On 07/18/2023 I spoke with Child D and Child K's Mother. She stated on the morning of 05/31/2023 when she dropped Child D off at the center, Child D had no eye swelling. After Child D woke up from a morning nap, Child D and Child K's Mother received a phone call from program director (LaQuante') Sarah Junious. Ms. Junious said Child D's eye had some swelling. Child D and Child K's Mother immediately went to the center and picked up Child D. Ms. Junious and Staff 2 were working in Child D's classroom at the time. Child D and Child K's Mother told them she was going to take Child D to the doctor, which she did. Child D and Child K's Mother stated Child D's allergist examined Child D and told her the eye swelling had to be from Child D being exposed to one of Child D's food allergens, which are dairy and eggs. On 07/25/2023 I completed an on-site inspection to the center and interviewed Ms. Junious. I informed her of the complaint allegations. Ms. Junious stated she did not remember if Child D was in attendance on 05/31/2023 so looked up the Infant 1 classroom's attendance record for 05/31/2023 and confirmed Child D was in attendance that day. I scanned a copy of this attendance record. Ms. Junious stated she and Staff 2 were working in the Infant 1 classroom the morning of 05/31/2023, and Child D was not exposed to any allergen while at the center. Ms. Junious stated neither Child D and Child K's Mother nor Child D and Child K's Father ever told her they took Child D to the doctor on 05/31/2023. If she had been informed of this, she would have reported it to Licensing. Ms. Junious reviewed the center's electronic messages and Child D's daily record from 05/31/2023. She stated the morning of 05/31/2023 she sent out an electronic message to all parents at the center about a change in the lunch menu. Ms. Junious also communicated via the electronic application with Child D and Child K's Mother that morning about what was okay to serve Child D from the center's menu. Child D's Mother wrote back she would send a lunch for Child D, and it was okay to serve pears. Ms. Junious provided me a copy of this electronic communication with Child D and Child K's Mother and Child D's daily record for 05/31/2023. Ms. Junious also gave me a copy 3 of the center's menu for the Month of May and pears were listed as the fruit served for lunch. Ms. Junious stated when Child D woke up from a morning nap, Staff 2 thought Child D's eye looked a little swollen, so Staff 2 sent a message to Child D and Child K's Mother on the electronic application. Ms. Junious stated Child D went home in the middle of the day, which was typical for Child D so Child D and Child K's Mother could breast feed Child D. Child D and Child K's Father brought Child D back to the center that afternoon, and neither Child D and Child K's Mother nor Child D and Child K's Father communicate with her they took Child D to the doctor. I interviewed Staff 2 regarding the allegation. Staff 2 stated she was working in the Infant 1 classroom on 05/31/2023 and Ms. Junious was working with her. Child D appeared fine at drop off. Child D ate breakfast at the center which consisted of Chex cereal and a banana provided by the center. Child D then took a morning nap, and when Child D woke up, Staff 2 saw some swelling under Child D's right eye. Staff 2 called Ms. Junious over to Child D who was still in the crib and pointed this out to Ms. Junious. Ms. Junious sent an electronic message to Child D and Child K's Mother about the eye swelling and a parent (Staff 2 could not remember if Child D and Child K's Mother or Child D and Child K's Father) came right away and picked up Child D. Staff 2 told them that Child D did not touch or get a hold of any allergen. Later that afternoon, Child D and Child K's Father brought Child D back to the center. Child D and Child K's Father told Staff 2 that Child D's eye swelling went down, and Child D was fine. I asked Staff 2 if Child D and Child K's Father or Chil

On 05/24/2023, program director LaQuante' Sarah Junious contacted me about the complaint allegation. Ms. Junious stated that morning Staff 11 had walked out of the Discovery Preschool 1 classroom and left 4 children unattended. Child H's Father and Staff 12 saw Staff 11 walking down the hallway. Staff 12 stayed in the 2 classroom until Staff 9 came into the classroom. Ms. Junious stated that Staff 11 has been placed on leave. On 05/25/2023 Ms. Junious sent the written incident report. The incident report documents on 05/24/2023 at 8:00am Staff 12 informed Ms. Junious she and Child H's Father saw Staff 11, one of the staff members who works in the Discovery Preschool 1 classroom, in the hallway. Staff 12 entered the Discovery Preschool 1 classroom and found four children with no staff present in the classroom. Staff 12 stayed in the classroom until Staff 9 came into the room. On 05/25/2023 I spoke with Child I's Mother. She stated Child I is in the Discovery Preschool 1 classroom, and Staff 9 and Staff 11 are the staff that usually work in the classroom. Child I's Mother stated around 8:00am when she dropped off Child I to the Discovery Preschool 1 