    On 12/14/2023 I received an incident report from Program Director, Kristen Miller. She reported that Child A and Child B went to the locker room bathroom in the field house, without telling any of the (6) staff members that were in the field house. Children were called to line up and leave the gym. Ms. Miller stated that no staff member counted the number of children before leaving the gym. After arriving to their classrooms, Child care staff member, Amanda Kassab, observed Child A was not in the classroom and walked back towards the gym. Sacred Heart Staff Member, Camilla McCaffrey (Fourth Grade Teacher) was walking the girls back towards the preschool room after finding them. Ms. McCaffery stated that children were found by two high school students in the girl's locker room bathroom. Parents were notified of the incident on the day it occurred. On 12/15/2022, I completed an unannounced, onsite inspection at Sacred Heart Academy. I interviewed Program Director, Kristen Miller and six child care staff members that provided care in the field house on 12/13/2022 (the date of the incident). The staff members I interviewed include Lead Preschool Staff Member (Starfish) Agnes Thibodeau, Child Care Assistant Lorriane Sikora (Starfish & Sea Turtles), Child Care Assistant Mark James (Starfish), Lead Child Care Staff Member Nathan Wagner (Sea Turtles), Lead Child Care Staff Member Amanda Kassab (Panda), Child Care Assistant, Heidi Stebila (Panda), Child Care Assistant, Madisyn Jones (Panda), Child Care Assistant Sheran Tioran (sea horse & turtles), and Child Care Assistant Maria Spounias (sea horse and turtles) Ms. Miller stated that the Starfish, Sea Turtle, and Panda's classrooms were together in the field house that is shared by k-12 students. There were 31 children and 6 staff members. All children were between the ages of 3 and 5 years old. Child A is enrolled in the Starfish classroom and Child B is enrolled in the Panda classroom. Ms. Miller was unsure how long children were left unattended but thought it was between 5 and 10 minutes. Ms. Miller stated that children go outside or to the field house (weather permitting) from 2:15 pm to 3:00 pm, daily. Due to the cold temperatures on the date of the incident, children used the field house. Ms. Miller stated the girl's bathroom/ locker rooms are attached to the field house and that children are allowed to use those bathrooms as long as they have permission from a child care staff member and that a child care staff member goes into the bathroom with the child. Children are not allowed to use the bathrooms by themselves. Ms. Miller said that staff are supposed to count children before they leave the field house and when they return to their classrooms. She stated she has reiterated the need to count children during any and all transitions; however, staff informed her that they did not count children on the date of the incident. 3 Mis. Miller informed me that after the incident she updated the center's policy to indicate that the bathrooms in the field house are not allowed to be used by children. If children need to use the bathroom, they will walk back to the bathroom in the preschool area with a child care staff member. I interviewed Starfish staff members Agnes Thibodeau (Lead) and Mark James (Assistant). Ms. Thibodeau stated she arrived in the field house around 2:50 pm. She did not recall if she saw Child A and Child B. Around 3:00 pm she called for children to line up. She held the door open, and children started to exit the field house. Ms. Thibodeau observed a large group of older children in the hallway and shut the field house door. She had a group of children outside of the field house door lined up against the wall. The rest of the group remained in the field house. She did not recall how many children were in the hallway with her.     On 7/1/22, I received a complaint stating that Child A was left unattended in the Ryan's Roost classroom while all the staff members from the classroom were outside on the playground with other children. The complainant stated that after 15 minutes of the children being outside, the staff members realized that they were missing Child A. The three staff members went inside leaving their children with the Toddler 1 classroom staff to look for Child A. They came back outside with Child A in a few minutes. The incident occurred in summer of 2021, and it is concerning that Child A's parents and the Bureau were not informed about the incident. No further details could be obtained from the complainant since contact information was not provided. The witnesses to this event were Employee C, Employee E and Employee G. On 7/5/22, I conducted an unannounced, onsite inspection at the center. I saw the Ryan's Roost classroom (1- 2- year- old toddlers) and the path leading to the outdoor playground. The children have to pass through the long hallway and go up the stairs to reach the playground. Child A is currently enrolled in a different classroom. On 7/5/22, I interviewed the program director/licensee designee, Ms. Miller who stated that she was not aware of any such incident that occurred at the center. She said that she hopes that the staff members would make her aware of such incidents. She said that she would have promptly informed the bureau if she knew that something like this had occurred. Ms. Miller indicated that she had to reject employment for an ex-employee that she did not think was a good fit and thinks that the complaint probably came from that individual. On 7/5/22, I interviewed Employee G who said that she could not recall any such incident at all. She said that there were times when they had realized that a child had been behind in the line and got caught up with them but never left a child in the classroom unattended at any time. On 7/6/22, I interviewed Employee C who stated that she could not recall any such incident at all. She said that she had worked with Child A in the Ryan's Roost classroom, and she would have informed the program director if something like this had occurred. On 7/7/22, I interviewed Employee A who stated that she saw what happened with Child A in June of 2021. She said that the Ryan's Roost class came out to the playground in the morning at about 10:45 am. The Toddler 1 classroom was already 3 on the playground. The Ryan's Roost children were playing outside for more than10 minutes before the staff members realized that Child A was missing from the group. Employee C, Employee E and Employee G went inside to find Child A. They came back out within a few minutes to let the other staff members know that Child A was in his classroom in the kitchen area. Child A appeared to be quite cheerful and did not seem to have been affected by the situation. Employee A said that she was very uncomfortable with this incident and decided to inform Ms. Miller about the same. Employee A called a little later and told her about the incident. Ms. Miller said that Employee G had already told her about it, and she would follow up and address the issue with the staff members involved. Employee D and Employee F were also present in the room when she told Ms. Miller. Employee A said that she did not call the parents since it was the protocol for the management to call the parents when such incidents occur. On 7/8/22, I interviewed Employee B who stated that she was not aware of any such incident with any children. Employee B said that she had worked there for several years, and she had not seen or heard of it. Employee B confirmed that she worked mostly in the afternoons several days. On 7/28/22, I interviewed Employee D who said that in June of 2021, there was an incident when Child A was left unattended in the Ryan's Roost classroom for about 10 minutes or even more. Employee D saw the class come out to the playground.

