On April 28, 2023, the Complainant reported that on February 14, 2023, the Complainant arrived at the center at 5:27 PM. While the Complainant was in the parking lot, the Complainant saw Child A walking in the parking lot of the center crying. The Complainant stated that Child A appeared to be between 2 and '/2 3 years old. Child A stood at the Complainant's car, while the Complainant proceeded call 911. The Complainant did not complete the call but rather decided it would be better to go to the center to make the call. The Complainant assumed that Child A was a resident of the apartment complex where the center is located. The Complainant knocked on the door of the center and when the child care staff member opened the door, the child care staff member grabbed Child A by the arm and asked Child A how he got outside. The child care staff member then yelled something to another child care staff member then closed the door with Child A inside. The Complainant stood outside the door in shock. The Complainant does not know the name of the child care staff member who opened the door and was not 2 sure what was said to the other child care staff member. The Complainant reported the incident to a parent the Complainant knows has a child who attends the center. The following day the Complainant asked program director Rajnish Kapila about Child A being left outside but Mr. Kapila denied that the child was enrolled at the center, stating that the child was a resident of the apartment complex. Mr. Kapila said that Child A's parents left Child A outside with the child care children while they were next door to the center in the apartment's leasing office. Mr. Kapila stated that he was not aware that Child A was left outside until after the complainant found him. Mr. Kapila stated that he spoke with Child A's parents about leaving Child A outside of the center without his knowledge. The Complainant asked Mr. Kapila for the contact information for Child A to make sure that he was ok. Mr. Kapila told the Complainant he already took care of the situation. The Complainant asked Mr. Kapila if he needed to call "the state" and Mr. Kapila responded that the Complainant was the problem calling on good places like his. The Complainant just wanted to make sure that the children at the center were safe because the Complainant believed that Child A was enrolled at the center. When at the center at a later time, The Complainant saw Child A outside with the child care children. The Complainant stated that wanted to file a complaint at that time but choose to wait due to personal reasons. The Complainant never found out Child A's name, but Mr. Kapila told the Complainant that Child A was no longer a resident of the apartment complex and that he and his parents had returned to Japan. During the onsite inspection on May 1, 2023, program director Rajnish Kapila stated that on February 14, 2023, Child Care Staff Member 1 was outside with the preschool children. After she returned to the center with the children a person who "babysits" for a child enrolled at the center came to the door and stated that she found Child A outside. Child Care Staff Member 2 answered the door when the "babysitter" brought Child A to the door. Mr. Kapila stated that Child A is not enrolled at the center but his parents were next door to the center at the rental office. Child A's Parents saw the child care children outside playing so they left Child A outside while they were in the rental office without notifying Child Care Staff Member 1. Mr. Kapila stated that Child A used to be enrolled at the center, so that is probably why his parents felt comfortable leaving Child A outside with Child Care Staff Member 1. Mr. Kapila stated that he did not have contact information for Child A parents because they returned to Japan. Mr. Kapila stated that Child Care Staff Member 1 was not at the center at the time of the onsite inspection. During the onsite inspection on May 1, 2023, Child Care

There was one child care staff member and 15 children, so the classroom was over ratio by five children.

The complainant stated that on January 3, 2023, they walked into the toddler room just before 9:00 AM and observed six children watching television with no child care staff member present. Program director Rajnish Kapila rushed into the room and stated that the toddler child care staff member's husband had a medical emergency so she had to leave and another child care staff member would be coming into the room. The complainant believes that a child care staff member came into the room before the child care staff member left the center. During the onsite inspection on February 14, 2023, program director Rajnish Kapila denied that children were left unsupervised in the toddler room at any time. Mr. Kapila stated that there is no television in the toddler room. The only television at the center is kept in the primary 2 classroom and used for presentations only. Child Care Staff Member 1 stated that she starts work at 8:30 AM and Child Care Staff Member 2 starts at 8:45 AM in the toddler room. Child Care Staff Member 1 2 stated that the first child arrives at 8:30 AM and the last child arrives by 9:00 AM. Child Care Staff Member 1 stated that she was never absent from work during the month of January so she doesn't know why someone would say that children in the toddler room were left unsupervised. She stated that there is no television in the toddler room so she knows that the allegation is untrue. Child Care Staff Member 2 states that she worked at the center on January 3, 2023, in the toddler room. She stated that she arrives to work between 8:40 AM and 9:00 AM. Child Care Staff Member 2 stated that when she arrives at the center there are usually three or four children present in the toddler room. Child Care Staff Member 1 is already present in the toddler room when Child Care Staff Member 2 arrives. Child Care Staff Member 2 stated that there are nine children enrolled in the toddler classroom but they do not all attend every day. Child Care Staff Member 2 stated that there is no television in the toddler classroom and children are never left alone in the classroom.