classroom, there was no staff present. Child I's Mother stated this had never happened before this inciden; there has always been a staff in the classroom when she dropped off and picked up Child I. On 05/25/2023 I interviewed Staff 12 who stated on 05/24/2023 she arrived at the center just before 8:00am. She and Child H's Father were walking down the hallway and saw Staff 11, who works in the Discovery Preschool 1 classroom, walking down the hallway. Staff 12 walked by the Toddler 3 classroom, looked through the window, and saw Staff 9 in the Toddler 3 classroom. Staff 9 usually works in the Discovery Preschool 1 classroom. Staff 12 thought it was odd to see both Staff 11 and Staff 9 out of the Discovery Preschool 1 classroom at that time of the morning. Staff 12 and Child H's Father then entered the Discovery Preschool 1 classroom. Staff 12 looked around and did not see any staff in the classroom. Staff 12 saw four children in the classroom and the children were "running around". Staff 12 told Child H's Father she would stay in the classroom. Staff 12 started getting the children ready for breakfast and about three or four minutes later, Staff 9 came in the classroom. Staff 9 had no idea what was going on. Staff 12 told Staff 9 she saw Staff 11 walking down the hallway and found the four children alone, unsupervised in the classroom. Staff 9 told Staff 12 she had been working in the Discovery Preschool 1 classroom that morning with Staff 11 when staff from the Toddler 3 classroom asked her (Staff 9) to come to the Toddler 3 classroom to help for a few minutes. Staff 9 then told Staff 11 she was going over to help in the Toddler 3 classroom for a few minutes. Staff 12 stated after she spoke with Staff 9, she went to notify Ms. Junious about what happened. Staff 12 went into the kitchen and saw and heard Staff 11 yelling at Ms. Junious. Staff 12 left and came back later, when Ms. Junious was alone, to tell Ms. Junious what had happened. On 05/25/2023 I interviewed Staff 9. She stated she works daily in the Discovery Preschool 1 classroom with Staff 11. Staff 9 stated prior to the incident on 05/24/2023, Staff 11 had never left children unsupervised. On 05/24/2023 at about 7:50am she and Staff 11 were in the classroom with four children, when staff from the Toddler 3 classroom asked her (Staff 9) to come help in the Toddler 3 classroom for a few minutes. Staff 9 stated before she left the Discovery Preschool 1 3 classroom, she told Staff 11 she was leaving for a few minutes and Staff 11 said "okay". Staff 9 returned to the Discovery Preschool 1 classroom around 8:00am and Staff 12 and Child H's Father were in the room with the children. Staff 9 heard Child H's Father say to Staff 12, "I don't think the teacher is in the room". Child H's Father and Staff 12 then left the classroom, and

On 04/13/2023 program director LaQuante' Sarah Junious left a voicemail message that she needed to report an incident that occurred on 04/13/2023. On 04/13/2023, I called the center and spoke with Staff 1, who stated Ms. Junious was not available at the time. I asked Staff 1 to have Ms. Junious send a written incident report. On 04/18/2023 I had not received an incident report, so I contacted Ms. Junious who stated Staff 1 had not informed her of my message. On 04/18/2023 Ms. Junious sent the written incident report which documented: on 04/13/2023 at 12:00 p.m. Staff 2 served Child D tuna, which contained mayonnaise, for lunch. Child D has allergies to milk and eggs, and once Staff 2 realized mayonnaise contains eggs, she immediately removed the food from Child D and washed Child D's hands and face. Staff 2 told Staff 1 what happened, and Staff 1 called Child D's Mother who came to the center right away and took Child D home for observation. On 04/24/2023, I spoke with Child D's Mother. She stated she provides breast milk for Child D and the center provides some food for Child D. She enrolled Child D at the center in January 2023, and at enrollment she informed the staff and wrote on Child D's information card that Child D has allergies to egg and dairy. Child D's Mother stated on 02/10/2023 she gave Ms. Junious a written allergy action plan for Child D that states Child D has the medications Benadryl and Auvi Q if Child D has an allergic reaction, and she provided the center the medications. Child D's Mother stated when the incident happened on 04/13/2023, Staff 1 called her, and she immediately came to the center. Child D had a few hives from eating the mayonnaise. She took Child D home and gave Child D Benadryl. After the incident happened, Staff 2 and Ms. Junious told her they did not have the written allergy action plan for Child D. On 04/25/2023, I completed an on-site inspection to the center and interviewed Staff 2. Staff 2 stated she is the primary caregiver for Child D in the Infant 1 classroom. Staff 2 said Child D is allergic to eggs and milk. Child D is fed breast milk and some food from the center. On 04/13/2023, Child D's Mother brought Child D back to the center at lunch time, and Staff 2 asked Child D's Mother if it was okay to feed Child D tuna salad for lunch. Child D's Mother