Child Care Staff Member 1 assured Child B's Guardian that Child A and Child B would not sit together in class and that if they were in the loft area where Child B was previously seen with Child A there would be an adult present. Child Care S a Member 1 did not follow through on implementing this safety plan and did not direct any other child care staff members in the room to keep the children apart. After the January 2023 incident there were other reported incidents witnessed by Child Care Staff Member 1 where Child A and Child B were seen together with Child B On March 17, 2023, Child B's Guardian went to pick up Child B from the center. While waiting outside in the car she received a text message from Witness 1 asking for her to park and come inside. Child B's Guardian stated that she went into the office and met with program director Kristin Crowe and Child Care Staff Member 2. Child B's Guardian was informed that Child Care Staff Member 2 saw Child A and Child B of the classroom while she was standing across the room in the bathroom doorway. On 2/16/23; I reviewed the incident report the department received from the center. On 2/16/23, 1 conducted an unannounced onsite inspection to the center and interviewed Ms. JoAnn Telfer, licensee designee and Ms. Kristin Crowe, program director regarding the allegations. Both Ms. Telfer and Ms. Crowe informed me that the center was notified on 2115/23 by Child A's Mother of the incident. Child A's Mother said Child A informed her that on 2/14123, an undisclosed Child A's while at the center and when she told while wa t 's Mother and ran a er met with s. Telfer and Ms. Crowe at the center on 3/15/23 around 4:00 p.m. According to Child A's Mother and Grandfather when Child A arrived home from the center on 2/14/23, Child A's Mother changed Child A's clothes and noticed that she had diaper cream on her private areas. The center also made Child B's Parents aware of the incident and some of the ongoing behavior issues Child B has been displaying in the classroom that included acting aggressively towards his classmates and child care staff members (CCSMs), using Both people as Child walks past them. Crowe explained that these behaviors from Child B were not acceptable behaviors and when he displayed them, the CCSM would immediately remove Child B away from the group of children and talk with him individually about his behaviors and inform him by telling him tha Psqca After speaking with all the CCSMs who worked in Child ossr000mo olnqW, the CCSMs sai*thehave not noticed any sustained physical contact when Child B They also denied FChild seeing Child A CCSMs said when the children are in the bathroom, there is always a CCSM standing in the doorway observing while the children use the bathroom. Some of the CCSMs said they have seen the children crawl under the bathroom stalls to include Child A but said when the children do it, the CCSM immediately intervenes telling the child that this behavior is unacceptable. Since being made aware of the incident, the center completed an incident report for the department, made other state agencies aware if the incident, and separately met with both parents regarding the incident, to include Child A's Mother and Child B's Father. The center informed Child B's Father of their recent behavioral observations they have observed in Child B while in class that included the . Ms. Telfer informed me that the center has o ere s family with the following strategies since he begun displaying behavior issues; parent meetings, special education referral; set up a behavior modification plan, support from behavior analyst from Fo and providing the classroom with extra CCSM support when needed assist in helping Child B with his behaviors. On 119/23, 1 conducted an unannounced onsite inspection to the center and interviewed Ms. JoAnn Telfer, licensee designee and Ms. Kristin Crowe, program director. I informed them of the allegation. Both Ms. Crowe and Ms. Telfer informed me that they were already aware of the allegation based on a Title IX complaint with the same allegation being filed with the Ann Arbor School District. Both Ms. Telfer and Ms. Crowe said that all of the child care staff members, substitute teachers, therapists, and family advocates who work in Child A's classroom were spoken to regarding the allegation. According to Ms. Telfer and Ms. Crowe, the allegations were unfounded as none of the staff members could recall an incident occurring involving Child A being another child while Both Ms. Crowe and Ms. Telfer further informed me that the that Child 's classroom (A103) use are with another c assroom (A105). When the children use the bathroom, theRcWi carestaff members are present with the children and directly supervise them while in the bathroom. Ms. Telfer and Ms. Crowe provided me with contact information and a list of all of the child care staff members who has worked in Child A's classroom which included all of the child care staff members, substitute teachers, therapists, and family advocates that work in Child A's classroom. Ms. Telfer informed me that child 3 care staff member 8 (CCSM 8) and child care staff member 2 (CCSM 2) were Child A's primary teachers, however when they were absent, there were two long term substitute teachers who worked in the classroom with Child A, child care staff member 7 (CCSM 7) and child care staff member 9 (CCSM 9). Ms. Telfer acknowledged the center always being staffed within the correct child care staff member to child care ratio requirements of 1:10. She denied Child A's