On 10/12/2022 the complainant stated that on 09/13/2022 the building was evacuated when the fire alarm was sounded, and Ms. Rarick left Child A sleeping in the Pre-k classroom when she exited the building with the Pre-k children. Ms. Rarick was covering for Ms. Decker who was on her lunch break. When Ms. Decker returned to the class, they were outside. She noticed that Child A was not with the group, and she went back into the building to retrieve Child A. Ms. Decker found Child A sleeping on his cot in the Pre-k classroom. On 10/12/2022 Ms. Rarick stated that the building was evacuated on 09/13/2022 because the fire alarm went off. The fire department arrived and determined that the building was safe for them to return. The alarm went off around 12:30 pm during naptime. She was in the Pre-k classroom and when she exited the classroom, she left Child A sleeping on his cot in the classroom. She did not realize that Child A was left in the classroom until Ms. Decker arrived outside and asked where Child A was located. Ms. Decker returned to the classroom and retrieved Child A who was still on his cot asleep. The children were outside fifteen to twenty minutes before they realized Child A was still in the building. Ms. Rarick stated that the building was also evacuated on 09/23/2022 when the fire alarm was sounded, and she did not contact the department within 24 hours or submit the written form within 72 hours either time that the center was evacuated. Ms. Rarick was not aware of the requirement which was why she did not contact the department within 24 hours and provide the written form within 72 hours when the center was evacuated. When I requested Child A's child information card, Ms. Rarick did not have a completed child information card on file for Child A. She was not sure why she did not have a completed child information card on file. Child A was enrolled at the center on July 11, 2022. On 10/12/2022 I reviewed the 09/13/2022 name-to-face sheet for the Pre-k classroom. There were six children present with Ms. Rarick. The ages of the children in the Pre-k classroom are 4-5-year-olds. The child care staff member to child ratio is 1:12. The center was in compliance. On 11/23/2022 Child A's Mother stated that she completed a child information card for Child A and provided it to the center when he was enrolled. 3
Ms. Rarick left Child A (four-year-old, male) alone in the preschool classroom when the fire alarm was sounded, and the building was evacuated. Ms. Rarick did not inform Child A's parents when he was left alone in the Pre-k classroom when the building was evacuated. The center does not maintain the required child care staff member to child ratio in the Preschool classroom.

On 10/12/2022 the complainant stated that Child A's Mother was not informed when Child A was left in the Pre-k classroom when the center was evacuated because the fire alarm was sounded. Ms. Rarick did not want to inform the parents because she did not want to get in trouble for leaving Child A alone in the classroom. On 10/12/2022 Ms. Rarick stated that she did not inform Child A's parents when he was left alone because it was a short period of time that he was left unsupervised, so she did not feel that the parent should be informed. I informed Ms. Rarick that the parents should have been informed of the incident. On 11/23/2022 Child A's Mother stated that she was never informed by the center that Child A was left alone in the classroom when the building was evacuated 5 because the fire alarm was sounded on 09/13/2022. She disenrolled Child A from the center a couple of weeks ago; she could not remember the exact date. She stated that learning that Child A was left alone and was not informed, confirmed that she made the correct decision when she disenrolled Child A.

On 10/12/2022 the complainant stated that the center does not maintain the required child care staff member to child ratio in the preschool classroom. The complainant did not have a specific number of children, days, or times. On 10/12/2022 Ms. Rarick stated that the Preschool classroom was not out of ratio because she will either go into the classroom or have another child care staff member go into the classroom to maintain the required ratio. On 10/12/2022 I reviewed the name-to-face sheets for the Preschool classroom for the week of 09/26/2022 and 10/03/2022. I found the classroom to be in compliance with the child care staff member to child ratio of 1:8. On 12/01/2022 Ms. Hancock stated that she works in the infant classroom and the classroom is never out of ratio. When the fifth child arrives, Ms. Rarick will either go into the classroom or send another child care staff member into the classroom. She has not heard of other classrooms being out of ratio.

I was unable to reach the complainant for additional information. I made an unannounced, on-site visit to the center on 2/10/22 at naptime and visited the five rooms operating (Infant, Preschool, Pre-k, Toddler 1 and Toddler 2) to check for proper CCSM-to-child ratios. Proper ratios were maintained in all rooms. The Preschool and Pre-k rooms were combined. There were two CCSMs with 18 children, age 3 to 4 years, appropriate for the required 1:10 ratio. In the Infant room there were two CCSMs and seven children, appropriate for the required 1:4 ratio. In Toddler 1, there was one CCSM with four children, appropriate for the required 1:4 ratio. 2 In Toddler 2, there were three CCSMs and ten children, appropriate for the required 1:4 ratio. I interviewed program director Justine Sirajeldin. She acknowledged that at naptime proper ratios are not always maintained. When all of the children are asleep, one staff person takes a lunchbreak which sometimes leaves one caregiver to watch all of the children for that hour. Proper CCSM-to-child ratios are maintained outside of naptime. Ms. Sirajeldin is aware that compliance with the current ratio rules require maintaining proper ratios per R 400.8182(3) at all times regardless of whether children are awake or asleep. She is actively seeking to hire additional staff and believes that she currently has the ability to mobilize existing resources to maintain consistent compliance. Preschool staff member Hannah Decker said she typically works alone in the classroom where there are no more than 10 children. At naptime, when the Preschool and Pre-k rooms combine, there are as many as 20 children supervised by a single CCSM. When all children are asleep, if there is not anyone to fill in so that staff can take a lunchbreak, one person supervises a maximum of 20 children for about one hour. It has been a common practice and occurred twice in the past week. Some improvement has been noted. Pre-K staff member Naomi Eicher reported the same. She typically works alone with no more than ten children outside of naptime. During naptime when the rooms combine and one staff member takes a break, they are out of ratio for about an hour. The practice is common. Sometimes there is a staff member to help maintain proper ratios while staff members take a break during the children's lunchtime. I interviewed Toddler 1 staff member Christine Netschke by phone on 02/24/2022. She said the required 1:4 CCSM-to-child ratios are maintained except at lunchtime on days when there are more than four children present which happens about twice weekly. One staff member will take a lunchbreak when most of the children are sleeping, placing the room out of ratio during that hour. There are a maximum of eight children in the room at any given time. On the inspection date, Toddler 2 staff member Anayvi Martin said proper ratios of 1:4 are usually maintained with two CCSMs and a maximum of eight children. However, when all children are asleep and one of the two CCSMs takes a lunch break, one CCSM supervises up to eight children. This happens roughly 50% of the time. I interviewed the Infant Room CCSM by phone on 02/24/2020. She said the proper CCSM ratio of 1:4 is consistently maintained, including at naptime. There are typically two staff members with seven to eight infants. 3

At naptime when the 3- to 5-year-old children in the Preschool and Pre-k rooms combine, a CCSM-to-child ratio of 1:10 is required.