stated it was okay and Child D's Mother left the center. Staff 2 asked Staff 3 to go get a serving of the tuna salad from the kitchen. Staff 3 brought back some tuna salad for Child D, and Staff 2 sat Child D down and gave Child D the tuna salad. Child D had just put some in his mouth when Staff 2 realized that the tuna salad is made with mayonnaise, which contains eggs. Staff 2 immediately took the plate away from Child D, washed Child D's face and hands, and called Staff 1 who was preparing the lunch in the kitchen that day. Staff 1 called Child D's Mother to inform her what happened, and Child D's Mother arrived back at the center in about five minutes. Child D's Mother took Child D home. Staff 2 stated Child D had a hive under his lip when Child D's Mother arrived. 4 Staff 2 stated Child D's Mother has provided the center with Benadryl and epi pen medications for Child D's food allergies. Staff 2 stated she was not given a medical action plan for Child D until today (04/25/2023). Staff 2 showed me Child D's medical action plan, which was dated 02/10/2023. The plan documents Child D is allergic to peanuts, eggs, and dairy and directs to give the antihistamine medication Benadryl for mild symptoms from one system area (nose, mouth, skin, gut) and to give medication Auvi Q, an epinephrine injection, for mild symptoms from more than one system area or for severe symptoms. Staff 2 showed me Child D's Auvi Q and Benadryl medications and Child D's information record signed by Child D's Mother on 12/29/2022. The complainant stated on 04/05/2023 the Infant 1 classroom had one staff caring for five infants. The complainant also stated at nap time some of the classrooms in the center may not be maintaining the required staff to child ratio. On 04/25/2023 I completed an on-site inspection to the center, and at 1:00pm, I observed the following classrooms not maintaining the required staff to child ratio: Toddler 1 classroom with 1 staff (Staff 6) to 8 children (1 years of age). The children were awake. Staff 6 was washing children's hands and trying to get the children ready for nap time. Toddler 2 classroom with 1 staff to 8 children (2 years of age). The children were lying on cots at nap time. Toddler 3 classroom with 1 staff to 5 children (2 years of age). The children were lying on cots at nap time. Discovery Preschool 1 classroom with 1 staff to 15 children (2 to 3 years of 1/2 age). The children were lying on cots at nap time. Preschool classroom with 1 staff to 19 children (3 to 4 years of age). The children were lying on cots at nap time. On 04/25/2023 I interviewed program director Ms. Junious regarding the ratio violations I observed in the classrooms. She stated several staff "called off' and did not come to work that day. Ms. Junious stated both she and Staff 4, who assists her, are working daily in classrooms attempting to maintain the required ratio. She stated when staff "call off' she often does not have enough staff to maintain ratio throughout the day, so she contacts enrolled families via the electronic Kindercare application and asks parents, who are willing, to not bring their child(ren) for the day or to pick up their child(ren) early. Ms. Junious stated she was unaware that classrooms had to maintain staff to child ratio during nap time. Ms. Junious stated she is trying to hire more staff and she has communicated the staffing issues with her district manager Ms. Aubree Marino. On 04/27/2023 I interviewed Staff 6 who stated on 04/25/2023 Staff 13 was working in the morning with her in the Toddler 1 classroom, however, around 1:00pm Staff 13 had to unexpectedly leave for the rest of the day. Staff 6 stated at 3:00pm four toddlers in the Toddler 1 classroom were moved to another room, and she had four toddlers and ratio was maintained for the remainder of that day. On 04/27/2023 I interviewed Staff 8. She stated she works in infant and toddler classrooms. Staff 8 stated there are often problems maintaining the required ratio (1 staff to 4 children) in the infant and toddler classrooms between 7:30 and 8:00am until additional staff arrive for the day. Staff 8 stated Staff 4 sometimes comes in classrooms and sees ratio is not being maintained. Staff 8 stated Staff 4 then just leaves the classroom and says and does nothing about the classroom not being in ratio. Staff 8 stated she sometimes tries to call Ms. Junious or Staff 4 on the center phone to let them know a classroom is not in ratio, however, they usually do not rj answer the phone. Staff 8 stated she has spoken with Ms. Junious about ratio concerns, and Ms. Junious has stated she is "working on it". On 05/05/2023 I interviewed Staff 1, who stated she is no longer working at the center. Staff 1 stated last month, 04/2023, when she was working at the center, she heard many staff complain that neither Ms. Junious nor Staff 4 would answer the center phone when staff would try to notify them of a classroom not being in ratio. On 05/08/2023 I spoke with Kindercare District Leader Aubree Marino regarding my observations during my 04/25/2023 on-site inspection at the center, ratio concerns, and the staffing issues.