classroom having a lot of different substitute teachers working with Child A when her primary teachers were unavailable. During my unannounced onsite investigation, I interviewed CCSM 8, who is the primary lead caregiver of Child A's classroom (A103) and reports to like her job and working with the children each day. According to CCSM 8, over winter break, on 12/31/22 she received a text message from Child A's Father indicating hild A ibiieiigiaiin having ,regressing in and having and having to . Child s Father informed CCSM 8 that Child A about why she was having the in her Child A's Father also indicated Child said during her nightmares. Child A's Father also texted that Child A was not using the bathroom and having a lot of accidents. When he spoke with Child A about it; Child A told him that while she was using the bathroom at school, another came into her bathroom CCSM 8 asked Child A's Father if he could be more specific detailing what a allegedly happened to Child A. Child A's Father responded back by texting when Child A was CCSM 8 said she immediately made the administration of the center aware of ild A's Fathers text messages. CCSM 8 said there was no timeframe given when this could have taken place. Child A's Father sent her an audio voice message of Child A saying a child's name that he could not understand. Child A's Father asked CCSM 8 if she could make out the name Child A was saying from the audio recording. He added that when Child A used the toilet, he had to stand outside with the door opened. CCSM 8 listened to the audio recording which she thought may have been the name of Child B but indicated the audio recording was not very clear. CCSM 8 said Child A's Father continued to call her and try to get CCSM 8 to tell him what child name was from the audio recording. CCSM 8 explained to Child A's Father that she could not disclose any information relating to a child care child due to privacy act restrictions. CCSM 8 said Child A has been enrolled in care approximately four and a half months. She described Child A as a very sweet and caring girl who gets along great with all of the children. On October 12, 2022, licensee designee JoAnn Telfer submitted an incident report to the department indicating that child care staff member was observed picking Child A (female, age 4 years) up by the armpits and carrying her across the room on October 11, 2022. During the onsite inspection October 18, 2022, licensee designee and program director Kristen Crowe reported that on October 11, 2022, child care staff members Holly Toy and Darlene Manross reported 2 seeing child care staff member Michelle Trummel pick Child A up by the armpits and carrying her across the room while Child A's legs were flailing. Ms. Manross told Ms. Trummel to go to lunch and told her that she would handle Child A. Ms. Telfer stated that Ms. Trummel was interviewed and then placed on administrative leave pending the outcome of the investigation. Licensee designee JoAnn Telfer stated that Michelle Trummel has been employed by the center since September 6, 2022, however she has 30 years of experience in child care. Ms. Telfer and program director Kristen Crowe stated that during the interview with Ms. Trummel she was very surprised about the allegations. Ms. Trummel gave all of the correct answers with regard to how to handle a child who did not want to transition. Ms. Trummel stated that she did not remember picking up Child A by the armpits and carrying her across the room. Ms. Telfer stated that the center's internal policy requires that children's feet remain on the ground at all times and their bodies should be able to move freely. Child care staff members are not allowed to pick children up to move them from one place to another. Ms. Telfer stated Ms. Trummel was informed of the center's policy when she was hired. Ms. Telfer reported the incident to Child A's Mother on October 12, 2022. Child A's Mother felt really bad for Child A after hearing about the incident. After Child A's Mother spoke with Child A about the incident Child A told her that she was "scared of Ms. Trummel" and she did not want to see her again. Ms. Telfer stated that Child A loves to read, and she is not happy when she has to transition from reading in the loft area of the classroom. Child care staff member Holly Toy has been employed by the center for one year. She stated that she has worked with Michelle Trummel for a couple of weeks. Ms. Toy stated that on October 11, 2022, Child A was in the loft area of the classroom reading a book when it was time to transition to the gym. Child A did not want to leave the loft, so Ms. Trummel picked Child A up underneath her arms while yelling at her that she needed to listen. Child A was crying, and distraught while being carried by Ms. Trummel. Ms. Trummel continued yelling at Child A even after Child A was crying. Ms. Toy felt that Ms. Trummel's behavior was unprofessional and inappropriate. Ms. Toy stated that Child A was not hurt, but it made her uncomfortable. Ms. Toy feels that Ms. Trummel is too aggressive in the way that she speaks to children. She hasn't observed Ms. Trummel being abusive but her behavior was not appropriate. She sometimes gets nose to nose with a child when she corrects them. Ms. Toy stated that she finally reported her concerns to Ms. Telfer and Ms. Crowe because she did not feel that Ms. Trummel was a "good fit" for the center and her presence set a negative tone in the classroom. Ms. Toy was concerned that it could escalate to the point of abuse because of how aggressive