The complainant did not have any firsthand information regarding this allegation. The complainant was told by someone else that Child B may have been placed in the crib in a dark room with the door shut. There were no known dates of when this may have occurred. The complainant did not disclose that this was done in a rough manner during the interview. The complainant believes that Former CCSM 3, a former child care staff member was present. I interviewed Child A’s Mother alongside Child A’s Mother has not observed the children disciplined in this manner. However, she was told by someone else that this may occurred. Former CCSM 3 may have been employed at the time. I interviewed Ms. Barber alongside Ms. Barber denied the allegations. She stated that children are not placed in a dark room in a crib for discipline. She denied handling the children in a rough manner. Ms. Barber indicated that discipline of infants and toddlers consists of redirection. Time out is used for children ages three years and older in the main child care room with the other children and caregiver present. 8 I interviewed AHM 1 alongside He did not have any concerns. AHM 1 was not aware of any child being placed in a crib in a dark room for discipline. He has never observed the children handled in a rough manner. I interviewed CCSM 1 alongside She denied the allegations. CCSM 1 did not have any concerns. She denied that the children are placed in a crib in a dark room alone for discipline. She denied that the children are handled in a rough manner. Discipline of the children consists of talking and redirection. If time out is used with the older children, time out occurs in the main room sitting by a child care staff member. Time out does not occur in the bedrooms. I interviewed CCSM 2. She has been employed for one month. She has no concerns regarding discipline, saying that that normally don’t have to use discipline with the children. Children under 3 years old are verbally redirected. Children over 3 years old may receive a time out as a last resort in which they will sit next to a child care staff member. The children remain in the same room as the other children and child care staff members. The lights are kept on. They do not use cribs as a time out location. She has never observed the children handled in a rough manner. I interviewed Former CCSM 3 alongside Former CCSM 3 stated that while working with Ms. Barber from “May 2023 and earlier”, there was a “time out crib.” Former CCSM 3 did not report that the children were handled in a rough manner. The time out crib is a regular sized crib and would be behind a closed door in the bedroom. This occurred with children ages 1 to 3 years of age and the children would be put in any room. The children would be placed in the time out crib if they were pushing or shoving each other. Former CCSM 3 did not identify a particular child or date that this occurred but said that this occurred approximately 10 times. While Ms. Barber was placing the children in the crib, she would say “you’re not listening.” Ms. Barber would leave the room and close the door. The children remained in the room for a few minutes. Ms. Barber would then go back into the room and would ask if they were going to behave better. The children would then regain the rest of the group of children. Former CCSM 3 believed that the lights to the room were turned off as the lights were normally turned off during nap time. She did not remember seeing Ms. Barber turn the lights back on before shutting the door. She did not observe children ages 4 and older be disciplined. I interviewed Child B’s Mother alongside Child B’s Mother has no concerns. Child B’s Mother “loves” Ms. Barber saying that she takes good care of Child B. Child B likes attending and has never expressed or exhibited any concerns. Child is always excited to attend. Child B’s Mother believes that discipline consists of redirection. Ms. Barber told Child B’s Mother that she does not use

Ms. Barber places “bad children” in a crib. She will grab the children roughly, put them in the crib, and lock them in a room all alone. There is a crib in the bathroom next to the toilet that the children use to sleep in. Ms. Barber has firearms in her home, even though she states on applications that she does not have firearms. Ms. Barber will have 12 children in care, and she will leave the home and the children with just one caregiver. There are cups at the child care that have mold on them.

