    I conducted an unscheduled on-site inspection on 05/15/2021 interviewed Sandra Stack and her child care staff member, and adult household member, Donald Stack regarding the allegations. At the time of my on-site inspection, five children were present in the home — four child care children and one grandchild. Upon my arrival, the four child care children were in the play room with the gate up, confining the children to the room. Mrs. Stack's grandson was at the dining table, immediately outside the play room, attending school virtually. The child care children were two and three years of age. 2 The grandchild was ten years of age. It should be noted that the play room is in the far corner of the house, away, and not visible from, the entry area. Mrs. Stack advised that she put the children in the play room and put the gate up when I came to the door, so that she could answer the door and ensure that the children were safe. She said that the gate was not up prior to my arrival. Mrs. Stack relayed that she gates the children in the play room any time she has to leave the area. Examples she gave for leaving the area were to answer the door, put food in the oven, to change a diaper, or go to use the bathroom. When asked to estimate how much time each day the children are gated in the play room, Mrs. Stack could not say. At one point she said "one hour" and then said she was not sure. Mrs. Stack stated that she only gates the children in the play room when there are six children or less and she is the only caregiver present. She said when more children are present, and Mr. Stack is there assisting her, the gate is not used. Mrs. Stack advised that the children are usually in the play room playing with toys and that the television does not exceed two hours a day. Mr. Stack was present for Mrs. Stack's interview. He confirmed all of Mrs. Stack's statements, adding that they have been spending a lot of time outdoors with the children, since the weather has been getting nicer. The play room is a small room off the side of the dining room. The room has tile floors and no furniture. Play equipment in the room included blocks, a play kitchen, and a large activity block like you see in pediatrician's offices. There was an opening in the wall, like a window, that led to the kitchen. In the opening was a television. There was nothing on the television when I arrived but a show started playing shortly after my arrival. I was present in the home for approximately 35 minutes. The child care children remained in the play room for the duration of my inspection. I spoke with Child A and B's Mother on 06/08/2021. She has been taking her children to Mrs. Stack's for care for about three months. At enrollment Mrs. Stack gave her a tour of the home, so she is familiar with the environment. She could not recall seeing a gate at or near the playroom at the time of her tour. She could not recall if children were in the play room at the time of the tour. Child A and B's Mother said she has not been in the home past the entry area since the time of her tour. Her children have not talked about being confined to the play room. I spoke with Child C's Mother on 06/08/2021. She has been taking her child to Mrs. Stack's for approximately three years. Currently her child is only present in the home for about 15-20 minutes before school and then 15-20 minutes after school, if that. Child C's Mother said she has not been past the entry area of Mrs. Stack's home for almost a year. When she was last in the home, she did not recall seeing children gated in the play room. She could not recall if she saw children in the playroom at all. Child C has not said anything to her about children being confined 3 to the play room. Child C's Mother said that Child C is good about communicating when things are bothering her or something is wrong, so she believes Child C would say something if there was an issue. I spoke with Child D's Mother on 06/08/2021. She has been taking Child

    Four of the parents I spoke with do not enter Ms. Stack's home. One only enters occasionally and briefly. She has seen the television on but cannot say for how long it is viewed. Ms. Stack denied the television being on more than two hours a day. I
