    On 3/2/2023 I completed an onsite inspection and interviews with child care staff member 1 and child care staff member 2. Child care staff member 1 reported that the program director Lindsey Potter was not currently onsite. She said that on 2/28/23 at the end of the day she and child care staff member 2 and child care staff member 3 had 18 children on the playground walking in a line from the playground to the building. She was in the middle of the line, child care staff member 2 was at the beginning of the line and child care staff member 3 was at the end of the line. She said Child C left the line and started to run toward a puddle. Child care staff member 3 went after Child C to get him away from the puddle, and since child care staff member 3 was at the back of the line, she (child care staff member 1) did not see child care staff member 3 leave the line and neither did child care staff member 2 who was at the beginning of the line. Child A must have left the line at the same time that child care staff member 3 went to get Child C. Child A was behind child care staff member 1 and child care staff member 2. They did not see Child A leave the line. They were in the entryway of the building taking off shoes and coats when Child C's mother brought Child A back to the building and told them that she watched the whole thing happen from her car as she was just arriving to pick up Child C. She saw her child (Child C) go to the puddle, and child care staff member 3 go after him, and then Child A left the line and went in the opposite direction toward the entrance 3 to the building that is up some stairs so she got out of her car and since she knows Child A, he came right to her and she returned him to the classroom. Child care staff member 1 said that their protocol used to be that they would count heads at the classroom door and not the entrance to the building but now they are counting heads at the entrance of the building and while leaving the play area as a result of this situation. She approximated that from the time Child C left the line to the time Child A was returned to the building was two minutes. Child care staff member 2 reported there were three child care staff members and 18 children in line transitioning from the playground to the building. They count heads when they leave the playground and then again at the classroom door. Child care staff member 2 said that she was at the beginning of the line and did not realize that Child C had left the line until she heard child care staff member 3 call out his name. She turned and saw Child C running to the puddle but never saw Child A leave the back of the line. She reported that they did not even get a chance to count heads at the classroom door before Child A was returned by Child C's mother explaining what had happened. Child care staff member 2 reported this has not happened since she has been working, and she approximated that from the time they entered the building to the time Child A was returned had been one minute. She informed me that child care staff member 3 was not onsite at the time of my interviews. On 3/3/2023 I spoke to program director Lindsey Potter. Ms. Potter reported that she spoke to Child C's mother to get the information of what she witnessed to better understand how this happened. She feels that even being well within ratio, there was obviously still a way a child could leave unnoticed, so she has implemented a new system. The classrooms will now be split into smaller groups when transitioning from the playground to the building and head count will happen when leaving the playground and when entering the building, not when entering the classroom as was the previous protocol. Ms. Potter has no concerns regarding the child care staff members. They are all new but this provided a good training opportunity for them. She was told that Child A was gone for approximately one minute. A corrective action plan was discussed and agreed upon. Ms. Potter report

    On May 18, 2022, 1 completed an unannounced onsite inspection at the facility and interviewed Program Director and Licensee Designee, 2 Lindsey Potter. She reported that Child A is 2.5 years old and on the day of the incident, in April of 2022, it was her first day transitioning into the preschool room. Child Care Staff Members, Annie Frey and Alexis Snyder were working in the classroom that day. Ms. Potter reported that in the afternoon the preschool classroom was on the playground and Child A squeezed through a space in the gate of the fence that surrounds the play area. She stated that the staff working in the preschool room saw it happen and Ms. Frey immediately went and retrieved Child A. Ms. Potter reported that Child A only made it to the sidewalk, just outside of the fence, she did not make it to the riverbank as reported. Ms. Potter text Child A's mother to let her know it happened and spoke with her at pick-up. Child A still attends the child care. Ms. Potter stated that after the incident Child A was moved back to her previous room, because that age group uses a separate playground, until the space between the gate could be fixed. They laced plastic material between the gate until a permanent solution could be installed. A part called a "dead man" was installed in the space. It is a large metal post that goes into the ground and creates a barrier between the two doors. I observed the space while onsite. The newly installed part provides an appropriate barrier to stop children from getting through the space. The sidewalk is 10-12 feet from the fully fenced play area. The river is approximately 40 yards from the playground. Ms. Potter provided me Ms. Frey and Ms. Snyder's contact information because they were not working on the day of my onsite inspection. On June 16, 2022, I made telephone contact with Ms. Frey and Ms. Snyder. Ms. Frey reported that she has worked in the preschool classroom since March of 2022. On the day of the incident Child A was in the preschool classroom for the first time. They went outside in the afternoon. While in line walking to the play area Child A tried to run from the group, but she was immediately caught and moved back into line. They were on the playground for 10-15 minutes when Ms. Frey did her first count and realized she was missing one child. She asked Ms. Snyder to count, and she was also counting one less child. Ms. Frey realized that she was missing Child A. She reported looking around and not seeing Child A anywhere. She called Ms. Potter to have her check the classroom and Ms. Potter told her to calm down and check the perimeter. Ms. Frey said that Ms. Potter walked out the front door and pointed towards the parking lot. She followed where Ms. Potter was pointing and saw Child A standing on the curb, next to the sidewalk just outside of the fence. She ran to get her and brought her back into the playground. She reported being unsure how long Child A was outside of the fence, but she was not near the riverbank when she found her. Ms. Frey reported that she did not speak with Child A's mother about the incident, but Ms. Potter did. She stated that Child A was moved back to her old classroom until the space between the gate was fixed. Ms. Snyder reported that she has worked at the facility since March of 2022 and mostly works in the preschool room. She stated that Child A was not normally in their classroom but was just transitioning the day of the incident. She stated that in 3 the afternoon they were outside in the fenced play area for around 10 minutes when Ms. Frey was doing count and said she was short one child. Ms. Snyder then counted and was also short one child. Ms. Frey realized it was Child A that was missing, and they started looking for her. Ms. Snyder stated Ms. Frey was going to head inside to see if Child A was in the classroom, but then she called Ms. Potter to look in the classroom.
