On February 21, 2022, I attempted a telephone call to complainant for additional information, as limited information was provided on the complaint filed regarding the child's full name and age. The complainant also stated that complainant was informed of this information by a child care staff member that was employed at the child care home two years ago. I was unable to leave a message as the recording stated that voicemail was not set up. On February 22, 2022, I completed an unannounced on-site inspection at the child care home of Marcia Tyson. I individually met with licensee, Marica Tyson and child care staff member, Lisa Getty. I informed Ms. Tyson of the allegations. Ms. Tyson was able to provide the last name, age, address, mother's name and telephone number of Child A. Child A is 7 years old and was enrolled at the child care home from February 2, 2019, until August 29, 2019. During the time of enrollment Child A was 4 years old. Ms. Tyson denied lifting Child A by his arm and throwing him into a highchair. Ms. Tyson also stated that she did not utilize a highchair for Child A during his enrollment due to his age. She stated that Child A did have temper tantrums and discipline consisted of verbal redirection. Ms. Tyson also stated that she and child care staff members also sat with Child A and talked to him discussing appropriate alternative behaviors. On February 22, 2022, I met with child care staff member, Lisa Getty. Ms. Getty has been employed at the child care home for three years. She stated that she never observed Ms. Tyson lift Child A by the arm and throw him into a highchair or scream at him. She stated that discipline of Child A consisted of verbal redirection and sitting with him and talking to him about appropriate behaviors. This is the discipline technique that is utilized at the child care home. I also reviewed the discipline policy. The policy stated that the overall discipline is aimed at helping children learn to develop techniques of self-control. Positive discipline techniques would be utilized such as verbal redirection and talking to a child to help them problem solve. The unacceptable behavior will be explained to the child and acceptable choices will be discussed. The policy also stated that physical or any other type of demeaning discipline would not be employed or condoned. Ms. Tyson provided the names and telephone numbers of current and previous child care staff members, as well as a supervised volunteer for the past three years. On February 22, 2022, I attempted another telephone call to complainant. I left message requesting a return telephone call. On February 23, 2022, I spoke to Child A's Mother. She stated that Child A had "great experiences", while attending Ms. Tyson's child care home. She denied Child A ever telling her he was lifted by his arm and thrown in a highchair or screamed at by Ms. Tyson. She also stated that Child A was 4 years old when he attended the child care home and stated that he has good verbal skills. She also stated that he always verbalized good things about Ms. Tyson. Child A's Mother stated that she 4 always observed Ms. Tyson to be patient and nurturing with Child A and provided appropriate care. I asked Child A's Mother for permission to interview him. She gave me permission but stated that I would need to call back on February 25, 2022, as he was not with her this evening. On February 25, 2022, I conducted a telephone interview with Child A. I introduced myself and established the forensic protocol. Child A was able to understand the difference between the truth and a lie. He also had good verbal skills and was able to tell me things about himself. I was able to conduct a forensic interview with him. When asked if he remembered attending Ms. Tyson's child care home he stated, "yes." When asked to tell me more about Ms. Tyson's home he stated, "it was fun at Ms. Marcie's." There is insufficient evidence that Ms. Tyson screamed at Child A and lifted him by his arm and threw him in a high chair. Ms. Tyson and child care staff members all reported discipline techniques to be verbal direction and talking to children, which are appropriate positive methods that encourage self-control and self-direction self-esteem, and cooperation.

On April 27, 2021, an intake was received stating that the child care home was not clean. I completed an unannounced on-site inspection on April 28, 2021, and interviewed licensee, Marcia Tyson. Ms. Tyson stated that the home is always kept clean. I observed the entire house including the outside to be in a clean and sanitary manner. On May 20, 2021, I spoke to child care staff, Lisa Getty. Ms. Getty stated that she has always observed the child care home to be clean. On May 20, 2021, I spoke to Child A&B's Mother. She stated that her two children have attended the child care home since they were infants and she has always observed the home to be clean. She also stated that she would not have allowed her children to attend the child care home if it was not clean. On May 20, 2021, I spoke to Child C's Mother. She stated that her child has attended the child care home since last year. She has always observed the home to be clean. On May 20, 2021, I attempted a telephone call to Child D's Mother. I left a message asking her to return my telephone call. I have not received a return call to date.