Ms. Trummel had become in only one month's time and she didn't want anyone to get hurt. Child care staff member Darlene Manross has been employed by the center for 2 '/2 weeks. Ms. Manross stated that on October 11, 2022, she was working in the 3 preschool classroom with Holly Toy and Michelle Trummel. She had only been working with Ms. Trummel for one week as of October 11, 2022. Program director JoAnn Telfer submitted an incident report on April 29, 2022, indicating that Child A walked away from two child care staff members Christy Corkin and Nicholas Chaconas unnoticed while walking from the playground to the classroom along with eight other children. During the onsite inspection on May 2, 2022, I interviewed program director JoAnn Telfer and was able to review camera footage from the time of the incident on April 28, 2022. Ms. Telfer stated that lead child care staff member Christy Corkin and substitute child care staff member Nicholas Chaconas were returning to their preschool classroom after leaving the playground with nine children. The camera footage shows that at 2:33 PM, Ms. Corkin and Mr. Chaconas were walking down the hall with nine children in a single file line. Ms. Corkin was walking at the front of the line with one child in front of her and Mr. Chaconas was at the end of the line. As they were walking down the hall one of the children fell to the floor and appeared 2 to be upset. Mr. Chaconas moved from the end of the line and walked over to the child on the floor. After Mr. Chaconas left the end of the line there were two children who were now at the end of the line. Ms. Corkin continued to walk toward the classroom. Still at 2:33 PM as Mr. Chaconas was assisting the child on the floor and Ms. Corkin continued walking down the hall with her back to the children Child A turned and walked back around the corner and down the hall in the opposite direction of the classroom. At 2:35 PM camera footage shows Ms. Telfer returning Child A to her classroom. Ms. Telfer stated that she was walking down the hall when she saw Child A sitting on the floor. Child A told Ms. Telfer that she left her coat on the playground and she wanted to go get it. Ms. Telfer took Child A to the classroom and told Ms. Corkin that she found her in the hall. Ms. Telfer then took Child A to playground to get her coat. The hall where Child A was found was not located near any hazards or near any exit doors. Ms. Telfer stated that Ms. Corkin and Mr. Chaconas did not follow the center's procedures which required them to count children before crossing any threshold including the classroom door. Mr. Telfer stated that she contacted Child A's Father to report the incident. She stated that Child A's Father was very understanding and stated that Child A has walked away Iit:7ii 1111I T t:7- Substitute child care staff member Nicholas Chaconas has been employed by the center for two months. He stated that Thursday, April 28, 2022, was a different day than normal in the classroom. There were three children who were having a rough day. There were two children who were also having a difficult time when they were coming in from recess. Mr. Chaconas stated that as they were coming inside, Ms. Corkin counted the children before walking down the hall. As they were walking down the hall one of the children fell to the floor upset about coming inside. Mr. Chaconas went over and tried to assist this child. He did not realize that Child A walked away from the group until Ms. Corkin told him after they made it to the classroom. Mr. Chaconas stated that he feels bad because he knows that child care staff members are supposed to keep track of the children. He was initially at the back of the line while Ms. Corkin was at the front but when the child started getting upset, he left the end of the line. Mr. Chaconas stated that he has worked as a substitute in this preschool classroom two to four times before, but he became overwhelmed when the children were having a hard time. He stated that when he has worked with Ms. Corkin in the past, she has always counted the children as they entered the room, but they were both distracted on this occasion. Program director JoAnn Telfer submitted an incident report March 24, 2022, indicating that Child A was left unattended in the classroom when child care staff members, Polly Salvato and Noah Helber left the room with the rest of the children to go to the outdoor play area. During the onsite inspection on March 25, 2022, I interviewed program director JoAnn Telfer was able to review camera footage the time of the incident on March 2 24, 2022. Ms. Telfer stated that there were 13 children in the preschool classroom with child care staff members Polly Salvato and Rachel Bergeren and substitute child care staff member Noah Helber. The camera footage shows that at 9:34 AM, Ms. Salvato opened the classroom door at the same time child care staff member Rachel Bergeren exited the room and walked off down the hall. At 9:35 AM Ms. Salvato and Mr. Helber left the classroom with 12 children. At 9:36 AM Mr. Helber walked back down the hall and returned to the classroom. Family support specialist Laura Dills was also walking down the hall at the same time as Mr. Helber. Ms. Dills unlocks the door to Mr. Helber's classroom and continues to another classroom. Ms. Telfer indicated that Ms. Dills reported that Mr. Helber asked her to open the locked classroom door, stating that he left something inside. At 9:37 AM Mr. Helber leaves the classroom with Child A. After watching this footage Ms. Telfer then showed