    R 400.8125 · R 400.8125 Staff; volunteer; requirements. (1) All staff and volunteers shall provide appropriate care and supervision of children at all times.

    Program director Elizabeth Meza stated that on October 5, 2021, at 12:30 PM Child A (female, age 2 years) was outside on the playground with child care staff members Emma Vega and Julia Gwizdz and 12 or 13 other children. At 1:30 PM some of the children in Child A's class go home for the day. Ms. Meza stated that Ms. Gwizdz came back into the center prior to 1:30 PM with the children that remained in care for the full day. Ms. Vega was left with two children who were still waiting for their parents to arrive. Ms. Meza stated that Ms. Vega normally waits by the gate that leads to the playground and to the building with children waiting to be picked up once it's close to 1:30 PM. As parents arrive, they step inside the door where the children's backpacks are hung on the hall and sign their child out on the attendance sheet. Ms. Vega normally waits outside with the remaining children while the parent is inside. Ms. Meza stated that on October 5, 2021, Ms. Vega was waiting by the gate with Child A and Child B (male, age 4 years) when Child A walked away to play in the sandbox. Child B's Grandfather arrived a few minutes later to pick up Child B and needed assistance because he does not normally pick up Child B. Ms. Vega forgot that Child A walked over to the sandbox and went inside the building to help Child B's Grandfather find Child B's backpack. After helping Child B's Grandfather Ms. Vega went to the breakroom. Child A's Father arrived one to two 2 minutes later and noticed Child A outside alone. He brought Child A inside and let child care staff member Melissa Cunningham know that Child A was left outside alone. Ms. Mezza stated that Child B's Grandfather did not sign Child B out of the center so she's not exactly sure what time he arrived. There are no cameras at the center, so she estimated that Child A was left outside for approximately one to two minutes based on Ms. Vega's statement that she had only been in the breakroom for one to two minutes. Child A's Father signed Child A out at 1:30 PM and many of the other parents who picked up their children prior to Child A's Father also signed out at 1:30 PM so there is no way to accurately estimate a time frame for how long Child A was left unattended. Ms. Mezza stated that there is a dry erase board that is kept outside with the number of children present. That number is supposed to be changed as children are picked up but on October 5, 2021, the board was erased when Ms. Gwizdz returned inside with the group of children that were remaining in care for the full day. Ms. Mezza stated that along with the attendance sheet that is on a table inside the door there is a small clock so that parents know the exact time that they are picking up their children. The gate that parents enter to pick up their children is latched but not locked. Due to its height children are not able to reach the latch to open the gate. Child care staff member Emma Vega stated that she and Ms. Gwizdz take the preschool class outside at 12:30 PM each day. The half day children are picked up by 1:30 PM and the full day children return to class a little before 1:30 PM. Ms. Vega stated that parents begin to arrive to pick up children as early 12:45 PM. On October 5, 2021, at the time that Ms. Gwizdz returned to the class with the full day students there were four children remaining outside that were waiting to be picked up. After two of the four remaining children were picked up Ms. Vega put the dry erase list in the drawer because there were only two children left and she thought that she could keep track of them. After putting the list away Ms. Vega walked over to the gate with Child A and Child B to wait for them to be picked up. Child B's Grandfather arrived to pick up Child B and Child A walked away from the gate and returned to the play area. Ms. Vega stated that she went inside to assist Child B's Grandfather with getting Child B's backpack and forgot that Child A had not been picked up because she was

(11) A center shall maintain an accurate record of daily attendance at the center that includes each child's first and last name and each child's arrival and departure time. Electronic records may be used. If electronic attendance records are used, then they must be available to the department at the time of an inspection. If the electronic attendance records are not available during an on-site inspection, then the center is in violation of this rule.
