On 04/03/2023, I received an incident report along with a statement from CCSM 2 providing additional details on the incident. The statement from CCSM 2 was dated 3/31/2023 and explained there was a discussion with former CCSM 1 regarding her lesson plans. When she entered the infant classroom to have this discussion, former CCSM 1 argued that she did not need to complete this as she submitted her two weeks' notice and 4/7/2023 would be her last day. This discussion continued with Ms. Desano-Smith in the office to which former CCSM 1 "had a bad attitude towards Danielle." Former CCSM 1 left the office to enter the infant classroom and became "belligerent", throwing items over the baby gate in the classroom and cursing, using words such as "fuck, bitch, cunt, shit" and yelled threats to Ms. Desano-Smith. CCSM 2 was able to get former CCSM 1 to go outside, but she did try to re-enter the center and the police were called. On 04/06/2023, I made an unannounced visit to the center. I interviewed CCSM 3. She said she primarily works in the Happy Hopper classroom, but she overheard the incident that occurred last Friday, 03/31/2023. At approximately 12:15PM, CCSM 3 was in her classroom with Child A, as rest of the classroom went outside. She heard "a lot of cussing and banging" from former CCSM 1 and she observed a baby bouncer sitting in the hallway, it appeared to have been thrown there. CCSM 3 heard language such as "Fuck you." She then took Child A, who she was in the classroom with her, and they went outside. Child A didn't seem to have a reaction to what was being heard, but asked if she would be staying outside. Child A didn't mention or question the commotion outside of the classroom and didn't appear to be visibly upset. Child A did not witness any of the incident. CCSM 3 has had conversations with former CCSM 1 in the past, but they work in different classrooms. CCSM 3 has never observed or heard of this happening before. She has not seen former CCSM 1 since the incident. Ms. Desano-Smith called while I was onsite and explained she would be returning in a few hours to this location. I told her I could call her tomorrow to discuss the incident. I interviewed CCSM 2. She said on 03/31/2023, she was working in the infant room and when former CCSM 1 arrived in the classroom, she seemed to have "an I don't care type of attitude." CCSM 2 left the infant room once former CCSM 1 was working to complete other work obligations. CCSM 2 was under the impression that former CCSM 1's last day would be 4/31/23 as she had given her notice. While working in the office, she and Ms. Desano-Smith were determining exactly when former CCSM 1's last day would be. Therefore, former CCSM 1 was called into the office for a 3 meeting at roughly 9:00AM. When Desano-Smith was speaking to her, former CCSM 1 became defensive and former CCSM 1 didn't have an attitude with CCSM 2 so CCSM 2 was trying to diffuse the tension between Ms. Desano-Smith and former CCSM 1. Former CCSM 1 said she did not want to speak with Ms. Desano- Smith, so she was asked to clarify when her last day of work would be, and she replied 4/14/2023. Former CCSM 1 seemed to be calming down once we had the dates corrected and CCSM 2 thought everyone was content. When former CCSM 1 and CCSM 2 were walking back to the infant room, CCSM 2 mentioned former CCSM 1 could possibly leave early today due to the low numbers, but that they needed to work on curriculum as it wasn't completed. CCSM 2 then returned to the office to finish her tasks. Around 12:30PM, CCSM 2 went back into the infant room to work on curriculum with former CCSM 1 and she asked her for the weekly preparation box (which is the weekly items prepped for the following week for activities). CCSM 2 then realized nothing was prepped for the following week. Therefore, she looked at lesson plan for next week and only the names of the activities were listed and not the definitions or areas of core. CCSM 2 informed former CCSM 1 th
Former Child Care Staff Member (CCSM) 1 went into the infant room, threw items, and cursed at other child care staff members in front of the child care children. The police were called.

While motioning to the side of her neck Child A said she was hit by her "teacher." Child A provided a name, [child care staff member (CCSM) 4], but because Child A has a speech impediment the name was unclear. When the possible name of the "teacher," was repeated, Child A said "yes."

On 03/17/2023 — I left a voicemail requesting a return call to the complainant. Emails exchanged with Witness 1o n 3/17/2023 to arrange a day and time for a phone call. I made an unannounced visit to the center on 03/20/2023. I interviewed Danielle Desano-Smith, Program Director and Licensee Designee to the center. Child A is in the little adventures classroom and sometimes attends the happy hoppers classrooms in the morning. There are three child care staff members in the little adventures room, CCSM 1, CCSM 2 and CCSM 3. She is aware that Child A had disclosed that a [CCSM 4] hit her, however there is no child care staff member with that name or has a name that could be shortened to match that name. Child A's Guardian said that Child A made similar allegations at her previous child care, but then Child A told her she had lied about the disclosures. Ms. Desano-Smith said she has observed interactions between CCSM 1 and Child A and CCSM 1 is very consistent with Child A, uses firm words when needed and Child A often sits on her lap, happy. Child A tends to run towards all of the child care staff members in her classroom for hugs. For discipline, natural consequences are used, positive reinforcement and child care staff members give children opportunities to feel successful by giving them classroom jobs. Ms. Desano-Smith recently installed cameras into the classrooms, but they do not always work. If Ms. Desano-Smith notices a challenging situation arising, she goes into the classroom to offer support with that child's behavior. She has no concerns with the way CCSM 1 interacts with Child A, she has never seen her hit any children or be aggressive with any children. Child A is easily redirected and isn't a child who has difficult or challenging behaviors. Ms. Desano-Smith has observed CCSM 2 and Child A's interactions as well and CCSM 2 is very gentle with her. CCSM 2 uses redirection, natural consequences and positive reinforcement. She has never observed CCSM 2 to be aggressive or inappropriate with any of the children. She has never seen her hit a child and she 3 has never observed any type of corporal punishment being used. CCSM 3 also works well with Child A and Child A seems to "love her." CCSM 3 was absent from the classroom last week due to an illness and has not been working this week. The numbers in the classrooms have been low and CCSM 3 floats around all the classrooms. CCSM 3 also uses natural consequences and redirection for discipline. Ms. Desano-Smith has never observed CCSM 3 to be aggressive towards any child or using any types of corporal punishment. None of the child care staff members in Child A's classroom have received disciplinary action. No parents or child care staff members have complained to her about child care staff members being aggressive towards any children either. I interviewed CCSM 2. She said she works in the happy hopper classroom but often splits classrooms with little adventures. Therefore, she is familiar with Child A. Her primary child care staff members are CCSM 1 and CCSM 3 who help in the classroom with Child A from time to time. She said there is no one who comes inside the classroom named [CCSM 4] or something similar. For discipline, if there is an escalating situation between two children, CCSM 2 helps the children walk away and reminds them to use gentle hands. If there is a child making bad choices, she tells them they are making "red light" choices and helps them figure out how to make better choices by talking it out with the child. She has never used physical discipline as a form of punishment. She has never observed any child care staff member hitting Child A or any other child. She has never hit Child A. No child care staff member or parent has complained that child care staff members were hitting children or using any forms of physical discipline with children.
