Based on the video footage reviewed, the interviews with the PD, CCSM 1 and CCSM 2, Child A Mother and Child B Mother, there is sufficient evidence to conclude that appropriate care and supervision of children was provided to Child A. Video footage showed that CCSMs responded as soon as the incident occurred. Additionally, the video footage showed that the CCSMs were always within reach of the children and had them in their line of vision to supervise the incidents.

On April 14, 2023, and I conducted an unannounced onsite inspection at Becky and "essi"cas Place. Program Director Jessica Thornell was interviewed and said the incident happened as the complaint details. She said Child A was outside with CCSM 1 and CCSM 1 told her that Child A hurt her arm after falling. She did not know Child A's arm was dislocated until Child A's Mother informed her that she had taken Child A to the hospital for an evaluation. She and Child A's Mother reviewed the video footage of CCSM 1 and Child A on the playground. The footage showed CCSM picking Child A up by her right arm, moving her to another location on the playground. During the onsite director Jessica Thornell allowed me to review the video footage of CCSM1 picking Child A. The footage showed Child A near the fence and CCSM 1 pick her up by her right arm moving her near a play car on the playground. The car was approximately five to ten feet in distance. CCSM 1 was interviewed during the onsite and she said she and Child A were outside on the playground together. Child A was upset and walked by the fence because she wanted to get in the stroller with the other children. CCSM 1 walked over to Child A and picked her up by her right arm and moved her near the toy car which was approximately five to eight feet apart in distance from where she was standing. Child A did not want to sit in the car and was still upset and crying because she was not in the stroller. CCSM 1 noticed Child A was holding her wrist and crying so she took her inside. She told Ms. Jessica about Child A crying and holding her wrist when she came outside but she never mentioned picking Child A up by the arm. CCSM 1 said she thought Child A's wrist was hurting because she pushed another child earlier. She never considered her wrist was hurting from being picked up. CCSM 1 said she usually pick children up by their waist and/or under their arms. In this instance she thought it was a harmless act considering the short distance she was moved and the duration of time she was held. Additionally, she attributed Child A's crying to her being upset she was not allowed to get in the stroller. CCSM 1 said she would never intentionally hurt a child and that she would never pick a child up by one arm again. CCSM 2 was interviewed during the onsite and said Child A was outside with the other children and CCSM 1 brought her inside because she was crying. She was told that Child A was holding her arm and crying. CCSM 2 said she calmed Child A down; Child A stopped crying and took her back outside. CCSM 2 said she could not recall the staff member that brought Child A inside. CCSM 3 was interviewed during the onsite, and said she does not know anything regarding the incident with Child A. She was outside caring for some children at the table while they were eating. CCSM 4 was walking around with four children in the 3 stroller and CCSM 1 was sitting on the bench holding Child A. Eventually, CCSM 1 took child A inside the center because she was crying. CCSM 3 said she did not know why Child A was crying and didn't see her fall or get grabbed by CCSIVI 1. CCSM 4 was interviewed during the onsite and said she did not know anything regarding the incident with Child A. She was pushing a group of children around in the stroller. Notably, CCSM 4's primary language is Spanish, and she did not speak English very well. I utilized an app on my phone to assist with the interview and translate questions. She understood the questions and would respond to the questions using the app. CCSM 5 was interviewed during the onsite and identified herself as the assistant director of the center. She said she does not know what happened to Child A's arm. She does not work in the room with Child A, and she was not outside at the time of the alleged incident. On April 19, 2023, Child A's medical records were received from the I reviewed the records and they indicated she was treated at e April 12, 2023. Child A was diagnosed

On 07/29/2022, I spoke with Child A's Mother. She said Child A has been picked up from the child care center with a wet diaper. She said Child A had a soiled diaper on 07/27/2022 and she reported the information to the staff at the child care center. On 07/29/2022, I spoke with the Witness. It is reported that Child A has been picked up from the child care center with soaked and soiled diapers. Child A clothes were soiled, and feces was observed on his back. According to the witness, the soiled diaper and clothes were observed after Child A was outside of the child care center being placed in the car. The Witness said Child A has been enrolled in the child care center since October 2021. There have been no problems with Child A's diaper being soiled when he is picked up before 4:00 p.m. However, if he is picked up after 4:00pm, he is wearing a soil or soaked diaper. This incident has occurred multiple times. The program director was notified of the issues and concerns. Afterward, the issue was resolved for approximately a week. However, Child A had soaked and soiled diapers again. The Witness stated that Child A was picked up one to two times per month with a soiled or soaked diaper. The Witness was unable to give exact dates that the incidents occurred with the soiled and soaked diapers. The Witness is concerned that this may be happening with the other children. On 07/29/2022, I completed an unannounced onsite inspection. When I arrived, I interviewed CCSMs, Jamie Greenwood and Nidia Grullon. Ms. Greenwood works with the latchkey children and Ms. Grullon works with the children ages; 3-4 years old. Ms. Greenwood said CCSMs, Jessah Price and Kathy Mclaughlin, and program director and licensee designee Jessica Thornell works in the one-year-old classroom from 6:00 a.m.-4:00 p.m. Jamie Greenwood explained that the younger children combine with Ms. Grullon at the end of the day. Ms. Greenwood and Ms. Grullon said the children's diapers are changed on a schedule and on demand if they need 3 to be changed in between the scheduled diaper times. Ms. Grullon denied that Child A has gone home with a soaked or soiled diaper. On 07/29/2022, I spoke with Ms. Thornell. She stated that she received a complaint from Child A's Mother. Child A's Mother said on 07/27/2022, Child A came home with a wet and soiled diaper. Child A's Mother suspects that Child A had not been changed for hours, if at all. Ms. Thornell said Child A's Mother began potty training Child A in March 2022. According to Ms. Thornell, Child A's Mother was upset because Child A was not potty trained, she did not like the child care center's potty-training policy. Ms. Thornell said she has video footage and a diaper log that documents that Child A was changed 45 minutes before he was picked up from the child care center. On 07/29/2022, I spoke with Child B's (2-year-old, female) Mother. She said she does not have any concerns with the diapering at the child care center. She explained that the staff does a great job with making sure Child B is dry and is not sent home with wet or soiled diapers. On 08/02/2022, I spoke with Ms. Thornell. She said the potty-training policy for the child care center requires the child to be placed back in a diaper or pull-up if they have two accidents. Children are not allowed to go without a diaper or pull-up if they are not actively being potty trained and using the potty. This is unsanitary and can be unsafe for children and staff. Child A does not communicate with the staff and is taken to the bathroom numerous times throughout the day. He will not use the potty. Child A has been taught some signaling and pointing techniques to assist with potty training. Ms. Thornell said Child A's Mother is upset that Child A is not using the potty and appears to be upset when he is not dry when she arrives to pick him up. Ms. Thornell said that Imani Jones told her that on 07/27/2022, Child A's Mother came into the center and told her that Child A was wet.