The complainant stated that there is a crib in the bathroom next to the toilet that the children use to sleep in. I observed the bathroom to be a large room that contained a toilet on one wall next to a standard sized clothes washer and dryer. The other side of the bathroom contained a changing table, a crib, and a sink. The crib was not next to the toilet, as it was approximately seven paces away. The bathroom was large enough to support all the above listed items. Child C was observed sleeping in the crib. I interviewed Ms. Barber alongside She stated that she has a crib in the bathroom. Ms. Barber stated as she thought would be acceptable because the crib is not near the toilet, but on the other side of the room. She indicated that sometimes children prefer to sleep in a quieter environment versus in the large childcare room. Ms. Barber agreed to move the crib out of the bathroom. I interviewed CCSM 1 alongside CCSM 1 stated that that the crib located inside the large bathroom is used for sleeping by the children. The crib is not next to the toilet as it is located across the large bathroom. 17 I interviewed CCSM 2. She stated that since beginning employment about a month ago, she has never observed a crib in bathroom. I interviewed Ms. Barber and additional time. She stated that this has been corrected. The crib is no longer located inside the large bathroom.

The complainant stated that there are no firearms “laying out”, but that there are firearms in the house. The complainant did not know if the firearms are properly locked and secured. I interviewed Child A’s Mother alongside Child A’s Mother stated that Ms. Barber has guns in the home, but she has not observed them. She does not know if they are properly locked and secured. I interviewed Ms. Barber alongside Ms. Barber stated that the home contains one firearm and related ammunition, but neither the firearm nor ammunition are kept in the child use areas. The firearm is kept unloaded in the garage, which is not used by the children. The door leading from the home to the garage is made inaccessible by a child proof knob protector. The ammunition is kept in an outside shed, which she believed was locked. Ms. Barber showed me the garage, which contained a shot gun style gun leaning up against the wall. She again stated that she believed that the gun was unloaded. Ms. Barber showed me the outdoor shed, which she believed to be locked. The lock on the shed door was not working properly. Ms. Barber was not able to locate any ammunition inside the shed. Ms. Barber stated that she would properly secure the gun and ammunition today. 18 I reviewed Ms. Barber’s Child in Care Statement Forms for the enrolled children. The completed forms marked “no” next to firearms at the residence when it should have been marked “yes”. Ms. Barber stated that she did not realize that she needed to tell the parents about the firearm because it was not located in a child use space. I explained to Ms. Barber that parents needed to be notified if firearms are anywhere on premises. Ms. Barber agreed to update this information with her parents on the Child In Care Statement forms. Ms. Barber contacted me later the same day via text messages with photographs of the new lock on the outdoor shed where the ammunition is stored, and the gun safe that was purchased to store the firearm. I interviewed AHM 1 alongside AHM 1 stated that the only firearm in the house is a shot gun in the garage. The shotgun is not loaded. The children do not have access to the garage. The ammunition is kept in the outdoor shed which the children do not enter. I interviewed CCSM 1 alongside CCSM 1 has not observed any firearms inside the home but is aware of a firearm being in the garage. She was told about the firearm being in the garage when she first started. Neither she nor the children are in the garage. She did not know if the firearm was loaded or not. I interviewed CCSM 2. She stated that when she began employment about a month ago that she was told the home has a gun in a locked gun safe. She has never observed any guns. I interviewed Former CCSM 3 alongside Former CCSM 3 stated that when she worked at the child care, she knew there was firearms, but she did not have any firsthand information on their location. Former CCSM 3 has not observed any firearms at the residence. I interviewed Child B’s Mother alongside Child B’s Mother did not report any safety concerns at the residence. She was not aware of any weapons or firearms at the residence. I interviewed Child C and Child D’s Mother alongside Child C and Child D’s Mother has no safety or weapon concerns at the residence. She is aware that the home has firearms as she signed a statement indicating that there is a gun safe. I interviewed Child E’s Mother alongside Child E’s Mother has no concerns regarding any safety hazards in the home. She was not aware of any firearms in the house. I interviewed Child F’s Mother alongside Child F’s Mother has no concerns regarding any safety hazard in the home. She was made aware that the 19

