Upon completion of the special investigation, there is evidence to support the allegation. Teacher 7, Teacher 8, and Teacher 9 were interviewed. Witness 6 and Witness 7 were interviewed. Interviews were conducted with Child D’s Mother, Child E’s Mother, Child F’s Mother, Child G’s Mother, and Child H’s Mother. Video footage from 06/01/2026 was obtained and viewed. Information gathered through interviews and video footage verified that Teacher 7 did not provide appropriate care and supervision to Child D.

When interviewed, they admit that they did not count the children prior to leaving the cafeteria and did not count the children when they arrived back at their classroom.

A review of the classroom child and staff attendance sheet for 1/14/2026 shows that the classroom had 10 children and 1 teacher. Given that there were multiple children under the age of 3, the ratio should have been 1 to 8. Program Administrator acknowledged the error and explained that she misunderstood the rule and thought the ratio could be 1 program staff member for every 10 children.

Upon completion of the special investigation, there is evidence to support the allegation that the LD does not have the administrative capability to operate the center to provide the services and facilities that are conducive to the welfare of children. On 09/05/205, the LD sent a text message to teachers informing them their classrooms would be out of ratio. On 10/30/2025, the LD instructed teachers to not contact the CCLB. The LD sent an email on 11/01/2025 instructing teachers to have the children engage in Mass and acknowledged the activity was not developmentally appropriate. The LD has not maintained the center's CCBC account. The LD has not notified parents or the CCLB of incidents in which children have been unsupervised.