    R 400.8182 · 1 R 400.8182 Ratio and group size requirements. (3) In each room or well-defined space, the maximum group size and ratio of child care staff members to children, including children related to a staff member or the licensee, must be as shown in Table 4:

    On 1/26/2022, the department received a complaint on this facility. The complainant did not leave contact information and I was not able to interview them. I completed an unannounced onsite inspection on 1/28/2022. I spoke with program director and licensee designee, Kristin Miller. She is aware that the ratio in the Toddler 1 room should be one staff member for every four children or fraction of. 2 Ms. Miller provided me a tour of the facility. During my inspection I visited nine rooms, seven of them being classrooms. Each classroom was within the required child to staff member ratio based on the children's ages at that time. Room 29 (3-4 years) had 19 children with five staff members Room 22 (3-4 years) had 11 children and three staff members Room 35 (2 - 3 years) had two children and two staff members 1/2 Room 19 (18-24 months) had 11 children with three staff members Room 39 (12-18 months) had 12 children and four staff members Room 12 (3 years) had four children and two staff members Infant Room (birth to 12 months) had seven children and three staff members I spoke with Toddler 1 staff member, Aureel Bell. Ms. Bell stated that she starts work at 7:00 a.m. Staff member, Bridgette Jabbaar, comes into the classroom at 8:00 a.m. and staff member, Maria Schwab, comes into the classroom at 9:00 a.m. Ms. Bell stated that they typically have a "full house" meaning 11 or 12 children between 8:15 a.m. and 8:30 a.m. before Ms. Schwab arrives at 9:00 a.m. I spoke with Toddler 1 staff member, Maria Schwab. Ms. Schwab stated that she usually arrives to work early to use the restroom and wash her hands before entering the classroom a little before 9:00 a.m. Ms. Schwab stated that nobody has told her that the Toddler 1 classroom is out of ratio before she gets there. She does not count the children when she arrives, because she knows when she is there the class is in ratio. Ms. Schwab stays late sometimes if it is needed to maintain ratio in the classroom. Ms. Miller provided me with attendance records for the week of 1/24/2022. I looked at the date in the complaint first. On 1/26/2022, the Toddler 1 class appeared to be in ratio until 8:55 a.m. when the ninth child and tenth child arrived. This is assuming that the third staff member, Ms. Schwab enters the classroom at her scheduled time of 9:00 a.m. The staff members use software on their phones to clock in and out. I obtained a printout of the staff member's time sheets for 1/26/2022. Ms. Schwab clocked in at 8:41 a.m. It is unknown at what time she actually entered the classroom or if she was in the classroom when the ninth child and tenth child arrived. I continued to review the children's attendance records for the Toddler 1 classroom. On 1/24/2022, the ninth child arrived at 8:55 a.m. and the third staff member was scheduled to be in the class at 9:00 a.m. On 1/27/2022, the fifth child arrived at 7:55 a.m. when only one staff member was present. The second staff member, Ms. Jabbaar, is a salaried worker and does not use the clock in software that the other staff member use. There is no record of when she arrived at the facility or entered the classroom. It is unknown if she was in the classroom early at 7:55 a.m. or if she entered at her scheduled time of 8:00 a.m. The ninth child arrived at 8:30 a.m. putting the classroom out of ratio. The tenth 3 child arrived at 8:50 a.m. The third staff member was not scheduled to be in class until 9:00 a.m. This left the toddler classroom out of ratio for approximately 30 minutes. On 1/28/2022, the day of my inspection, the ninth child arrived at 8:20 a.m. The third staff member was scheduled to come into the class at 9:00 a.m. This left the classroom out of ratio for approximately 40 minutes. I spoke with Ms. Miller again. She stated that all staff members know that if a child arrives, putting them out of ratio, they are to call her or another classroom and ask for help.     On 1/28/2022, Ms. Miller confirmed that on 1/26/2022 the Toddler 2 class did combine with the Young 3s classroom. She is aware that the ratio would need to go by the age of the youngest child in the classroom. There were two children from Toddler 2 class that were under 2 years old, and four 1/2 children that were 3 years old. Ms. Miller was scheduled to be in the classroom at 8:15 a.m. that morning. She admitted that she was in the building, but did not arrive to the classroom until approximately 8:30 a.m. I spoke with Young 3s staff member, Kelsey Sypitkowski. She denied there ever being a ratio issue because the staff members call other classrooms or the program director to help cover. She stated there is always extra people to help. She did not recall ever being over ratio on 1/26/2022. We went over the children's attendance records together. The children arrived at 7:25, 7:42, 8:15, 8:19; 8:20, and 8:37 that morning. Ms Sypitkowski recalled when the fourth and fifth children arrived, the parents lingered awhile to talk to her. They talked about children's allergies, and the need to combine classes since so many children were out quarantining. Ms. Miller walked into the classroom at that time. The sixth child arrived after Ms. Miller was in the classroom.

