R 400.8125 · R 400.8125 Staff; volunteer; requirements. (1) All staff and volunteers shall provide appropriate care and supervision of children at all times.
On February 25, 2022, I made an unannounced onsite inspection to the child care center. During the onsite inspection discussed the allegations in the complaint with the program director Peggy Kaczmarek. Ms. Kaczmarek was aware that Child A's parents were upset that Child A had not been eating her lunch. The child care children bring their own lunches from home. Child A along with the other child care children are served their lunch during lunch time. The child care staff members encourage the children to eat their lunches, however they do not force them to eat. Child A has even been given extra time to eat but does not always eat her lunch. When children do not eat their lunch, the food is sent back home so the parents know what the child did and didn't eat. Ms. Kaczmarek stated that they do not give the children sugary snacks, however there is nothing in Child A's file regarding allergies or dietary restrictions. Ms. Kaczmarek stated on February 23, 2022, Child A's Father came to the center at pickup time and was angry that Child A had not eaten her lunch or snack. Ms. Kaczmarek went on to say she had gone into the Pre-K classroom during snack time that day and saw Child A at the table with her snack in front of her during snack, however she did not stay in the classroom and couldn't confirm whether she ate the snack or not. 2 During the onsite inspection I reviewed Child A's child information card and enrolment documents. In the allergy section of the child information card there are no allergies listed on the card. On the enrollment form there is question that ask, "Are there any foods your child should not be given?" The answer to the question on the form was no. During the onsite inspection on February 25, 2022, I interviewed child care staff member Mahwish Batool. Ms. Batool states that she works in the Pre-K classroom. I made Ms. Batool aware of the allegations in the complaint. Ms. Batool stated Child A brings her lunch from home and the center provides a morning and an afternoon snack. Ms. Batool stated she gives the children their lunches and if a child does not want to eat, she will try to convince them to eat some of their food but does not force them to eat. Child A will sometimes eat small amounts of her lunch but is not a big eater. They do no serve sugary snacks to the children. Snacks are things like fruit and veggie straws or gold fish. Ms. Batool went on to say two or three weeks ago Child A's Father told her that Child A couldn't have a lot of sugar, but then they place sugary drinks in her lunch and send Lunchables with cookies in them. On Valentine's Day parents sent in goody bags, which contained candy, however she did not serve the bags to the children at the center, she placed them in their bags to take home so their parents could decide if they wanted them to have the goody bags. During onsite inspection I reviewed the emails exchanged between Ms. Batool and Child A's Mother. In the email exchange Ms. Batool acknowledged the concern over Child A not eating her lunch and explained the ways she tried to encourage her to eat her food. The email also went on to state that if sugary foods are sent in her lunch bag, she can't stop her from eating those things. The exchange also discussed the Valentine's goody bags being sent home and the snacks the center provides. On Valentine's Day they ordered pizza for lunch and decorated cookies, which some children at and others took home with them. During the onsite inspection I viewed the snack menu, which consisted of healthy snacks such as graham crackers and fruit. I also viewed the snack cabinet in the kitchen to confirm there were no sugary snacks being provided. While onsite I conducted and exit conference to discuss my findings with the program director Ms. Kaczmarek.
Child A (female, age 5 years) is not eating her lunch and being allowed to have sugary foods when she is unable to have sugar.

The kitchen in the child care center is dirty and contains expired and moldy food. The carpets are dirty and have not been cleaned. The classroom and toys are not cleaned regularly. There is not enough food in the center to provide adequate snacks for the child care children. The center is understaffed and frequently out of ratio.

On January 28, 2022, I made an unannounced onsite inspection to the child care center. I discussed the allegations in the complaint with the program director Peggy Kaczmarek. I asked Ms. Kaczmarek about the cleaning method they use to clean the toys in the center. Ms. Kaczmarek stated that she has cleaning wipes available for the child care staff to use to clean the toys in the classrooms and for larger toys they spray them with bleach water. I asked Ms. Kaczmarek what cleaning process they use for the to clean the kitchen, she stated they use a three-step method cleaning method of washing, rinsing, and sanitizing. 2 During the onsite inspection I viewed the kitchen of the center. The refrigerator was extremely dirty and had mold on the door frame and old sticky food at the bottom of the refrigerator. There were carrots, apples, and strawberries in the refrigerator they did not present as spoiled or moldy. One of the kitchen cabinets was broken and sitting on the floor. I checked the food in the cabinets there were Cheerios in the cabinet which had been opened January 27, 2022, GoGo squeeze applesauce pouches with an expiration date of November 12, 2022, and bagels with an expiration date of February 9, 2022. There were a variety of other crackers and snacks in the cabinets. There was one package of unopened Sun butter in the cabinets was expired. Ms. Kaczmarek stated that they do not serve the Sun Butter but had purchased it a few years ago for an experiment, that they never did. I informed Ms. Kaczmarek that she should dispose of the expired food even if they did not plan on serving it. I viewed the condition of the carpet in the center. The carpet did not appear to be dirty or soiled. Ms. Kaczmarek provided a copy of the receipt showing the carpet was professionally cleaned July 5, 2021. During the onsite inspection on January 28, 2022, I interviewed child care staff member Jala Burroughs regarding the allegations in the complaint. Ms. Burroughs stated that she assists in the 2-year-old classroom and the toys in that classroom have not been cleaned or sanitized in months. Ms. Burroughs thinks part of the problem is they have been having a lot of turn over with child care staff members and the newer child care staff members have not been given directions on cleaning and sanitizing the equipment. The center only has two classrooms that are switching out their bleach water for new sanitizing solution. Ms. Burroughs went on to say that she knows "Ms. Beverly's class cleans and sprays the toys in her classroom." During the onsite inspection I interviewed child care staff member LaDawn Walton- Edmonds. Ms. Walton-Edmonds stated they do not have a cleaning procedure that they have been trained in, however she knows that the toys were not being cleaned properly. I interviewed child care staff member Yvette Murry. Ms. Murry stated that usually works in the 2-year-old classroom with Ms. Walton-Edmonds. She started working at the center in November of 2021. Ms. Murry stated that since Ms. Walton- Edmonds started there has been more structure in the classroom and they spray the toys every night. They now use a three-step process to clean them ending with spraying them with bleach water. 3

