On 3/28/2023, I interviewed licensee, Ms. Erby-Duncan at her family child care home. I went over the allegations with Ms. Duncan. Ms. Duncan explained that Child A has had long fingernails and she asked Child A's Mother to trim them down over a week ago. Ms. Duncan indicated that Child A's Mother responded by saying "yes, they're getting long, and I will cut them down tonight." Ms. Erby-Duncan said on 3/27/23, when Child A arrived at 12:30 p.m. she saw a scratch on Child A's left cheek. Child A was picked up from care at 4:30 p.m. Later that same evening 2 around 9:00 p.m. Ms. Erby-Duncan received a text message from Child A's Mother with a picture of Child A's right cheek which had multiple scratches. Child A's Mother asked Ms. Duncan "what happened", and Ms. Erby-Duncan responded by saying "it looks like you need to cut her nails." Ms. Erby-Duncan showed me the text message between her and Child A's Mother while I was on-site. Ms. Erby-Duncan said on 03/27/2023 around 9:30PM she heard a knock on her apartment door. Ms. Erby-Duncan wasn't sure who it could be because there's a main door that's kept locked to enter the building where visitors have to ring a buzzard to get to the resident's personal door. Ms. Erby-Duncan asked who was at the door and Child A's Mother and Grandmother identified themselves. Ms. Erby- Duncan opened the door and asked "why are you here"? Ms. Erby-Duncan explained how Child A's Mother and Grandmother walked into the house saying, "I know you didn't hurt my baby", while pacing the living room. Ms. Erby-Duncan said Child A's Mother hit her and Child A's Grandmother held her down while both women began hitting her. Ms. Erby-Duncan said she continuously asked Child A's Mother and Grandmother to leave her home, but both refused. Ms. Erby-Duncan said she saw Child A's Mother reaching into a bag and that it was gun Child A's Mother began pulling out. Ms. Erby-Duncan called 911 and Child A's Mother and Grandmother left her home. Ms. Erby-Duncan described both women being very exhausted from assaulting her and destroying her belongings in the apartment. Ms. Erby-Duncan showed me two nails that were broken from the altercation. Ms. Erby- Duncan also showed me her nails that weren't broken and how they weren't sharp around the edges. The nails were not sharp at all to the touch. Ms. Erby-Duncan was home alone at the time of the altercation, and she does not have any child care staff members. This incident occurred after child care hours and no child care children were present. On 3/28/2023, I spoke to Child's A Mother via phone. She stated that she was aware that Child A's nails needed to be cut which she did the same day Ms. Erby-Duncan spoke to her about Child A's fingernails. Child A's Mother proceeded to say that she noticed Child A's cheeks with the scratches on the evening on 03/27/2023 when she picked Child A up from her grandfather's house. Child A's Mother texted Ms. Erby- Duncan along with a picture regarding the scratches and was not pleased with the response from Ms. Erby-Duncan stating, "it looks like you need to cut her nails". Child A's Mother forwarded me a copy of the text message that was exchanged between her and Ms. Erby-Duncan There were no other text messages after Ms. Erby-Duncan's response. The text message I received was exactly as Child A's Mother described. Child A's Mother said she and Child A' Grandmother went to Ms. Erby-Duncan's home and arrived unannounced. Child A's Mother said when she and Child A's Grandmother arrived at Ms. Erby- Duncan's home they saw someone coming out of the main building door, so they walked up to Ms. Erby-Duncan's apartment. Child A's Mother said she knocked on the door and Ms. Erby-Duncan responded, "who's at the door"? Child A's Mother responded by saying her last name. Ms.Erby-Duncan asked "why are you here"? 3 Child A's Mother responded, "how can Child A have scratches and her nails were cut the night before?" Child A's Mother asked Ms.Erby-Duncan f
Child A (female, age 5 months) had six scratches on her right cheek and one scratch on her left cheek. Child A's Mother believed the scratches were caused by licensee Regina Erby-Duncan. When Child A's Mother and Grandmother confronted Ms. Erby-Duncan about the scratches, they were involved in a physical altercation at Ms. Erby-Duncan's home.
