On 02/23/2022, I interviewed the complainant. They reported they had been told by a former child care staff member that children were being placed in a domed play ring with a towel placed over the top of it to cover up the children's crying. On 02/24/2022, I made an unannounced on-site visit to the home. When I arrived on-site, Ms. Evelyn Bradley was present with child care staff members Ms. Mia Slates and Ms. Riley Peacock. Ms. Bradley reported that there were twelve children in attendance. I explained the allegations to Ms. Bradley. She stated that she does own a domed play ring, but it is currently only being used to store extra toys in. She said that it had been used for the infants during the summer time when the children were outdoors. Occasionally it is used downstairs in the playroom to keep children out of the trash when they are cleaning. She had used it with Child J (16-month-old, male) and Child M (11-month-old, male) last summer. The dome lid, which only covers approximately half of the top of the dome, would be pulled to keep the sun off the children, but a towel was never placed over the top of the dome. Ms. Bradley shared a picture with me of the domed play ring, as well as, I observed it being used for storage in the basement as Ms. Bradley stated. On 02/24/2022, child care staff member Ms. Mia Slates reported that the domed play ring is being used mainly for storage purposes. Occasionally it is used when they take the children outside to play because it helps to keep the infants in a safe place. She could not recall a time when a towel was placed on top of it. On 02/24/2022, child care staff member Ms. Riley Peacock reported that the domed play ring is only used for infants when they are outside. The top portion of the play ring is never closed and she has never witnessed a towel being placed over the top of the dome. On 03/02/2022, Child A and B's Mother reported that in addition to being a parent of Child A and Child B who attended Ms. Bradley's child care, she also volunteered for Ms. Bradley for approximately one month. She witnessed Ms. Bradley placing infants in the domed play ring, closing up the dome cover and then placing blankets on top of it, "She [Ms. Bradley] said it was to contain the babies so the babies would go to sleep." Ms. Bradley was the only child care staff member who placed children in the domed play ring and she did so at least a few times a week. "The children cried for approximately an hour and would eventually fall asleep, she [Ms. Bradley] said they were fighting their sleep." On 03/02/2022, Child C and D's Mother reported that she had never seen a domed play ring at Ms. Bradley's home. On 03/02/2022, Child E's Mother reported that she had seen a child in the domed play ring, but she had not seen any towels placed over the top of it. 5 On 03/04/2022, volunteer Ms. Kiarra Harvey reported that Ms. Bradley does have a domed play ring, but that she has only seen it being used to store toys in. On 03/10/2022, Child F's Mother reported that she has never seen a domed play ring being used with the children in care. On 03/18/2022, Child H and I's Mother reported that she has never seen a domed play ring being used with the children in care. On 03/18/2022, Child J and K's Mother reported that she did not actually see Ms. Bradley using the domed play ring with Child J. On 03/18/2022, I left a voicemail message for Child G's Mother and Child L's Mother. As of the date of this report, I have not received a returned telephone call from either parent.

On 02/23/2022, the complainant reported they had witnessed approximately ten children, at one time, sleeping in the baby room located on the basement level of the home. On 02/24/2022, I observed child care children sleeping in the baby room. There were two children in play yards and seven children sleeping on the floor with a sleeping bag/blanket underneath them, and a blanket and pillow on top of the sleeping bag and/or blanket. The closet was an open space area without any doors. No children were observed sleeping on the floor in the open closet area. On 02/24/2022, Ms. Bradley reported that child care children sleep in the baby room that is located on the basement level of the home. She guessed that maybe nine children, at the most, have slept in the room at one time. She does not believe the space is too cramped for the children. On 02/24/2022, Ms. Slates reported that the majority of the child care children sleep in the baby room. There are always two play yards in there and everyone else sleeps on the floor. On 02/24/2022, Ms. Peacock reported that there are always two play yards in the baby room that are used for children when taking their naps. She does not feel like the children are too cramped when they are sleeping in there. On 03/02/2022, Child A and B's Mother reported that some of the children sleep in play yards in the baby room and some of the children sleep on the floor. On 03/02/2022, Child C and D's Mother reported that it is her understanding that the children sleep in the baby room. She has seen a couple pictures of the children sleeping in their own spaces with a blanket. On 03/02/2022, Child E's Mother reported that she has seen where the children sleep and that it seems cramped. On 03/04/2022, Ms. Harvey reported that child care children are generally awake when she is in the home. On 03/08/2022, Child A and B's Mother further reported that when Child A would not lay down to rest, Ms. Bradley would take all of the stuff out of the closet in the baby room, place Child A on the floor of the closet area and put a play yard in front of him and the closet area so he couldn't get out. On 03/10/2022, Child F's Mother reported that she has not witnessed any children sleeping in the baby room. On 03/18/2022, Child H and I's Mother and Child J and K's Mother both reported that they have never witnessed child care children sleeping in the baby room. On 03/30/2022, Ms. Bradley reported that she could not recall a time when she removed items from the closet area in the baby room and placed Child A on the floor in the space to sleep. On 04/19/2022, Ms. Bradley sent me a picture of the closet area in the baby room. The closet is very small in size, there was a toy box sitting inside the closet area with a box fan and a basket of stuffed animals sitting on top of it. Ms. Bradley confirmed that child care children have never slept inside the closet area. 7

