2022. No one has complained to her or indicated that she is not there enough. There hasn't been any incidents or concerns in her absence. I reviewed a copy of Ms. Bierbusse's timesheets. For the week of July 11-15, Ms. Bierbusse worked 5 hours on July 13, 2022. Ms. Bierbusse stated that she had a scheduled appointment that day and did not come in until later that day. The other fours days of the week showed Ms. Bierbusse coming in a minimum of six hours per day ranging until 8 hours per day. For the week of July 18-25, it showed her clocked in daily for a minimum of six hours a day. Three of those days she was clocked in for eight or nine hours. Ms. Bierbusse indicated that sometimes she will clock out even when she is going to a director's training, even though really it is a working lunch or a child care meeting. I informed her that she is allowed to be absent from the center for trainings and other tasks relevant to the child care center, including transportation. These would all count towards the required 50% of her required time in the center. In addition, the hours do not have to be consecutively in the center, so she could be gone for transporting etc. On July 26, 2022, I interviewed Ms. Sabin, Ms. Groulx, Ms. Dawson, and Ms. Spittler. All of them stated that Ms. Bierbusse is present in the center at least half of the time that children are present. They had no idea why someone would make this allegation. They all confirmed that she was recently absent for a short medical leave and then a short vacation. Jordan Clark is the assistant director and is in charge during her absence. Ms. Clark is able to handle the day too day operations when she is gone. They all corroborated that Ms. Bierbusse handles the transportation and field trips. She is in and out for that but otherwise is in the center. On August 23, 2022, I completed an exit conference with Ms. Clark. Ms. Bierbusse was on a field trip. She stated that the window project is completely done and the hallway is back to normal.

On 07/08/2021, during an unannounced onsite inspection I spoke with Ms. Tasia Bierbusse, program director/owner regarding the allegations. She explained that yesterday, (07/07/2021), the baby room was scheduled to have nine children. They had to move a child up to the toddler room. Child A is mobile and so she is the child that was moved up. Child A was in the toddler room for approximately 10 minutes because a parent of one of the children in the infant room called in and the child would not be attending care for the day. While Child A was in the toddler room the staff placed her in a toddler chair and gave her a snack to eat. Child A leaned to the left while in the chair and fell to the floor. Child A was not injured during the incident. She braced herself with her arm and fell to the floor. She was not crying or upset following the incident. Staff came to help Child A up from the floor. There were three staff members and a potential staff member (working interview) in the room at the time. Ms. Bierbusse contacted Child A's Mother and Father regarding the incident and allowed Child A's Father to view the video when he came to the center to pick up Child A at the end of the day. During my onsite investigation Ms. Bierbusse allowed me to view the video tape. Ms. Bierbusse showed me the toddler and I observed the chair that Child A had fallen from and it is a toddler size chair that sits low to the ground for younger children to maneuver. On 07/08/2021, I spoke with Breanna Trapp regarding the allegation. She was present in the room when Child A fell from the toddler chair. Child A leaned over in her chair causing her to fall. She caught herself with her arm and then fell the rest of the way to the floor. Child A hit her head but not directly on the floor. Child A got up and walked away and she didn't cry or become upset because of the incident. On 08/03/2021, I spoke with Child A's Mother regarding the allegations. She was called immediately by Child A's Father on 07/07/2021. They both believe that the staff were being neglectful when they put Child A in the chair unsecured. Child A did not receive any injuries from the fall but it was very upsetting to both Child A and Child B's Father. She was also upset because it took staff approximately 45 minutes to send her a picture of Child A, showing that she had no injuries. Child A's Father was shown the video when he arrived at the center to pick up Child A at the end of the day. She was concerned that the staff just watched Child A fall to the ground and did nothing about it. Child A's Father also questioned why Child A remained in the toddler room when there were enough staff members to cover for number of children in the infant room. Ms. Bierbusse told them that Child A was returned to the infant room after only being in the toddler room for approximately 15 minutes 8th because there were only 7 infants in the infant room (making Child A the infant). Ms. Bierbusse told them the next day that they would no longer be welcome at the 3 center and would need to seek child care elsewhere. Child A's Mother and Child A's Father were very upset because they could not find alternative daycare for quite some time and missed a great deal from work because of it. On 08/26/2021, I spoke with Diana Natthess (working interview) regarding the allegation. She was closest to Child A when she fell from the chair and helped Child A up from the ground. The chair was very close to the ground because it is a toddler chair. Child A cried for maybe two seconds and got up and walked around. Child A was probably more stunned by what happened than anything else. The staff immediately reported the incident to Ms. Bierbusse. She contacted Child A's Mother and Child A's Father. Child A's Father arrived at the usual time to pick up Child A and he began screaming and yelling at the staff who was in the room during the incident. Child A's Father returned the next day with Child A for child care. Ms. Bierbusse in

