On 10/09/2021 program director Kathleen Fotiu sent an incident report regarding the allegation. The report documents on 10/08/2021 at 5:17pm students were in the gym. Ms. Tubbs took a child to the front door for pick up. Three students tried to follow Ms. Tubbs, and she told the three to stay where they were, and they said, "Okay". Ms. Schaffenberger went to find a song for another student. At 5:19pm Child A's Mother arrived to pick up Child A. They looked around and did not see Child A and assumed Child A had gone to the bathroom. They went to the bathroom and did not see Child A, and as they were walking to go outside it was noticed that Child B was not present. Ms. Schaffenberger looked outside and saw Child A and Child B in the courtyard with Child B's Father. On 10/12/2021 I completed an on-site inspection to the center. Marie Fisher-Dowell, a school age program director through the Berkley Public School District, was present and overseeing the staff. I interviewed staff RayVaughn Tubbs. She stated she was working on Friday (10/08/2021) with Krista (Wells) and Fawn (Schraffenberger). At 5:15pm there were 6 children present when the phone rang, and it was a father at the front door of the building stating his key fob was not working. Ms. Tubbs told the father she would bring his child up to him. When she was leaving the gym with this child, Child B ran up to say goodbye to the child and then three more of the children including Child A ran up to them. Ms. Tubbs told all of the children to stay with an adult and they said, "Yes". Ms. Tubbs stated Ms. Wells and Ms. Schraffenberger stayed in the gym with the remaining 5 child care children. Ms. Tubbs stated she took the one child to the front door to his father. Ms. Tubbs stated when she came back to the gym a few minutes later, Child A's Mother came into the gym and signed Child A out at 5:20pm. Child A's Mother asked where Child A was and Ms. Tubbs responded, "He was right here". Ms. Tubbs stated she then asked Ms. Wells where Child A was, and Ms. Wells did not know. Ms.Tubbs started looking around for Child A. Ms. Schraffenberger came back into the gym and Ms. Tubbs asked Ms. Schraffenberger where Child A was, and Ms. Schraffenberger responded that she did not know. Ms. Tubbs stated she kept three children with her while Ms. Schraffenberger left the area to go outside where Ms. Schraffenberger found Child A and Child B. Ms. Tubbs stated she did not know where Ms. Wells was when Child A and Child B were found. I interviewed staff Fawn Schraffenberger. She stated she was working with Ms. RayVaughn (Tubbs) and Ms. Krista (Wells) on 10/08/2021 and they had 6 children present after 5:00pm. They were all inside the gym at the time. Ms. Schraffenberger stated she and Ms. Tubbs were with the children and she did not know where Ms. 3 Wells was at the time. One of the children asked if they were going to go outside and so they started to clean up. The phone rang and it was one of the children's fathers, who could not get in the building with his key fob so she told the father they would bring his child to him. Ms. Tubbs left the gym and took the child to his father. While Ms. Tubbs was gone, Ms. Wells came back into the gym and asked her (Ms. Schraffenberger) about a speaker. Ms. Schraffenberger stated she then told Ms. Wells that she was running to the bathroom before they went outside. Ms. Schraffenberger stated she was gone for about a minute, and when she returned to the gym, Ms. Wells and the children were still in the gym. Ms. Tubbs returned to the gym, and at about the same time Child A's Mother arrived in the gym to pick up Child A. Child A's Mother looked around and asked them where Child A was. Ms. Schraffenberger stated she told Child A's Mother that Child A must be in the bathroom, and she (Ms. Schraffenberger) then went to the bathroom, but Child A was not in the bathroom.