The complainant reported that Child A was left soaked in urine after having accident at the center. Child A's Mother stated that Child A (female, age 2 years) was enrolled at the center from January 3, 2023, until her last day on January 9, 2023. Child A was recently potty trained and at home she went an entire week with no accidents. On January 5, 2023, when Child A was picked up from the center she was soaked in urine. When Child A's Mother took Child A into the bathroom at the center to change her clothes, she observed that a potty seat in the bathroom was filled with urine. Child A's Mother stated that on January 9, 2023, Child A was again soaked in urine when she was picked up from the center. Child A's Mother asked Child A why she didn't use the potty and Child A stated that it was covered in "poop". When Child A's Mother took Child A to the bathroom at the center to change her clothes, she observed a potty seat in the bathroom which was covered in feces. Child A's Mother contacted 3 program director Rajnish Kapila by phone on January 9, 2023, and informed him that she was disenrolling Child A from the center because she was repeatedly being left soaked in urine after having an accident. Mr. Kapila apologized and asked if she would change her mind. Child A's Mother stated that she would not change her mind. Program director Rajnish Kapila stated that Child A was enrolled in primary 2 classroom. Mr. Kapila stated that children in primary 2 are supposed to be fully potty-trained. He stated that Child A's Mother was dishonest when she stated that Child A was fully potty-trained. Mr. Kapila stated children in the primary 2 classroom are supposed to the toilets in the bathroom and not the potty chair which was provided for one child by his parents. He is not sure if the potty seat was filled with urine but the child care staff members that work in primary 1 where the bathroom is located empty the potty seat after the child uses it. Mr. Kapila denied that Child A was left soaked in urine after having an accident. He stated that as soon as Child A's Mother arrived to pick up Child A, she had an accident on January 5, 2023, and on January 9, 2023. Mr. Kapila stated that if children have an accident child care staff members change their clothes. The potty seat that was observed with feces on it belonged to one child at the center and was not to be used by any other children. Mr. Kapila stated that when Child A's Mother told him that there was feces on the potty seat, he told her that the cleaning person would clean it. Child Care Staff Member 1 works in the primary 2 classroom starting at 3:30 PM. Child Care Staff Member 1 stated that only one child in the primary 1 classroom uses a potty seat. None of the children in primary 2 use a potty seat. Child Care Staff Member 1 stated that she does not recall if Child A ever had an accident when she was caring for her but she always changes children right away if they have an accident. The children in primary 2 are very independent and she only takes children to the bathroom if they say that they need to go. Child Care Staff Member 3 works in the primary 1 classroom where the bathroom for children is located. Child Care Staff Member 3 stated that the potty seat in the bathroom belongs to another child in primary 1. The child now uses the toilet instead of the potty seat. When the potty seat was being used it was cleaned after he used it. Child Care Staff Member 3 stated that she did not know that there was feces on the potty seat. Child Care Staff Member 4 works as a floater at the center. She stated that she did not provide care for the Child A and she is not aware of the potty seat not being cleaned. The child who uses the potty seat uses it while she is working in primary 1, she cleans it after they use it. Child Care Staff Member 5 works in the primary 2 classroom. Child Care Staff Member 5 stated that she cared for Child A for less than a week. Child Care Staff Member 5 stated that

