There is no beds or clothes for herself or her children in the old home that is currently licensed for child care. Her new license was delayed by a radon test issue, but she is hopeful the license will be issued this week, and she plans to cease care at her old home by 3/7/2025

On 11/15/2022, I spoke with Child Care Licensing Bureau's (CCLB's) child care licensing consultant, Michael Skonieczny. He had no concerns but indicated there was a previous special investigation for physical discipline in February of 2021. Ms. Babcock was given verbal permission from a parent. "I think she learned from that incident and has not used spanking from that point on." On 11/22/2022, I conducted an unannounced visit to licensee's, Stacey Babcock's family child care group home. Ms Babcock was not home. Child care staff member, Tammy Ward, was caring for the children. Ms. Ward reported, "Well, that's news to me." Ms. Ward has never witnessed Ms. Babcock "spank" any of the children in care and has a good working relationship with the parents of the children attending her child care home. Ms. Ward worked the week of November 7 and November 14,, 2022. On 11/22/2022, Ms. Babcock was interviewed regarding the nature of the allegations. She was frustrated with Minor Household Member (MHM) 3. "MHM3 called in a complaint on me last year after getting caught being inappropriate on her cell phone. I'm pretty sure she called in this complaint." MHM 3 is currently not home due to sports practice at school. On 11/22/2022, interviews were conducted with MHM 1 and MHM 2. MHM 1 stated children in child care do not get spanked. "One time my mom spanked someone with permission but not anymore." MHM 2 has never seen mom spanking children in care. "My mom would never do that." On 11/22/2022, I interviewed child care staff member, Kirsten Wagner. Ms. Wagner has never witnessed Ms. Babcock "spank" any of children in care. She reported she is a new employee and has been working at the child care group home for a couple weeks. I requested child information records, child attendance, and child care staff members' records detailing arrival and departure times to determine who was working at the child care group home. Ms. Babcock provided both for the week of November 7 through November 14, 2022. On 12/16/2022, I reviewed records provided by Ms. Babcock. Ms. Ward worked everyday the week of November 7 through November 14, 2022. Ms. Wagner worked Monday, Wednesday and Friday the week of November 7, 2022 and Tuesday, Wednesday, and Friday the week of November 14,2022. On 01/07/2023, I contacted Ms. Babcock to coordinate a private interview with MHM 3 via telephone. MHM 3 was not home and will call when she arrives home. On 01/08/2023, an attempted phone call was made to Child A's and B's mother. A voicemail message was left requesting a return call. 4 On 01/08/2023, I spoke with Child C's, D's, E's, and F's mother. She has no concerns with the child care group home and her children love Ms. Babcock. "Stacey is great at what she does. My kids want to be there even when I don't need them to attend." On 01/08/2023, I received a phone call from MHM 3 who reported her mom does not spank any of the children in care. "I don't know why anyone would say that." On 01/09/2023, a text message was sent to Child A's and B's mother, requesting a return phone call. I received a response verifying contact information which was provided. On 01/10/2023, I received a return phone call from Child A's and B's mother. She has no concerns, and her children look forward to going to the child care group home. "My kids love it there and I know my kids are safe while they are in Stacey's care, and she's got all great staff." On 01/10/2023, I conducted an exit conference with Ms. Babcock.

