I completed an onsite inspection and interviews with Program Director Robin Beasley, Child Care Staff Member (CCSM) 1, CCSM 2, and CCSM 3 2 on 6/1/2023. Mrs. Beasley reported that she was aware of the incident the allegations were referencing. She said that last week on 5/22/2023 she was not onsite when she got a call from one of her CCSMs saying a parent had started an altercation at the center during pick up time. Child A's mother was waiting and watching outside the classroom door. Child A's mother believes she heard CCSM 1 take a toy from Child A and say, "please stop, that is so annoying". She also believes that she saw CCSM 1 throwing a ball with Child B and didn't like the way CCSM 1 was throwing the ball. This aggravated Child A's mother, and she was so angry that when CCSM 1 opened the door, Child A's mother had her shoes off and said she was ready to take CCSM 1 and CCSM 2 out to the parking lot to fight. Child A's mother was cussing at CCSM 1 and CCSM 2 and screaming in their faces. They asked her to calm down and she continued to scream and cuss at them while she took Child A off the premises. Child A's mother then waited in the car for CCSM 1 and CCSM 2 to leave work, but she eventually left. Mrs. Beasley reported that this incident scared her staff, and she instructed that they should call law enforcement in the future. She had all CCSMs write statements of the incident and she provided me with the written statements. Mrs. Beasley also played a voicemail message for me to listen to of Child A's mother saying she would "like to talk with Mrs. Beasley appropriately without all the cussing." Mrs. Beasley said that she informed Child A's mother that due to her aggressive behavior, she is no longer allowed on the child care center's property and they terminated Child A's contract. Mrs. Beasley reported that she has no concerns with CCSM 1 or CCSM 2. She actually used to work with CCSM 1 at another child care center and was so impressed with her that she asked her to come to this center to work. CCSM 1 reported that she had no idea Child A's mother was outside the door, but she often watches from the small window in the door and you can hear classroom activity through the door. CCSM 1 reported that she did take a plastic car out of Child A's hands because he was banging it on a wooden bookshelf and said, "please stop hitting that". She denied calling Child A annoying. CCSM 1 said that she went to open the classroom door and all the sudden Child A's mother was there. She had kicked her high heel shoes off and said she "was ready to fight y'all" then she started cussing at her and accusing her of being rude to Child A. CCSM 1 said she just tried to de-escalate the situation by saying "ok ma'am, and yes ma'am." CCSM 1 said she does not think that she was being rude to Child A and did not take the toy from his hand in a forceful manner. CCSM 1 reported that Child A's mother made her feel unsafe. CCSM 1 denied saying that she throws things at children. She believes this was a misunderstanding. Just before the incident with Child A's mother, CCSM 1 was playing ball with Child B. CCSM 1 denied cocking her arm back and denied throwing the ball in an aggressive manner. CCSM 2 reported that she has no concerns with CCSM 1 and believes she is excellent with the children. She reported to seeing CCSM 1 take the toy from Child A 3 and put it down on the floor because Child A has a re-occurring behavioral pattern of slamming toys on other objects. She said that CCSM 1 did not call Child A annoying, she said "please stop hitting that." CCSM 2 reported that towards the end of the day on 5/22/2023 all the sudden she heard someone yelling at CCSM 1 at the door and realized it was Child A's mother. She was cussing at CCSM 1 and then looked at her (CCSM 2) and said she wanted to fight them outside. CCSM 2 has never witnessed CCSM 1 throw anything at a child. She believes Child A mother saw CCSM1 playing catch playfully with Child B through

Prior to this to this department on 11/11/2022 completed phone 3 contact with Child A's Mother. Child A's Mother reported that after leaving the child care facility today, Child A was taken to for examination. Child A was diagnosed with a broken collarbone from and incident occurring while at the child care. The child care facility could not give her a clear explanation of how Child A was injured. On 11/11/2022 I had phone contact with program director Robin Beasley. Ms. Beasley notified me of the reported incident. She stated that on 11/10/2022 Child A was climbing on a playground structure and fell to the ground. The actual fall was not witnessed by child care staff. Child care staff member (CCSM) was at the playground gate with her back to the playground talking to anotherchild care parent. CCSM was nearby attending to another child and her back was to Child A when she fell. only