    R 400.8125 · R 400.8125 Staff; volunteer; requirements. (1) All staff and volunteers shall provide appropriate care and supervision of children at all times.

    On July 26 2021 I along with made an unannounced onsite inspection to the child care center. During the onsite inspection we met with the program director Shannon Peitz. Ms. Peitz was informed of the allegations in the complaint. Ms. Peitz was aware of the incident and that a written incident report was 2 completed. Ms. Peitz did not see the incident, however based on what was reported to her the incident did not occur in the classroom but occurred outside in the play area. Child Care Staff Member Erica Schrodt was outside feeding a baby. When she was done feeding the baby, she took the child out of the chair and placed the tray on the chair. "[Child A] was outside and walking around, she leaned against the chair and the tray popped up and hit her." According to the incident report Child A cried a little bit and the child care staff members gave her big hugs and she was fine. During the onsite inspection Childcare Staff Member and I interviewed Child Care Staff Member Elena Boudreau. Ms. Boudreau stated that the incident occurred outside and not in the classroom. Ms. Boudreau works in the Railroad Infant/toddler classroom. Child A is in her classroom. They were outside along with the Pond Side classroom. Child care staff member Erica Schrodt from the Pond side classroom was feeding a child in a chair that has a tray attached to it. The chair is wooden, the legs of the chair are approximately twelve inches long and has a tray that can attach to the chair. When Ms. Schrodt took the child from the seat, she placed the tray on the chair. Child A was walking around exploring and leaned against the chair, when she leaned against the chair, she fell forward and the tray hit her on the forehead. Ms. Boudreau picked her up and gave her a hug and took her inside to apply ice. Child A calmed down and stopped crying shortly after being comforted. There was some redness around her forehead, but other than that Child A appeared fine, and no injuries were noted. During the onsite inspection an observation of the outside area was completed. The outside area is a courtyard surrounded by classrooms. There are sidewalks that lead from the classroom to the center of the play area. Ms. Boudreau described Child A walking from left side of the play area where she leaned against the chair. During the onsite inspection children were observed in the play area walking and playing. The child care staff members were observed walking throughout the play area interacting with the children. A chair similar to the one Child A leaned against was viewed. The chair is low to the ground and easy for a toddler to lean on the tray or the chair. During the onsite inspection and I called child care staff member Erica Schrodt. Ms. Schrodt stated she works in the Waters Edge classroom, which is in the Pond Wing of the center. Ms. Schrodt stated that she does not generally have contact with Child A, the only time she has contact with her is on the playground. Ms. Schrodt stated that Child A was walking in the play area and propped herself on tray table chair when she was walking. The tray hit her as she lost her balance. The child care staff members from her classroom came over and comforted her and took her to get an icepack. During the onsite the incident report was reviewed. The information in the incident report was consistent with the information provided during the interviews. There were no injuries that would be consistent with Child A falling from a high chair. 3 On August 20, 2021, a*ttele one case conference was held with Darlese McConnel-LARA Area anager, a i a ec ase Manager Supervisor, and Jacquelyn Oliver-Case Ms, uisver aia not nave any concerns regaraing the care was receiving at the child care center.