footage from the hallway where Ms. Salvato was located with 12 children at 9:36 AM after Mr. Helber returned to the classroom. This footage shows Child B and Child C running away from the group. Ms. Salvato remained with the other 10 children and at 9:37 AM when Ms. Dills walked down the hall toward her, she informed her that Child B and Child C children ran away from the group. Ms. Salvato pointed in the direction that the children ran, and Ms. Dills ran off to look for them. Seconds later Mr. Helber returned to the group with Child A and Ms. Salvato told him that Child B and Child C ran away from the group. Mr. Helber then leaves to look for the children. The very large center is divided into four separate pods each painted a different color. There are several classrooms as well as offices in each pod. Walking down the hall in each pod and turning the corner leads to another pod. The camera footage showed that Child B and Child C ran to the second pod from the hall where they were standing with Ms. Salvato, however both Ms. Dills and Mr. Helber ran to the first pod to look for them. When Ms. Dills did not find Child B and Child C, she went to the main office to request assistance to look for them. At 9:39 AM Mr. Helber returned to the hall with Ms. Salvato and the 11 children who were waiting with her. Ms. Helber remained with the children and Ms. Salvato then went to look for Child B and Child C. At 9:40 AM Ms. Dills, principal Kristen Crowe and secretary, Sherri Polovick run down the hallways looking for Child B and Child C. At 9:41 AM Ms. Crowe and Ms. Polovick return to the hall where Ms. Helber was waiting with the children along with Child B and Child C. Ms. Telfer stated that Ms. Polovick looked in an adult bathroom in the hall and saw Child B's and Child C's feet underneath the bathroom stall. Program director JoAnn Telfer submitted an incident report on August 30, 2021, notifying the department that Child A (male, age 3 years) left his classroom unnoticed by the child care staff members and returned to the outdoor play area. During the onsite inspection on September 7, 2021, Ms. Telfer stated that child care staff members Phyllis Newman and Abla Zeidan were working in the preschool 2 classroom with 10 children on August 30, 2021. Ms. Newman and Ms. Zeidan used the door in their classroom to access the outdoor play area. At approximately 10:00 AM on August 30, 2021, Ms. Newman and Ms. Zeidan took the children outside to play. Ms. Newman and Ms. Zeidan reported to Ms. Telfer that they returned to the classroom with the children at 10:35 AM. Both Ms. Newman and Ms. Zeidan stated that they are "100 percent" sure that Child A came into the classroom along with them and the other nine children. Ms. Newman and Ms. Zeidan reportedly counted the children as they were coming in the door to the classroom. Ms. Telfer stated that Ms. Newman and Ms. Zeidan said that they are sure that they counted 10 children however they did not follow the center's policy to count the children again after they entered the classroom. Once they were in the room it was reported to Ms. Telfer that one child was crying, and Ms. Newman was comforting that child. At 10:50AM child care staff member Emily Warner came into the classroom to cover Ms. Zeidan's lunch break. Ms. Zeidan left the class to go to lunch at 10:53 AM. Ms. Telfer stated that she is not sure when Child A left the classroom to go back to the play area but at 11:09 AM child care staff member Krista Walton brought Child A to the office. Ms. Walton and child care staff member Mandy Hall were on the playground with children from their preschool classrooms when they counted the children and realized that there was one too many children. Ms. Telfer stated that since it was the first day of school Ms. Walton and Ms. Hall didn't know which class Child A belonged in. Ms. Telfer stated that she took Child A to his class and informed Ms. Newman that he was found outside on the playground. Ms. Newman stated that she believes that Child A might have slipped out of the line when she was gathering children to go inside at 10:35 AM. Ms. Zeidan thought that Child A might have gone outside when Ms. Newman went to get another child that was still on the playground at 10:35 AM. Ms. Telfer stated that after she returned Child A to his classroom, she reviewed camera footage to find out how and when Child A left the classroom. Ms. Telfer stated that the footage showed Ms. Newman and Ms. Zeidan going inside with their class at 10:35 AM. Also, at 10:35 AM child care staff member Megan Brynolf and Carolyn Sochacki entered the playground with their class. At 10:55 AM Ms. Walton and Ms. Hall came outside with their classes. Ms. Telfer stated unfortunately, the camera footage skips not allowing her to see certain timeframes. She was not able to see the entire time that Ms. Newman and Ms. Zeidan transitioned from the playground to the classroom. She was also never able to see Child A playing outside after Ms. Newman and Ms. Zeidan went into the classroom, but she did see him walking toward the door with Ms. Walton at 11:09 AM prior to Child A being brought to the office. Ms. Telfer stated that after reviewing the footage several times she was not able to determine exactly how long Child A was outside without Ms. Newman and Ms. Zeidan because of how the footage skipped but she was able to see that he was never outside without supervision. Ms. Telfer stated that the door from the classroom that leads to the playground is "pretty heavy" and she's not sure that Child A could open it.