    On 11/04/2021 I received a phone call from Program Director, Kristen Miller. Ms. Miller stated she received an email from Child A's Mother the previous evening (11/03/2021) regarding an incident that occurred in the 3- and 4-year- old Preschool Room (Panda Room). The email stated that as she drove home from the center, Child A told her that Child Care Staff Member, Nia Jackson made him cry because he would not get off his cot at naptime. Child A's mother asked Child A if he was listening to staff members. Child A told her he was not (listening to staff). She said she did not think much of the interaction with Child A, assuming he was upset because he was in trouble for not listening. Later in the evening, Child A washed his hands in the sink. She observed single, perpendicular thumbprint bruises on the underside of 3 each forearm. Child A's Mother asked Child A what happened, and Child A told his mother that he was hurt by Ms. Jackson. He told her that Ms. Jackson grabbed his arms when he didn't want to get off his cot at naptime. Child A demonstrated the incident and showed his mother a strong pull by the forearms. Ms. Miller stated she was very concerned about the allegations and reported the incident to the department for further investigation. She stated Ms. Jackson has been placed on leave and is not currently working at the center. On 11/05/2021 I received a written incident report and photographs of Child A's injuries from Ms. Miller. The incident report confirmed Ms. Miller's verbal report. Child A's Mother contacted Ms. Miller to tell her that Child A had bruising to his left and right arm/wrist area. Three child care staff members were in the classroom on 11/04/2021 at the time of the incident and included: Amanda Kassab, Heidi Stebila, and Nia Jackson. Individual meetings were conducted with Ms. Kassab and Ms. Jackson. Both staff members were placed on leave pending an investigation. I received 5 photographs: Photograph 1, Photograph 2, and Photograph 3 depicts Child A's left and right inner forearms. There are 2 bruises on Child A's right arm and 1 bruise on Child A's left arm. The bruises on the left and right forearms are located directly across from one another. Photograph 4 depicts a penny size bruise on Child A's left inner forearm. The bruise is located between his elbow and wrist. This bruise is red, purple, and black in nature. Photograph 5 depicts a penny size bruise on Child A's right inner forearm. The bruise is located between his elbow and wrist. This bruise has a red center and is purple and black around the outer edges. A second circular bruise is located just above the penny size bruise. The second bruise is smaller in nature and appears black and purple. On 11/08/2021, completed an unannounced onsite inspection at Sacred Heart. We interviewed Ms. Miller, and Child Care Staff Members, Amanda Kassab (Lead Panda Room Staff) and Heidi Stebilla (Assistant Panda Room Staff). Ms. Miller stated that Ms. Jackson started at the center, . She was assigned to the Panda Room and worked as an assistant child care"stamember. She has not had any disciplinary actions or other issues since being employed. Ms. Miller said Ms. Jackson is "sweet, gentle and good with the kids." On the date of the incident there were 12 children ages 3 and 4 years old in the room. Ms. Miller said not many of the children took a nap, and most children had a "hard-time," at naptime on 11/04/2021. Ms. Miller said that naptime occurs daily from 12:30 pm to 2:00 pm. Right after naptime children go outside. Ms. Miller stated that staff sometimes have to "coax" children to get up and go outside, however staff "would not physically rouse" the children. To coax children Ms. Miller stated staff turn the lights on in the classroom, give the children a 4 couple minute warning, verbal reminders to get up, and ask them to please get up. Once cots are put away, the class goes outside. Ms. Miller stated it would "not be typical" to pull a child up off

(1) Except as provided in section 5n(8), a licensee, child care staff member, or adult member of the household may not have contact with a child who is in the care of a child care center, group child care home, or family child care home, until the department obtains documentation from the department of health and human services that he or she has not been named in a central registry case as the perpetrator of child abuse or child neglect.
