On 02/03/2022, I completed an on-site inspection. I interviewed program director Jennifer Swisher. I was unable to interview child care staff members because they were needed to maintain appropriate child care staff 3 member to child ratios in the classrooms. I observed appropriate child care staff member to child ratios in each classroom. Ms. Swisher stated she was not aware of the center failing to maintain appropriate child care staff member to child ratios. She agreed to send me staff and child attendance for 12/01/2021 to present via email. On 02/03/2022 and 02/04/2022, I received staff and children attendance records from program director Jennifer Swisher via email. On 02/04/2022, I interviewed the Complainant via telephone. The Complainant stated that younger children and school age children are routinely mixed with the preschool children in the preschool classroom when there is not enough staff. The Complainant observed the center to be in violation of appropriate child care staff member to child ratio requirements approximately 10 to 20 times. On 03/01/2022, I conducted separate telephone interviews with CCSM 1, CCSM 2, CCSM 3, and CCSM 4. They stated they are not aware of the center failing to maintain appropriate child care staff member to child ratios. On 03/04/2022, I reviewed staff and children attendance records with program director Jennifer Swisher via telephone. Based on the attendance records and Ms. Swisher's explanation of staff and children placement, the center has maintained appropriate child care staff member to child ratios.

On 02/03/2022, I completed an on-site inspection. I interviewed program director Jennifer Swisher. Ms. Swisher stated that staff are trained to wear gloves when prepping and serving food. Other than an occasional reminder to new staff, staff routinely wear gloves when handling food. On 02/04/2022, I interviewed the Complainant via telephone. The Complainant stated that gloves are not worn by staff when food is prepped or served. The center has gloves, but staff just do not wear them when handling food. On 03/01/2022, I conducted separate telephone interviews with CCSM 1, CCSM 2, CCSM 3, and CCSM 4. They stated that they always wear gloves when handling food. They have not witnessed anyone handling food without gloves.

On 02/02/2022, along with the written complaint, I received five photos of mouse droppings on various surfaces. Photo #1 shows mouse droppings in a white plastic silverware tray in a kitchen drawer. Photo #2 shows mouse droppings on the top shelf and the bottom shelf of a cupboard with boxed and packaged foods. Photo #3 shows mouse droppings on the bottom of a cupboard with boxed food. Photo #4 shows mouse droppings on a package of Kings Hawaiian rolls inside a cupboard. Photo #5 shows a mouse dropping beside the rolls shown in Photo #4. On 02/03/2022, I completed an on-site inspection. I interviewed program director Jennifer Swisher. Ms. Swisher stated she has not seen any mice at the center. The discovery of mouse droppings has been very rare. Staff immediately clean up the droppings when found. I inspected the cupboards, drawers, and baseboards in the kitchen. I observed and photographed mouse droppings in cupboards, a drawer, and food on the floor. Photo #6 shows mouse droppings in a drawer with aluminum foil and plastic food storage bags. Photos #7 and #11 show mouse droppings on a top shelf in a cupboard. Photo #8 shows mouse droppings in a cupboard beside a package of pancake mix. Photos #9, #10, and #12 show mouse droppings in the cupboard under the sink. Photos #13, #14, and #15 show pieces of food on the floor near the floorboards of the cupboards. The photos were taken at approximately 11:20am at which time no food prep was occurring. On 02/04/2022, the Complainant stated that the center has had an ongoing issue with mice for over a year. The Complainant stated that the pictures provided in the written complaint were provided by CCSM 4. On 03/01/2022, I conducted separate telephone interviews with CCSM 1, CCSM 2, CCSM 3, and CCSM 4. CCSM 1 stated she has no knowledge of the center having mice. CCSM 2 stated that she has heard rumors about the center having mice, but she has not seen anything herself. CCSM 3 stated she has seen photographs of mouse droppings in what appears to be the kitchen at the center, but she has not seen anything herself. CCSM 4 stated that the center has had an ongoing issue with mice for approximately six months. Child care staff members who close are expected to clean up mouse droppings in the kitchen. She cleaned up mouse droppings in the kitchen several months ago. She took photos provided to the Complainant sometime last fall.