I spoke with Ms. Bierbusse regarding the allegation and she had questioned all of the staff members and no one heard or admitted to swearing in the office the morning of 07/07/2021. Ms. Bierbusse asked Child A's Mother who she had overheard swearing and she thought it was a certain staff member, however, that staff member was not present at the time and didn't arrive at the center until later that morning. Ms. Bierbusse did remind staff that this type of behavior is not professional and not acceptable. I spoke with Ms. Trapp, Ms. Natthess, Ms. Crawford and Ms. Bailey regarding the allegation and they all denied swearing or hearing any staff members swearing in the office on 07/07/2021. I spoke with Child A's Mother regarding the allegation and she admitted that she had not seen which staff member had been swearing but did hearing swearing from the office. 5

On 05/07/2021 I interviewed Person 1 who stated she was notified that Child A's Guardian was contacted to have Child A picked up from the child care center on 05/06/2021 and at this time Ms. Bierbusse admitted what she had said to Child A. On 05/10/2021 I interviewed Child A's Guardian who explained on 05/06/2021 that she received a telephone call from Ms. Bierbusse stating that Child A got upset when playing with another child and attempted to leave the building. Child A's Guardian added that Ms. Bierbusse reported that at this time she "may have lost her 2 cool and said a bad word to Child A". Child A's Guardian asked Ms. Bierbusse what she said to Child A and she replied, "If you put a _ hole in my door, I will spank you". Child A's Guardian reported that Ms. Bierbusse notified her that Child A needed to be picked up from the child care center, so her cked Child A up. Child A's Guardian reported that Child A told her husband tha was upset and husbandi they decided that Child A would to the child care center. On 05/12/2021 I completed an unannounced onsite inspection at the child care center from 1:08 pm — 1:40 pm and interviewed Ms. Bierbusse and child care staff members (CCSM) Amber Crawford and Jordan Davison. Ms. Bierbusse stated that 0 Child A became upset on 05/06/2021 when was playing with magnetic tiles and another child would not give more of the tiles. Ms. Bierbusse stated at this time Child A ran out of the room an toward the door to exit the building, yet a CCSM stopped from exiting the child care center. The unknown CCSM brought Child A into her o ice and began pushing the door hard. Ms Bierbusse could not recall what she said to Child A at this time. I notified Ms. Bierbusse of the alleged statement that she said to Child A and Ms. Bierbusse's response was, "I probably said it." When I asked Ms. Bierbusse if she was admitting to making the statement to Child A, she responded that she was not denying that she did. I clarified if Ms. Bierbusse was not denying that she made the statement and she agreed that she was not denying making the statement. On 05/12/2021 I interviewed CCSM Amber Crawford who stated that she was not in the office at the time of the incident, yet she was the one that prevented Child A from running out of the building earlier that day. On 05/12/2021 I interviewed CCSM Jordan Davison who stated that she was in the office at the time of the incident, yet she did not recall what Ms. Bierbusse stated to Child A. Ms. Davison confirmed that she was the one that prevented Child A from running out of the building and brought to Ms. Bierbusse in the office.