Child A's Mother stated that on January 3, 2023, Child A was dropped of just before 9:00 AM and there were 20 children present with 1 child care staff member in the big classroom including Child A. Child A's Mother stated that she counted the children because it seemed to be a lot of children. Program director Rajnish Kapila stated that the large classroom is the primary 2 with children ranging from 4 years to 6 years of age. He denies that the primary 2 classroom was out of ratio with one child care staff member caring for 20 children on January 3, 2023. Mr. Kapila stated that Child A who is 2 years of age was allowed 1/2 in the primary 2 classroom because Child A's Mother pushed for her to be there. He stated that he knows that Child A should have been in Primary 1 due to her age. Mr. Kapila stated that the primary 2 classroom is out of ratio today, 02/14/2023, because a child care staff member called off work due to an emergency. Child Care Staff Member 5 works in primary 2 from 8:30 AM until 3:30 PM. Child Care Staff Member 5 stated that she works in primary 2 with Child Care Staff Member 6 who starts work at 8:00 AM. Child Care Staff Member 7 also helps in primary 2 if needed. Child Care Staff Member 5 stated that there are 32 children enrolled in the primary 2 classroom, but they don't all attend every day. Child Care Staff Member 5 stated that she doesn't believe that the primary 2 classroom was out of ratio on January 2, 2023. She thinks that both she and Child Care Staff Member 6 were in the primary 2 classroom on January 3, 2023, by 8:30 AM. Child Care Staff Member 5 stated that the primary 2 class is out of ratio today, 02/14/2023, during the onsite inspection because one of the child care staff members was off work. Child Care Staff Member 6 works in the primary 2 classroom from 8:00 AM until 3:30 PM. Child Care Staff Member 6 works in primary 2 with Child Care Staff Member 5 who arrives between 8:15 AM and 8:30 AM. Child Care Staff Member 6 denied that there were 20 children with one child care staff member just before 9:00 AM on January 3, 2023. She stated that typically there are only between five and six children present by 8:30 AM. During the onsite inspection on February 14, 2023, there were two child care staff members in the primary 2 classroom with 27 children. The required child care staff member to child ratio in primary 2 is 1 to 12, with children ranging in age from 4 years to 6 years so the classroom was over ratio by three children. Mr. Kapila stated that there were more children present than normal for Valentine's Day. The primary 1 classroom was out of ratio on February 14, 2023, with one child care staff member with 16 children. The required child care staff member to child ratio in primary 1 is 1 to 10 with children ranging in age from 3 years to 4 years so the classroom was over ratio by six children. Mr. Kapila stated that the second child care staff member in primary 1 went home briefly but would be back. The toddler room was also out of ratio on February 14, 2023, with two child care staff members and 9 children. The required child care staff member to child ratio in the toddler room is 1 to 4 with children ranging in age from 16 months to 30 months, so the toddler classroom was over ratio by one child. Mr. Kapila stated that the toddler room was out of ratio because one of the child care staff members called off work due to an emergency. Mr. Kapila provided attendance records for both children and child care staff members for January 3, 2023. Upon reviewing the attendance records I determined that there were two child care staff members present in the primary 2 classroom by 8:30 AM. Child A was signed in at 9:40 AM on January 3, 2023. At that time there were a total of 20 children present not including Child A. Once Child A arrived the ratio of the class became 1 to 8 instead of 1 to 12 because Child A is 2 years of '/2 age and the ratio of a class with mixed age ranges is determined by the

On September 27, 2022, I spoke to the Complainant. Am"ptember 22, 2022, while taking Child A male age 4) to t observed a child and a child care staff member telling him to While assisting Child A in the _ complainant heard Complainant stated not witnessing the child but "assumed" the was the child care staff member child. Complainant also reported not knowing the name of the child. When asked if complainant reported this to the program director or any other child care staff member. Complainant stated, "I didn't say anything. I wasn't comfortable saying anything." On September 27 2022 I com leted an unannounced on-site inspection at the child care center with and I individually interviewed program child care staff members. Mr. Kapila denied observing a child while on September 22 2022. Mr. Kapila stated that is never utilized and reported to consist of verbal redirection and talking to the children. The discipline policy was reviewed and stated that the child care 4 center's discipline encourages positive social and emotional development of children by talking to them and providing positive reinforcement and verbal redirection. I observed Mr. Kapila's office to be located in close proximity to the hallway and which allows him to hear activity in the hallway. denied observing a child ~ They all stated triey nave never observed child care stall members 3 form of with any children at the child care center They all reported discipline to consist of talking to the children and verbal redirection. On September 30, 2022, I spoke to Child A's Mother, Child B's Mother and Child C's Mother. They all stated that they have not observed any child care staff members to They also stated that their xpressed concern about child care staff members utilizing and they are pleased with the care provided by the child care center. On October 21, 2022, I participated in a telephone case conference with Darlese McConnell, Child Care Licensing Manager and is closing her investigation. There is insufficient evidence that any child care staff member is not conducive to the welfare of children.
