The play room was being used for storage and was not able to be used for child care use space as it was full. Without that room there was not sufficient space for the capacity of 11 children.

On 12/17/2020 I completed an onsite inspection with Officer Billy Gohl from Alpena City Police department. Ms. Girard was present but there were no children in care. She closed due to some parents testing positive for Covid-19. Ms. Girard thought she knew why we were there and asked if it was regarding Child A and Child B. We confirmed it was and asked her to tell us what happened. Ms. Girard reported that Child A (6 years old) reported that Child B (5 years old) grabbed her private parts. Child B said it was an accident. Child B was having behavior issues as well so Ms. Girard called Child B's Mother and advised her that he needed to be picked up. Later that day Ms. Girard received a call from Child A's Mother who reported Child A described what happened and it "was an accident". Ms. Girard disenrolled Child B due to the behavioral issues and the inappropriate touch 2 incident. When asked Ms. Girard reported the behavior issues where Child B was saying he was going to kill kids, put them in a bone yard and set it on fire. Ms. Girard reported she was outside with six children and child care staff member Ms. Jordan Girard was in the house with two infants. Ms. Girard reported that the inappropriate touch incident allegedly occurred on 12/10/2020. I reviewed attendance records. Child A was not listed on the attendance record for any day that week except 12/09/2020. On 12/29/2020 I interviewed Child B's Mother. She did not really know exactly what happened. On 12/12/2020 Ms. Girard called and told her Child A's Mother said Child B touched Child A's body parts outside on 12/10/2020. She asked for more clarification so she could address it with Child B but Ms. Girard refused to tell her exactly what happened. Child B's Mother asked Child B what happened outside to Child A. Child B put his head down and said he "karate chopped" her and he demonstrated a chopping motion towards his "private parts". Child B told her the boys were "karate chopping" the girls. She did not ask exactly what other boys and girls. She asked Child B why they were doing that and he told her the girls would not leave them alone so they were "karate chopping" them. Child C is an older girl and she has been "excessively mean" to Child B. Child B's Mother had a "huge conversation" with Child B and he apologized. The following Monday he was "kicked out of child care" without any warning. The incident happened 12/10/2020, he was sent home on 12/11/2020 because Ms. Girard said he was saying inappropriate things and needed to be picked up. Child B's Mother asked for more information and Ms. Girard said there have been behavior issues for months. Child B's Mother stated Ms. Girard was being "very unprofessional" about it. Ms. Girard showed her a message from Child A's Mother with an "ultimatum". So, Ms. Girard "kicked Child B out". Child B's Mother reported her last conversation with Ms. Girard was "confrontational"; Ms. Girard told her the police and I were at her house because she was "turned in". That was the first time Ms. Girard told her Child B said he was going to "burn Child C in the yard". On 12/11/2020 when Child B was sent home Ms. Girard told Child B's Mother it was a "shit show there" that day. Child B was very upset after that and said he never wanted to go back there again. He used to love going to child care. On 12/29/2020 I interviewed Child A's Mother. Ms. Girard called her on 12/11/2020 during her lunch break to inform her of an incident where "Child B touched Child A" at child care. Child C reported to Ms. Girard that "Child B grabbed Child A's private parts". Child A's Mother stated she spoke to Child A later that night and Child A demonstrated how Child B touched her with a "cupped hand on her private parts". Child A reported it happened outside in the "castle". Child A and Child C reported what happened to Ms. Girard. Child D was there and witnessed it as well. On 12/11/2020 Child C reported to Ms. Girard that Child B said he was going to "burn