The complainant stated that Ms. Barber had a doctor appointment during child care hours on 4/12/23 at 12:30p.m., leaving the children with just one child care staff member. The complainant did not identify the name of the child care staff member left alone with the children. I interviewed Child A’s Mother alongside Child A’s Mother has not observed one child care staff member with more than six children. However, Child A’s Mother believes that Ms. Barber may have left one child care staff member alone with too many children on 4/12/23 when she had a doctor’s appointment. I completed an unannounced on-site inspection alongside Ms. Barber was caring for 10 children alongside CCSM 1, thus having enough child care staff members for the number of children in care. I interviewed Ms. Barber alongside Ms. Barber stated that she works hard to be in compliance with having enough child care staff members. When she was first licensed in January 2023, she was the only child care staff member until she reached six children. She then hired Former CCSM 3 in March 2023. CCSM 1 was also hired. Former CCSM 3 and CCSM 1 both worked part time until Former CCSM 3 quit in May 2023, making CCSM 1 a full time CCSM. Ms. Barber stated that Former CCSM 3 and AHM 1 were present when she left for her doctor appointment on 4/12/23. AHM1 is approved as a child care staff member 21 so the he can assist if she has appointments. I requested to observe the child care staff and child attendance logs for 4/12/23. Ms. Barber indicated that she has not been keeping child care staff attendance logs, as she forgot that this was required. Ms. Barber agreed to begin keeping child care staff attendance logs. Ms. Barber produced a child attendance log that indicated that there were 12 children in attendance of 4/12/23. I interviewed AHM 1 alongside AHM1 stated that he often assists at the child care, such as “putting stuff together” or “carrying stuff”, but otherwise does “not do a lot.” He may also put food in the oven. Although he may be present at the residence, he does not provide direct care for the children. He does not play or supervise them but will go downstairs on occasion. He believes that if Ms. Barber has a medical appointment, that she does this when she has six or less children, such as later in the day. He did not remember any specifics about 4/12/23 but stated that he was not left to care for the children. I interviewed CCSM 1 alongside CCSM 1 stated that she has been working at the child care since the beginning of April, 2023. She works daily. She denied being left alone with 12 children. She has never been left alone with more than six children at one time. She believes that Ms. Barber’s medical appointments take place after child care hours. She stated that at times AHM 1 will be present at the home during child care hours, but that he does not act as a caregiver of the children. He will sometimes come outside with the children. and I spoke with Ms. Barber a second time regarding AHM 1 and CCSM 1 reporting that AHM 1 does not acting as a child care staff member. She again stated that he would be present in the home and that he is an approved child care staff member. She stated that AHM 1 will come downstairs at times but admitted that he does not provide direct care to the children. Ms. Barber stated that leaving children alone with one child care staff member “could have been” and it would have been with Former CCSM 3. She does not remember that far back, but “could have”. If Ms. Barber did leave her alone with the children, it only happened once and that she was “totally fine with it, that’s fine” referring to accepting a rule violation since someone said that it happened. Ms. Barber stated that Former CCSM 3 told her that it was okay for her leave for her appointment and that she was gone during nap time for about 1 ½ - 2 hours. I completed to on-site inspections. I did not observe any cups with mold on them. I interviewed Ms. Barber alongside She denied the allegation. She stated that a lot of the parents bring their own cups. If the cups sent by the parents appear to be worn or moldy, she will not use them. While washing sippy cups, she will take them apart to be sure that all areas are washed thoroughly. Ms. Barber stated that the cups are washed either with hot soapy water or placed in her dishwasher that has a wash, rinse, and sanitize feature. I interviewed AHM 1 alongside He did not express any concerns regarding the children’s drinking cups, believing that they are properly cleaned. I interviewed CCSM 1 alongside CCSM 1 denied the allegation. She did not have any concerns regarding the cleanliness of the cups. She described herself and Ms. Barber as “clean freaks.” She has never observed moldy cups. I interviewed CCSM 2. She has no concerns. She stated that the cups do not have mold in them. I interviewed Former CCSM 3 alongside Former CCSM 3 did not have any concerns. Former CCSM 3 has never observed moldy cups. I interviewed Child B’s Mother alongside Child B’s Mother has no concerns. She believes the child care home is kept clean. She has only observed clean cups. 26
