There is no evidence that the center staff failed to provide appropriate care and supervision. The teachers and program staff use "zoning" to ensure the safety of all children including Child A. There is no evidence that Child A's arm was grabbed by a teacher or program staff. There is no evidence that Child A ran into the parking lot due to Teachers and or program staff not providing appropriate supervision.

There is no evidence that the program staff force Child A to lay on the cot quiet. On 01/27/2026 and 01/28/2026, I observed in the classroom. I observed Child A being offered multiple quiet activities during rest time.

On 12/21/2021, I completed an on-site inspection at the Sunset Early Childhood Program. I observed the classroom and children to be engaging in programming. I requested to interview the staff members who were present during the time of the reported incident. I interviewed Ms. Stacie Papineau, child care staff member. Ms. Stacie reported that she had another assistant in the classroom who is not usually in the classroom. They were also missing an aide the day of the incident who assists another child that requires more assistance. It was an off day due to heater issues and both child care staff members had migraines. Ms. Stacie explained that they were having the children get their jackets on and line up by the door that leads directly outside. Child A would not zip up her jacket and wanted assistance. Child A must have slipped out of line and was left in the classroom. The children were holding a rope with colored shapes. They had 11 children in the classroom that day. 2 Ms. Stacie reported that Ms. Courtney did the first count and had 11 children counted in the classroom. They went outside around the school to the ballpark with the children holding the rope with colored shapes. When the children got to the ballpark, they dropped the rope and scattered. They quickly did a count of the children and counted 10 children. She ran back to the classroom and Child A was sitting in the window. Child A stated, "you left me." Child A was crying but quickly calmed. Ms. Stacie reported that Child A was only left in the classroom for five minutes. They were outside from 11:30 am-11 :35 am before completing count and running back to get Child A. They have developed a safety plan and they have red tape outside the classroom to complete a secondary count of the children after they leave the classroom. She was never informed of Child A having a safety plan last school year due to running off from staff. I completed an interview with Ms. Courtney Spigelmyre, child care staff member. She was a sub in the classroom for the day. They were getting the children ready to take them outside. She did first count and counted 11 children inside the classroom. When they arrived at the ballpark the children were pushing and shoving to get inside the ballpark. They did their count and only came up with 10 children. They checked the dugout and Ms. Stacie ran back to the classroom where she found Child A. Child A was only left in the classroom for five minutes before Ms. Stacey arrived back to get her. I interviewed Danielle Bradbury, site supervisor. Child A has a history of running from staff and going outside. Child A would hide from the child care staff last year. She did not witness the incident. She was informed that Child A was left in the classroom for five minutes. Active supervision is drilled into all staff and they have training on active supervision. On 12/21/2021, I made a phone call to Ms. Brenda Bradbury, licensee designee. Ms. Bradbury reported that she was informed about Child A being left in the classroom. Ms. Bradbury did not report any concerns regarding the child care staff members. Child A's parent was notified. I spoke with Ms. Brenda about the child care staff explaining that they were never informed about Child A having a safety plan the year prior. Ms. Brenda reported that she would follow up with the program. Ms. Brenda was also informed about the staff reporting concerns with the heater system. Ms. Brenda reported that she would follow-up. On 12/27/2021, I made a phone call to Child A's mother. She was informed that Child A was left inside the classroom. She did not have any concerns. 3 On 02/08/2022, I made a phone call to Ms. Brenda Bradbury and completed an exit interview.