had her back turned for a minute when the fall occurred. Ms. Beasley reported that Child A was crying on the ground and picked up Child A to soothe her and check for injuries. All of the children were then brought back to the building, and Child A was brought to her office for further assessment and observation. Ms. Beasley stated they did not observe any visible injuries. Child A did not have any bumps to her head, cuts, and was able to move all of her limbs. They believed that Child A was not harmed and so she was returned to class. Ms. Beasley stated that after Child A woke up from nap she appeared to be in discomfort and was acting differently but was easily soothed and comforted. When Child A's Mother arrived for pick-up she was told about Child A's fall and her behaviors. Ms. Beasley acknowledged that no child care staff telephoned or otherwise notified Child A's Mother prior to her arriving for pick up. Ms. Beasley had told child care staff to notify Child A's Mother and to complete an incident report. She does not know why this was not completed as required. Ms. Beasley also indicated that the play structure Child A appeared to have fallen from is not approved playground equipment but is rather an old awning structure that used to be used for shading the playground. The structure is scheduled to be removed as they are getting new playground equipment soon. On 11/14/2022 I completed phone contact with Child A's Mother. She expressed that Child A may not be returning to the child care until the department's investigation is completed. On 11/10/2022 she picked up Child A from the child care facility shortly after 5:00 PM. When she arrived to the classroom Child A was laying down on her cot and was rubbing her back. It is unusual for Child A to be laying down at this time, and she did not run to her as she normally does at pick up. CCSM told her that Child A had a fall outside during recess. reported a s e does not believe anyone saw Child A fall, but the staff r observe Child A laying on her back on the ground after a fall. They did not know what Child A fell from when they found her on the ground. 4 told her that after the fall incident they checked Child A over and did not Ros"erve any bruises or marks. She further stated that Child A ate lunch and napped, so they believed she was not injured. When Child A's Mother got Child A to the car and put her in the car seat, it was clear to her that Child A was in pain. She called Child A's pediatrician and was told to take her emergency room for examination. Child A's Mother took Child A to the emergency room and she was examine Child A was diagnosed with a fractured collarbone. S e expressed a normally if there is any incident with Child A, will message her. She did not hear anything from or any teacher about Child A's fall or behavior that day. Child A's Mother did briefly talk to program director Robin Beasley about the incident. She brought Child A down to Ms. Beasley's office as they were leaving to show her that Child A was clearly acting unusual and questioned her about why she was not notifi

On 9/16/2021 I completed phone contact with Child A's Mother. She indicated that the reported bruising occurred off and on with the last incident occurring approximately one month ago. She was unable to identify any of the child care staff members that were working in the classroom during these incidents. She expressed that at one point she spoke to program director Robin Beasley about her concerns with the repeated bruises and marks, and thought things would improve. Shortly after that, Child A came home with a bump on his forehead. She could not recall if any incident reports were received regarding the incidents. She believes that one of the marks he received on his arm was a handprint. She indicated that this occurred a few weeks ago. She did not say anything to Ms. Beasley about this bruise. She did not take Child A for a medical examination for any of the injuries or bruises. On 9/17/2021 I completed an unannounced onsite inspection and interviews with Ms. Beasley and child are staff member Adora Woodward. Ms. Beasley stated that she does not recall any conversation with Child A's Mother about concerns with Child A receiving multiple bruises or marks. Ms. Beasley expressed that she did receive an email recently from Child A's Mother telling her that they were planning to remove Child A from care. Child A's Mother told her they were removing him from care, because he seemed to not like it here. Child A's Mother also told her that they had observed an unidentified child hitting Child A on several occasions, but they never reported to her or to the child care staff members in the classroom. Ms. Beasley indicated that Child A enrolled at the child care in September 2020. Child A was very inconsistent in his attendance and had some health issues. He