She adamantly denied ever seeing staff grab children by their arm or otherwise. On 03/01/2022, I conducted separate telephone interviews with CCSM 1, CCSM 2, CCSM 3, and CCSM 4. CCSM 1, CCSM 2, CCSM 3, and CCSM 4 stated they never witnessed any staff member yell at or grab a child.

On 02/11/2022, I received a telephone call from Child D's Mother. She stated that she received a text from a child care staff member indicating that program director Jennifer Swisher did not allow the preschoolers to eat breakfast this morning because they did not clean up in time. On 02/11/2022, I completed an on-site inspection. I interviewed CCSM 1, CCSM 2, CCSM 3, and CCSM 6. I also conducted a group interview with Child A, Child B, and Child C. I concluded the inspection with an interview with program director Jennifer Swisher. CCSM 1 stated that she sat out breakfast for the preschools and reminded them it was time to clean up before she returned to her classroom. She has no idea if the preschool children ate breakfast or not. CCSM 2 stated that when she arrived at 9 am Ms. Swisher instructed her to throw away the bowls of cereal and milk set out on the table. She has no idea if the children were offered an opportunity to eat or not. She did not observe any food on the table or floor, as if it had been untouched. CCSM 3 stated she has no idea if the preschool children ate breakfast or not. CCSM 6 stated that she briefly went to the preschool classroom just before 9 am when she observed breakfast sitting on the table undisturbed. Ms. Swisher told her that the children were not getting breakfast because they did not clean up. During outdoor play, I interviewed Child A, Child B, and Child C in a group. I asked the children to tell me what they had for breakfast. Child A stated that they did not get breakfast because they did not clean up. He then stated that "no one" got breakfast. He further stated that "Ms. Jen" said no one was getting breakfast because they did not clean up. Child B and Child C also stated they did not get breakfast because they did not clean up. Ms. Swisher adamantly denied the allegation. She stated the children were served, seated, and offered breakfast. She stated that some children chose not to eat, but every child was offered breakfast. I advised her that I had three preschool children who told me that they were not allowed to eat breakfast because they did not clean up. She insisted the children had an opportunity to eat breakfast. She denied withholding breakfast from any of the children.

On 02/11/2022, I received a telephone call from Child D's Mother. She stated that she received a text from a child care staff member indicating that the center has no running warm water. Additionally, program director Jennifer Swisher instructed staff to act like they were unaware of not having warm running water if child care licensing happened to show up. On 02/11/2022, I completed an on-site inspection. I interviewed CCSM 1, CCSM 2, CCSM 3, CCSM 6, and program director Jennifer Swisher. CCSM 1, CCSM 2, CCSM 3, and CCSM 6 stated the center did not have any running warm water. CCSM 3 stated the center has not had running warm water since 7:30am. She stated the cold water hurts the younger children's hands during hand washing. During the inspection, I measured the hot water temperature at the two sinks in the preschool bathroom using a digital food thermometer. The water from one hot water faucet measured 52.2 degrees Fahrenheit and the other measured 51.9 degrees Fahrenheit. The water from each hot water faucet was cold to the touch. I asked Ms. Swisher what the plan was to restore the hot water at the center. Initially, she acted surprised about having no hot water. I advised her that it had already been confirmed that the center has had no running hot water since 7:30 am. She paused for a moment and then stated that the hot water heater was scheduled to be replaced on 02/12/2022. I advised her that the children would not be able to remain in care without running warm water. She stated she would begin to contact parents for pick up. On 03/01/2022, I conducted separate telephone interviews with CCSM 1, CCSM 2, CCSM 3, and CCSM 4. They stated that the children were sent home on 02/11/2022 due to not having warm running water. The center had warm running water again on Monday, February 14. rj
