MCL 722.115 License required; applicability; application; forms; investigations; on-site visit; issuance or renewal of license; investigation and certification of foster family home or group home; placement of children in foster family home, family group home, unlicensed residence, adult foster care family home, or adult foster care small group home; certification; criminal history check; "good moral character" defined. (2) A person, partnership, firm, corporation, association, nongovernmental organization, or governmental organization, except for the department of health and human services or a local county department of health and human services office, shall not establish or maintain a child care organization unless licensed by the department. Application for a license shall be made on forms provided, and in the manner prescribed, by the department. Before issuing or renewing a license, the department shall investigate the applicant's activities and proposed standards of care and shall make an on-site visit of 3 the proposed or established organization. Except as otherwise provided in this subsection, if the department is satisfied as to the need for a child care organization, its financial stability, the applicant's good moral character, and that the services and facilities are conducive to the welfare of the children, the department shall issue or renew the license. If a county juvenile agency as defined in section 2 of the county juvenile agency act, 1998 PA 518, MCL 45.622, certifies to the department that it intends to contract with an applicant for a new license, the department shall issue or deny the license within 60 days after it receives a complete application as provided in section 5b.
Ms. Munson has an open group child care license at 7686 S. 25 Road Boon, MI 49618. I arrived at that address for an interim inspection. There was no answer at the door. I spoke with Ms. Munson by phone. Ms. Munson explained that she is no longer living at that address and has moved to 1012 South Haskins Boon, MI 49618. I arrived at Ms. Munson's new house. Ms. Munson has been residing in her current home since December 2022. Ms. Munson confirmed that she is providing care to one child, Child A (female, 3 years), who Ms. Munson has provided care for since Child A was a baby. I advised Ms. Munson that her child care license does not carry over from address to address, and she is not licensed to provide child care at her 2 current home. Ms. Munson confirmed that Child A is not related, that she has been providing care for Child A since December 2022 in her current home, and she is getting paid more than $600 annually for Child A. Advised Ms. Munson that currently she is providing unlicensed care, which is against the law, and cannot continue caring for Child A, while getting paid. Ms. Munson signed the unlicensed care form stating that she will cease caring for children until she is licensed. Ms. Munson has applied for a new license at her current address, and was referred to a navigator. However, has not yet completed the enrollment process. Ms. Munson stated that she had concerns that if she opens her license now, that she will lose a grant the Navigator is helping her with because she cannot have kids in care prior to the grant being distributed. While at the home, Ms. Munson contacted the bureau to check on her application and see what documents were missing from her enrollment. On 5/31/2023, phone contact was made with Ms. Munson. She confirmed that she is no longer receiving payment for Child A, but continues to watch her as they are family friends and she knows that Child A's Mother doesn't want Child A to go to anyone else for care. Ms. Munson confirmed that she is no longer pursuing getting licensed at her current home, as she is hoping to be moving soon. She has a new home lined up, which she has already submitted a license application for. On 5/31/2023 I made phone contact with Child A's Mother. She confirmed that Ms. Munson still provides some care for Child A, however Ms. Munson is no longer receiving payment for it.
