On 02/21/2023 Ms. Fowler stated that on 02/14/2023, after the center closed, Child A's Mother, who works at the center, posted on the center's app that her husband had noticed bruises on Child A's shin which looked like fingerprints, and she posted the pictures of the bruises. Ms. Fowler did not see the notice until the next day 02/1512023. After reviewing the message and pictures, she spoke with Child A's Mother, and during the conversation Child A's Mother accused CCSM A of leaving 2 the bruises on Child A. Ms. Fowler did not think that CCSM A had left the marks on Child A, but she spoke with CCSM A and showed her the message and pictures. CCSM A stated that she did not know how Child A would have received the bruises, but they were not from her. Ms. Fowler reported the allegations to the and the Child Care Licensing Bureau. On 02/21/2023 Child A's Mother stated that when she sent the message and pictures, she was not accusing anyone; she just wanted to know if anything had happened during the day that may have left the bruises on Child A's right shin because the staff should have noticed the bruises. Child A's Mother texted a copy of the message that was sent to the center with the pictures of Child A's right shin. There were four circular marks on Child A's right shin that did not appear to be fingerprints. The marks appeared to be in different stages of healing with two pink marks, one light purple, and one was barely visible. Child A's Mother said she did not accuse CCSM A until she spoke with Ms. Fowler, and she was upset because she had sent the message in the app and had not spoken with her directly. Child A's Mother had previously requested for Child A to not be in the classroom with CCSM A, and Child A has been going back to her classroom after she made the request. Child A still attends the center, and she is still working at the center. On 02/24/2023 Child A's Mother stated that she has worked with CCSM A in the past and she has observed her being rough with the children by grabbing them by the arm, and she has raised her voice towards the children. CCSM A would tell the children, "Come back; you do not run." Child A's Mother stated that she did not accuse anyone when she first observed the marks or when she sent the message. It was not until Ms. Fowler was yelling at her about leaving the message in the app that she stated that it was probably CCSM A. Child A's Mother stated that she posted the question on the app because that is the way that parents communicate with the center and at that point she was operating as a parent and not an employee. Also, the marks were noticed after the center was closed and she did not want to wait until she went into work the next day. Child A's Mother had Child A examined by a doctor on 02/17/2023 and she did not have the findings from the examination. CCSM A, toddler lead caregiver, stated that she was shown the pictures and message that Child A's Mother had sent to the center by Ms. Fowler. She did not know how Child A could have received the bruises. She has not changed his diaper since January when he transitioned out of her classroom. When he comes back to her classroom (toddler), one of the CCSMs from the older toddler (Child A's assigned class) will come with him, and she does not interact with him because he is not assigned to her classroom. Child A is in the older toddler classroom and will come into the toddler classroom daily for lunch and nap time with a couple of other children that were having a hard time transitioning into the older toddler classroom. 3 CCSM B stated that she is a floater, and currently she mainly works in the infant classroom. She has worked with CCSM A, and she has never observed her grabbing or being inappropriate with the children. She does have a concern with her tone sometimes. CCSM A could be sweeter. It is not what CCSM A says, it is more how she says it. CCSM B has no idea how Child A could have received the bruises; she does not work in C

On May 19, 2022, program director and licensee designee, Ms. Holly Fowler called and self-reported an incident involving Child A (male, 21 months old). Ms. Fowler said she received an email from Child A's Mother on May 18 at 7:44 P.M. Ms. Fowler said she didn't read the email until this morning. According to Ms. Fowler, Child A's Mother said Child A had a bruise on his shoulders, and prior to that, she noticed bruises on his thigh. Child A's Mother was concerned that the bruises occurred during diapering at the child care center. During the conversation, l advised Ms. Fowler to call and report the incident to the Michigan Department of Health and Human Services (MDHHS). On May 19, 2022, l received an incident report from Ms. Fowler. According to the report, Child A's Mother sent an email on May 18 at 7:44 P.M. indicating the following, "Hi. I noticed this weekend some bruising on Child A's thigh that appeared consistent with a hand grasping his leg. Then today I noticed another bruise on the top back of his shoulder. Again these markings seemed consistent with marks a hand would leave both in their shape and the location. I understand that Child A can be a rambunctious toddler and may wiggle around during diaper changes but l am concerned that caregiver are grasping him too tightly during changes and leaving bruising. I don't believe that any one is intentionally harming him but at the same time these types of bruises are concerning." There were also two pictures attached to the incident report. One picture showed three circular bruises on Child A's upper left thigh. The second picture showed two circular bruises on Child A's left shoulder blade. I informed at I was currently at a child care center in Pinckney, and that I would not ma e it there in time to complete a joint investigation. We agreed to complete separate interviews with child care staff members. On May 20, 2022. l completed an unannounced on-site inspection. I interviewed program director and licensee designee, Ms. Holly Fowler, and child care staff members, Ms. Diana James, Ms. Rhonda Horste, Ms. Sydney Alread, Ms. Rebecca Early, and Ms. Rebecca Nutting, separately. Ms. Ermira Vata, Ms. Dyllan MacDonald and Ms. Dawn Eby were absent. Ms. Fowler said Child A's Father dropped Child A off on May 19, 2022, and Child A's Mother picked up later that day. Child A's Father didn't say anything to her, or the child care staff members. He doesn't talk to them due to the disagreement regarding wearing masks during the COVID 19 pandemic. Ms. Fowler said she called and left a message with Child A's Mother yesterday because Child A suffered a cut above his left eyelid during play. Ms. Fowler has not talked to Child A's Mother. Ms. Fowler does not have any concerns regarding the child care staff members' interactions with Child A in the Toddler Classroom. Ms. Fowler believes that the Cl bruises did not occur at the child care center. Child A arrives at the child care center with bruises, it's normal. Ms. Fowler said Ms. Ermira Vata is the lead child care staff member in the Infant Classroom. Ms. Fowler said Ms. Vata is very upset with the allegation that Child A was inured while in her care. Ms. Vata has been employed with the child care center for Ms. Fowler said all new child care staff members complete a two-day training before working with children, which includes the Health and Safety trainings, Child Care Education Institute (CCEI) courses, and a Toddler Training checklist. Also, the new child care staff members are required to complete classroom observations and diapering procedures before working with children. Ms. Fowler described Child A as a typical child who likes to climb and wrestle. According to Ms. Fowler, she completed a classroom observation on May 19, 2022. She observed Ms. Horste change Child A's diaper. Child A did not move or wiggle; he was calm. Ms. Fowler said when Ms. Horste took Child A's diaper off, she didn't see any bruises on his thigh.
