R 400.1911 · R 400.1911 Care; supervision; children. (1) A licensee shall ensure appropriate care and supervision of children at all times.
On April 28 2021, and I made an onsite inspection to the child care home and spoke to Licensee, Heather Putt about the allegation. Ms. Putt stated that on April 26, 2021, she was outside by herself with six children in care ranging in age from to years. There was Child A ( age ), Child B age hil age ), Child D 4 age Child E age ), and Minor Househo d Member a u side with her. I was playing in the wood chips under the swing set Child B and Child C started fighting over a bike on theN pa ved patio area in her fenced backyard. Child B had tried to kick Child C because did not want to share the bike Child C was riding. Ms. Putt .vent over to break up the fight. Around 11:00 AM, Ms. Putt said she observed several cars slowing down on M-89 but she did not think much about it and thought maybe there was a deer in the road or an ambulance was trying to pass. Then she heard honking and stood up on a short retaining wall to see what was going on. She saw two vehicles stopped on the corner of 44i Street and M-89 and a man and a woman were both standing there. 1 The woman shouted, "You have here." Ms. Putt ran through the garden area and out to the corner of 44th StreeaRt an M-89 where she found Child A standing just inside her property near a broken wooden fence. She stated that when she was heading towards the corner, she thought it was something different and maybe someone else's child had wandered off and she was surprised to see it was Child A. She "scooped up-' and ran back to the fenced play area where the other children were still playing. She had to unlock the gated chain-link fence to get back inside. The man followed her back inside the gate and once she was back inside the fenced play yard, she began shaking and was upset. She took the children inside right after the incident around 11:15 AM. asked Ms. Putt where the two vehicles were when she found Child A RanWs usaid they were both pulled over and off the road. The woman's car was off M-89 by an inch or two. The man's truck was parked on 441" Street and she assumed he turned off from M-89 but she was not sure. asked Ms. Putt how long she estimated the time was between the last time she saw Child A playing in the wood chips under the swing and the time she heard the car honking. She stated that she was not sure but thought it was less than five minutes. 0 Ms. Putt described Child A as a very active child and said thinks it is funny to do things when is told "no." ■ will watch the adults and wait until they are distracted an then try to run away. Child A has been caught before trying to climb up the retaining wall into the garden or crawling up the nine cement steps towards the driveway which are both outside the play area. Ms. Putt stated that she has put a bench across the base of the stairs to deter Child A and the other children from going up the steps and that she usually sits on the bench to watch the children, but Child A has crawled under the bench to escape before. Ms. Putt said she cannot find anythin outdoors to occupy Child A's attention and that she will sometimes try to contain in a swing, but that is not always possible when she or child care staff member, renda Huggett, have to take children inside to use the bathroom. On April 26, 2021, Ms. Putt denies ever going inside the home for an reason or leaving the children unattended. She stated that Child A runs away from mother at home, and they have had many conversations about it since Chil started walking in the wintertime. Ms. Putt stated that Child A's Mother loves her child care home was after she told her about the incident. and• discussed a safety plan with Ms. Putt to prevent any other children "romescaping her fenced in play area. Ms. Putt agreed to have one adult sit on the bench or at the table to prevent children from gaining access to the unfenced areas. . On April 26, 2021, Child A , ) was found on M-89 unattended. Vehicles on M-89 were travelinagg 5e5W MPaHn there were two lanes of traffic. Several vehicles swerved to avoid hitting Child A. A concerned citizen stopped and removed Child A from the roadway. Licensee, Heather Putt, indicated that Child A had escaped her fenced yard. Child A was not injured or harmed.

On April 28, 2021, and I asked for a copy of Child B's child information card and Ms. Putt could not find the card during the onsite inspection. She was going to send a copy to the department after she located it, but the card was not made available to the department until May 10, 2021, when we made another onsite inspection to the child care home. The card was signed by the parent on May 3, 2021.

One of the two large play structures used by the children in care that included swings, a climber, a round swing, and a slide were placed over hard packed grass and dirt. A second swing set that included a regular swing, an infant swing, and some hand bars were placed over mulch that was deteriorated down to the dirt, the black weed barrier, and there were clumps of grass growing into the fall zone.