On 10/04/2021, I spoke with Mr. Skonieczny, Child Care Licensing Consultant. Ms. Babcock, licensee, is good about contacting him with issues or clarification. She did contact him within the past two weeks regarding Child A and Child B's mother who did not want Child A and Child B's father to pick up the children as he does not have any parental rights. He responded to Ms. Babcock by informing her unless there was a court order, then she needed to allow him to pick up Child A and Child B. On 10/04/2021, I spoke with the complainant who states Ms. Babcock told her several months ago that she smokes "weed" but does not know if she smokes during child care hours. She has not smelled it on her or seen anyone smoke marijuana. Ms. Babcock's husband does smoke cigarettes in the garage; however she does not think it's during child care hours. She has not seen Ms. Alexis Berry, child care staff member, at the home in a while. Child A and Child B's father has never had a driver's license and he is an active drug user. She said parenting time is as agreed upon by the parents; however, Child A and Child B's mother is going to ask for supervised visitation. Child A and Child B's parents were residing together because Child A and Child B's mother was in a terrible car accident. Child A and Child B's father just moved out of the home. He denies ever smelling cigarettes or marijuana on Ms. Babcock or seeing her smoke. He has no concerns or issues. On 10/13/2021, I spoke with Child A and Child B's mother. The children do not attend Ms. Babcock's child care home as of October 6, 2021. This is when she obtained a court order for Child A and Child B's father to have supervised visitation. Her concerns were that Child A and Child B's father did not have a license but was picking the children up and he is a current drug user and is abusive towards her. He did reside with her up to a month ago. With her knowledge, Child A and Child B's father did drop them off at Ms. Babcock's child care home from October 2020 to January 2021. Anything after that, she was not aware when he picked them up until after the fact. She has not seen Ms. Babcock smoke cigarettes or marijuana. She has no other concerns or issues. On 10/13/2021, I spoke with Child C (male,4 years); Child D (female, 9 years) and Child E's (male, 2 years) mother. She did not have any concerns or issues. She has not seen Ms. Babcock smoke marijuana or cigarettes. On 10/13/2021, I left a voice mail for Child F's (female, 3 years) father. On 10/14/2021, I spoke with Child F's father, who had no concerns or issues. On 10/13/2021, I spoke with Child G's (female, 3 years) mother and Child H's (male, 2 years) mother. Neither parent had any concerns or issues or smelled marijuana or cigarettes on Ms. Babcock. On 10/14/2021, I sent Ms. Babcock an email, requesting a copy of Child A and Child B's child information record. On 10/14/2021, I spoke to Child I (male, 3 years) and Child J's (male, 12 years) mother. She does not have any concerns or issues. She has never smelled marijuana or smoke on Ms. Babcock and has been using her as a provider for two years. On 11/02/2021, I received a copy of Child A and Child B's child information record, which had their father's name on there. On 11/22/2021, I had an exit interview with Ms. Babcock and let her know that I did not find any rule violations. On 2/03/21 I arrived at Ms. Babcock's home. Ms. Babcock was not home; she was out picking up a child from preschool. Alexis Berry, child care staff member, was present caring for the children. Ms. Berry stated that time out and redirection are used for discipline at the child care home. She has never observed Ms. Babcock use any physical discipline on the children. Ms. Babcock arrived home shortly after my arrival. Ms. Babcock showed me her discipline policy which was a copy of the licensing rules R400.1913 Discipline; child handling section. I asked her if she had her own policy and she stated that was all that she had regarding discipline. I asked her if she used physical discipline on any children. Ms. Babcock admitted that she has used physical discipline on Child B (female, 3 years) when she spit and peed on the floor. Child B's Father has given her verbal permission to spank her because he has noticed a difference in her behavior when she goes between his home and her mother's home. On 2/5/21, I interviewed Kyleigh Parks, child care staff member. Ms. Parks stated that time out and redirection are used for discipline. When I asked her if she could give me example, she told me that the children are in time out for the number of minutes for their age. If a child is two years of age, they will spend two minutes in time out for a consequence. They use time out for children of all ages. They use redirection much of the time. She has not witnessed Ms. Babcock use any physical discipline with any of the children. On 2/17/21, I interviewed Shannon Mitchell, child care assistant. She explained that time out and redirection are used for discipline. Ms. Mitchell explained that for children that are one and two years old they will have them stand in the corner for one or two minutes. If they are three years old or older, they will have them stand in the corner and then discuss with the child what they did wrong. She has not witnessed Ms. Babcock use any physical discipline with any of the children. I interviewed Child A (female, three years) and Child B's (female, six years) Father. The children have been attending the child care home for about a year. The children regularly attend Ms. Babcock's; it just depends on the visitation schedule with their mother. Child A attends full time when she is with him and when school is not in session Child B will attend the full day. Child A and Child B's Father specifically told Ms. Babcock that she could use physical discipline on the children. He has known her for over twenty years and he knows that she would not abuse the girls. The girls are his life and he would never let anyone mistreat them. He could only think of one time when Ms. Babcock used physical discipline with Child A. CONCLUSION: I VIOLATION ESTABLISHED ADDITIONAL FINDINGS: INVESTIGATION: During my inspection I requested to see Ms. Babcock's records detailing child care staff members and child care assistant arrival and departure times so I could determine who was working at the child care home. Ms. Babcock stated that staff are keeping track of their arrival and departure times. I requested to see Ms. Berry's records and Ms. Berry stated that she has it at her home. Ms. Babcock stated that she was keeping track in another calendar that the food program provided. They are no longer providing the calendar and so she has not been keeping records.