never really became fully established or comfortable in the classroom. There were a couple of incident reports regarding bruises from accidents, including a bump to his forehead. All incidents resulted from accidents and were minor in nature. She denied any knowledge of a handprint. She indicated that they have had other children in that classroom that hit or bite when upset, but that is pretty common for the age. The child care staff try to intervene before any hitting occurs, but they cannot always stop something like that from happening. Ms. Beasley provided me with the last email she received from Child A's Mother indicating why she was removing him from care. The email stated that Child A "has not had the greatest experience" and "refuses to everyday to get out of the car" or starts crying and doesn't want to go into the building. The email further stated that "this has nothing against you, I believe it is more of a teacher situation." Adora Woodard is the current lead child care staff member in the classroom. She expressed that she is familiar with Child A but pointed out that he rarely attended. 3 Ms. Woodard stated that the classroom has had children enrolled that will hit or kick when upset. She does not recall an incident of a child hitting or kicking Child A but admitted that it is possible. Child A primarily played alone and did not interact with the other children much. Ms. Woodard stated that Child A's parents never complained to her about child care staff members yelling or about bruises or marks. Child A's parents only talked to them about wanting to have more information about his day-to-day activities. On 10/11/2021 I completed phone contact with Child D's Mother. Child D (male, 3 years) has been enrolled at the child care for approximately two years. She denied any concerns with the child care or the child care staff members. She stated that Child D has never had any unexplained or concerning bruises or marks. There was one child in the classroom that can act out by hitting or kicking. The child care staff do a great job at addressing the child's behaviors when it occurs. On 10/12/2021 I completed phone contact with Child B's Mother. Child B (male, 3 years) has

Child A's Mother expressed that there were also a couple of incidents of a child care staff member yelling at Child A and other child care children. She did not know the name of the child care staff member. Anytime she reported concerns to Ms. Beasley or child care staff members, she felt they dismissed them or acted as if everything was fine. She indicated that she decided to pull Child A from the child care, because he started to cry and act terrified anytime he would attend. On 9/17/2021 I completed an unannounced onsite inspection and interviews with Ms. Beasley and child are staff member Adora Woodward. Ms. Beasley stated that she believes Child A's Mother may have been referring to former child care staff member, Amy Craig yelling at the children. Ms. Craig had a loud and stern tone, and other parents did report concerns that she was yelling at children. This was addressed with Ms. Craig at the time. Ms. Craig was terminated in August 2021, but not for this specific reason. Child A's Mother also talked about observing an unidentified child care staff member yelling at the children, but she gave no exact timeframe. Ms. Beasley provided me with the last email she received from Child A's Mother indicating why she was removing him from care. The email mentioned an unidentified child care staff member yelling at children. 5 Adora Woodard is the current lead child care staff member in the classroom. She expressed that she is familiar with Child A but pointed out that he rarely attended. She expressed that Ms. Craig was a child care staff member in the classroom for a period of time. She indicated that Ms. Craig was strict and had a loud, stern voice. She acknowledged that Ms. Craig may have yelled at the children on occasion but did not feel it was necessarily inappropriate or extreme. She reported that Ms. Craig would have to raise voice to get attention of classroom. She denied that Ms. Craig would yell directly at a child for discipline. On 10/11/2021 Child D's Mother reported that over the summer they may have had heard that a child care staff member raised her voice and was quite stern with the children. She believes her name was Ms. Amy. She expressed that Ms. Amy was not there for very long, and it was not extreme or concerning. She indicated that the current child care staff members, including Ms. Woodard are wonderful and she loves them all. Child D loves going to the child care everyday. On 10/12/2021 I completed phone contact with Child B's Mother. Child B (male, 3 years) has been enrolled since he was an infant. She denied any concerns with the child care facility. No concerns with discipline or yelling at children.

