Program director/licensee designee Holly Delgado submitted an incident report indicating that on Friday, September 15, 2023, at approximately 5:25 PM Child A (male, age 1 year) was left unattended in the fenced outdoor play area for about five minutes. During the onsite inspection on September 19, 2023, Ms. Delgado stated that Child Care Staff Member 1 and Child Care Staff Member 2 were working together in the Penguin toddler classroom on September 15, 2023. At approximately 5:15 PM Child Care Staff Member 1 and Child Care Staff Member 2 2 were outside with children as they were being picked up for the day. There were four children left outside when Child Care Staff Member 1 told Child Care Staff Member 2 that there were four children outside and that Child Care Staff Member 1 was going inside to speak with a parent who was picking up a child. While Child Care Staff Member 1 was in room speaking with the parent, other parents picked up their children and left. Child Care Staff Member 2 went into the room at approximately 5:25 PM while Child Care Staff Member 1 was still talking with the parent and said that all of the children were gone. Child Care Staff Member 2 asked Child Care Staff Member 1 if anything else was needed. Child Care Staff Member 1 said no and Child Care Staff Member 2 left the room. After Child Care Staff Member 2 left the room Child A’s Father walked into the Penguins classroom while Child Care Staff Member 1 was still speaking with a parent at approximately 5:30 PM. Child A’s Father didn’t see Child A in the room, so Child A’s Father asked Child Care Staff Member 1 if Child A was present. Child Care Staff Member 1 opened the door in the classroom that led directly to the outdoor play area and found Child A sitting at a picnic table. Child Care Staff Member 1 apologized to Child A’s Father. Ms. Delgado was not present at the center at the time of the incident but was immediately notified about the incident. Ms. Delgado stated that Child A’s Father was upset and was not ready to speak with her and said that he wanted to gather his thoughts. Ms. Delgado stated that she messaged him that evening apologizing and letting him know that she was available to speak when he was ready. Child A’s Father responded stating that they don’t believe that this incident was indicative of the care that Child A was receiving. Ms. Delgado called Child Care Staff Member 2 who was unaware of the incident. Child Care Staff Member 2 was surprised and apologized. Child Care Staff Member 2 did not do a “sweep” of the playground before going inside. The following Monday, September 18, 2023, Ms. Delgado met with Child A’s Mother and Father and apologized again. Ms. Delgado informed Child A’s Mother and Father that she shifted the sign in and sign out procedures to require that child care staff members sign children out instead of parents signing children out to ensure that all children are accounted for. Previously the attendance sheet was kept outside of the classroom door and parents signed children in and out. Child Care Staff Members were retrained on “sweeping” spaces before exiting an area. Ms. Delgado stated that policies regarding head counts and “sweeping” areas were discussed with child care staff members, but it is not a written procedure. Child Care Staff Member 1 stated that on Friday, September 15, 2023, there were 12 children in the Penguins classroom. At 5:15 PM there were four children left and lead caregiver Child Care Staff Member 3 already left for the day. Child Care Staff Member 1 and Child Care Staff Member 2 were outside with the four children as parents were arriving for pick up. Child Care Staff Member 1 stated that she needed to go inside, so she told Child Care Staff Member 2 that she was going inside and that there were four children.