On January 28, 2022, I discussed the allegations in the complaint with the program director Peggy Kaczmarek. Ms. Kaczmarek stated that they provide morning and afternoon snacks for the child care children. They are a nut free center, as they have one child in the center with an allergy to cashew and pistachios. Ms. Kaczmarek went on to say that "yes" she was out of town attending to family business, however prior to leaving she went shopping and there were people from the church that went shopping for the center while she was gone, so she is unaware of there being a time that the child care staff members were struggling to have enough food for the child care children to have for snack. During the onsite inspection I interviewed child care staff member Jala Burroughs. Ms. Burroughs stated she assist in the 2-year-old classroom, but her primary responsibilities are preparing and serving snacks and handling the pick up and drop off door. She has been working at the center since January of 2020. Ms. Burroughs stated that the center always has snacks available for the children, however she frequently has to substitute what is on the menu, because they don't have the listed items in the center. She went on to say that in December 2021 there was barely any food in the center, they "make do with what they have available to make sure the children eat. At the time of the onsite inspection, I observed Ms. Burroughs preparing to provide snack to the children. I noted that what she was serving did not match what was on the menu. The posted menu stated that the afternoon snack was Goldfish and oranges. The snack that was being served was banana's, graham crackers, goldfish, and apple sauce pouches. Ms. Kaczmarek reprimanded Ms. Burroughs and told her to serve the snack that was listed. Ms. Burroughs replied that they did not have any oranges and there were not enough Goldfish for all of the children. Ms. Kaczmarek checked the kitchen and came back and confirmed that there were no oranges.

On January 28, 2022, I made an unannounced onsite inspection to the child care center. I discussed the allegations in the complaint with the program director Peggy Kaczmarek. Ms. Kaczmarek stated that they are understaffed and she is working hard to hire new employees. They have also had a problem with frequent call offs of the child care staff members that are already employed at the center. Ms. Kaczmarek states that she does everything she can to avoid being out of ratio. On January 18, 2022, she had to close the center for the day because there was not enough staff. On January 14, 2022, she has to close the center at 3:00 p.m. because there was not enough child care staff members available to keep the center open. Ms. Kaczmarek stated that she also moves the child care staff members to different classrooms and will combine rooms to keep them in ratio. During the onsite inspection on January 28, 2022, I interviewed child care staff member Jala Burroughs. Ms. Burroughs stated that the center is "short staffed" and they have had to close when there were not enough child care staff members, however last week Ms. Pasha was working in a classroom by herself with nine 1-2 year-old children. During the onsite inspection I interviewed child care staff member LaDawn Walton- Edmonds. Ms. Walton-Edmonds stated that she works with the 2-year-old children and works alone the majority of the time. She is usually alone with between four to six, 2-year-old child care children. There have been times she can't even go to the rest room, because there are not enough child care staff members, so someone can come in and watch the children so she can step out of the classroom. She has text the program director and asked her to come into the classroom, however she did not receive a response to the text. Ms. Walton-Edmonds stated that there was one instance that she was caring for 10 children of various ages alone, however that is not the norm she usually has between four and five child care children. During the onsite inspection I interviewed child care staff member Yvette Murry. Ms. Murry stated that she works in the classroom with Ms. Walton-Edmonds a lot, they usually have six or seven children in the classroom. Ms. Murry stated that she has had to work alone with the child care children, however she does not recall ever having to have more than four children. Ms. Murry stated she has never seen any of the classrooms out of ratio when she is at the center. Ms. Murry stated that the center is "definitely understaffed," however, she does not think the classrooms are out of ratio often. On January 28, 2022, I completed an exit conference with the program director Peggy Kaczmarek and discussed the findings of the complaint. Ms. Kaczmarek stated that she tries to maintain ratio at all times, however it is hard to do so when people call off at the last minute or no call no show. She does what she can to combine classrooms and has closed the center early to avoid being out of ratio. A

Although the center is not providing the snacks listed on the menu the snacks provided are healthy and meet the two- component requirement for centers.
