The hot tub in the back yard was observed to be unlocked and the children had access to it.

A licensee shall ensure that barriers exist to prevent children from gaining access to any swimming pool, drainage ditch, well, natural or constructed pond, or other body of open water located on or adjacent to the property where the child care home is located. These barriers must be a minimum of 4 feet in height and appropriately secured to prevent children from gaining access to such areas.

The back yard was observed to have a soft side pool accessible to the children without a minimum of a 4 foot barrier.