On 10/26/2020 I received an email from Child A's Mother. She reported that on 8/31/2020 she went to the child care to visit her child, and observed a scratch between her eyes. She indicated that the scratch had drawn blood. The child care staff in the classroom stated that the scratch was self-inflicted, however Child A has never scratched herself before or since that time. Child A's Mother expressed that she had not received any written documentation regarding the scratch but was only verbally notified when she arrived. On 10/27/2020 I completed an unannounced on-site inspection and interviews with program director Lindsay Potter, assistant director Robin Beasley, and child care staff members Beth Cornwell, Taylor Young, and Hannah Boennac. Ms. Potter and Ms. Beasley expressed that they were aware of the incident regarding Child A. They stated that Child A scratched herself during nap time. The scratch was very minor and was not even visible by the next day. Child A's Mother was upset about the scratch, so Ms. Beasley and Ms. Potter met with her the day it occurred and again the next day to discuss. They recommended that Child A's Mother trim Child A's fingernails to reduce the risk of her scratching herself again. Ms. Beasley and Ms. Potter were not sure if child care staff wrote up an incident report. They expressed that Child A was not taken for any medical examination or treatment for the injury. Ms. Beasley stated that typically this type of incident would either be written up on the child's daily notes or verbally reported to the parent at pick up. The child care staff would not usually write up an official incident report for something so minor that did not require medial attention. Ms. Cornwell is the lead caregiver in Child A's classroom. Ms. Boennac and Ms. Young are child care staff in the same classroom. Ms. Cornwell reported that the day of the scratch was Child A's first day at the child care. Child A did not have a scratch prior to the nap but had the scratch when she woke up. She expressed that Child A clearly had scratched herself during nap time. Ms. Cornwell and Ms. Boennac indicated that they do write up incidents, but this scratch was so minor that they had not written it up by the time Child A's Mother stopped by to visit. They indicated that with a such a minor mark they typically would just write something up in the daily notes or verbally report to a parent at pick up. When Child A's Mother became upset about the scratch, they did complete a written incident report for her. Ms. Boennac, Ms. Young, and Ms. Cornwell reported that it is not uncommon for an infant to scratch their face. They expressed that the scratch was minor and gone by the next day. They reported that Ms. Potter and Ms. Beasley met with Child A's Mother about the scratch and recommended she trim Child A's fingernails to avoid future scratch marks. They all denied that any child care staff member or other child caused the scratch to Child A's face. 4 On 11/23/2020 I completed phone contact with Child C's Mother. Child C (male, 6 months) has been enrolled at the child care for approximately three months. Child C's Mother denied any issues or concerns. She reported that the child care staff have always been really good at reporting any incident, injury, or daily activities to her. They usually send a text or include details in the daily notes. She denied any incident or injury that caused her concern. On 11/23/2020 I completed phone contact with Child D's Mother. Child D (female, 5 months) has been enrolled at the child care for approximately two months. Child D's Mother stated that child care staff are very good at reporting everything about Child D's day. She has never had any concerns about any injury or incident. Child care staff always report things to her through text or their daily notes. I attempted phone contact with Child A's Mother and Child B's Mother but did not receive any response.

During email contact with Child A's Mother, she stated that her child's classroom recently had a case of strep throat and the child care did not notify families. She only found out because Child A had a fever, and the child care reported that she could have strep throat due to a positive case in the classroom. During the onsite inspection, Ms. Potter and Ms. Beasley stated that they did notify parents of a strep throat exposure in the building. They stated that last week Ms. Cornwell came to work and over her first couple hours at work she began to have a sore throat. Ms. Cornwell was sent home as soon as she began to feel sick, and was only at the child care for two hours that day. Ms. Cornwell found out later that she had strep throat. Once they were notified of her strep throat, they sent out an email notification via their computer application and posted a notice. Ms. Potter and Ms. Beasley stated that Child A did have a fever that same week, but it is unclear if it was connected to the Ms. Cornwell's strep throat. To their knowledge, Child A's Mother never had Child A tested for strep throat so it could be a completely different diagnosis. I observed the email notification to parents regarding the positive strep throat exposure. During the onsite inspection, Ms. Cornwell reported that couple of weeks ago she was diagnosed with strep throat. She expressed that she came to work in the morning and started to feel sick within a couple of hours. As soon as she started to feel sick, she notified Ms. Beasley and left for the day. She followed up with a doctor visit and was diagnosed with strep throat. Ms. Cornwell reported that on the same day she found out had strep throat, Child A reportedly had a fever. It is unclear if it was due to strep throat or not, because Child A was never tested for strep. Ms. Corwell, Ms. Boennac, and Ms. Young stated that the notice of positive strep exposure was posted at the facility and in an email to all parents the day Ms. Cornwell was diagnosed. During phone contact with Child C's Mother and Child D's Mother, both reported that the facility always notifies parents if there is possible exposure to a communicable disease. Child C's Mother expressed that they do not typically state whether the exposure was from child care staff or a child at the center. Child D's Mother stated that the child care always notifies parents right away if there is a possible exposure. Child C's Mother and Child D's Mother both indicated that they were notified when there was a positive strep throat case in the infant classroom. I attempted phone contact with Child A's Mother and Child B's Mother, but no return calls were received.