On 02/23/2022, the complainant reported that they had witnessed babies crawling in food that had been left on the floor and diapers not being disposed of in a diaper pail, but instead, set aside in the area where the children put their coats on. On 02/24/2022, I observed the approved child use spaces. On the basement level of the home the large play room and baby room are approved for child care use. Both rooms were well maintained and clean. On the first level of the home the sun room is approved for child care use. The sun room was cold and had several boxes, storage tubs and miscellaneous household furniture items stacked on top of one another in the northwest corner of the room. Due to all of the items being stored in the room and the cold temperature of the room, it was unusable space. On 02/24/2022, Ms. Bradley reported that sometimes the floor isn't always cleaned right away after the children have eaten, but it is always cleaned by the end of the day. She stated that the children have not been using the sun room, which has been approved for use, because it's too cold due to the room not having any heat ducts. She has felt as though the other two rooms do not provide enough space for the children to spread out, especially when there are children who do not take naps or children who have a difficult time falling asleep. On 02/24/2022, Ms. Slates reported that she tries to keep the rooms as clean as she can. After lunch, and when the children are sleeping, she will scrape off the plates, take them upstairs, wipe down the tables and high chairs and sweep the floor. "Never have I left food out or on the floor." A diaper Genie has always been available for use, so dirty diapers have never been left about laying around. On 02/24/2022, Ms. Peacock reported that the child care staff members generally keep the rooms clean. "Babies make a mess, but it always gets cleaned up." She said that food is usually taken care of right away, dirty dishes go upstairs and leftover food goes in the trash. There has always been a diaper Genie available for use, so dirty diapers have never been left out laying around. On 03/02/2022, Child A and B's Mother reported that the time she was volunteering for Ms. Bradley, she was constantly cleaning and picking up. There would be food on the floor and children were observed walking and crawling in it, as well as, eating it. She also observed little Polly Pocket toys and little Lego's left out on the floor and not kept out of the reach of the little children. She further reported that diapers were always disposed of in the diaper Genie. On 03/02/2022, Child C and D's Mother reported that she does not have any concerns with the cleanliness of the home. At lunchtime there might be food on the floor, but the floor is always cleaned by the end of the day and in the morning. rj On 03/02/2022, Child E's Mother stated she had never witnessed dirty diapers laying around the home. She has witnessed there being lots of clutter in the sun room and food left on the floor. On 04/15/2022, Ms. Bradley reported that there is approximately 300 square feet of usable space on just the basement level of the home. On 03/04/2022, Ms. Harvey reported that when she has arrived at the home, around 3:30 p.m., the floor is always clean and picked up. On 03/10/2022, Child F's Mother reported that she has never seen dirty diapers laying around and not disposed of. On 03/18/2022, Child H and I's Mother and Child J and K's Mother both reported not having any concerns with the cleanliness of the home or with dirty diapers being left out. On 03/30/2022, I observed the sun room. Ms. Bradley had cleaned up and organized the sun room, so that child care children could use it as soon as the weather warms up. We discussed completing a modification request to approve some of the rooms on the second level of the home to be used during child care hours.

On 02/23/2022, the complainant reported that between 3-4 times, Child E had been sent home with feces up her back side and had not been cleaned appropriately. When the complainant mentioned Child E not being cleaned, Ms. Bradley said that it was one of the child care staff members and that she would talk to them about it. The complainant stated, "It got better but would return." The complainant also reported that they had been told by a former child care staff member that there was no soap available for child care staff members to wash their hands. On 02/24/2022, Ms. Bradley reported that there were two separate occasions when Child M's Mother mentioned to her not all the feces had been removed from Child M's bottom after a diaper change. Child care staff member Ms. Mia Slates was not cleaning him completely after his diaper change. Following the parent's concern, Ms. Bradley is now the only person who changes his diaper. There has never been a time when hand soap was not available for the child care staff members to use, and if they did run out of hand soap in the basement, they could always run upstairs and get some from the kitchen. On 02/24/2022, Ms. Slates reported that she could not recall Ms. Bradley having spoken to her about Child M's diaper and him not being cleaned. She further reported that there has always been hand soap available for use. On 02/24/2022, Ms. Peacock recalled on one occasion when she was told that Child M had a red bottom when he got home, no one had put any cream on him and he still had some fecal matter on him. Ms. Bradley spoke to the child care staff members about it and Ms. Peacock feels like it has been taken care of and has not happened again. She further reported that hand soap has always been available for use. 11 On 03/02/2022, Child A and B's Mother reported that it was a daily occurrence that child care children's diapers were not changed as often as they should have been. She clarified that when she arrived at the home around 10:00 a.m., some children would still be in the diaper they arrived in. She further reported that for approximately three weeks there was no hand soap available for use. She stated, "Children were just rinsing their hands, no soap. Finally, she [Ms. Bradley] bought down some dish soap and said she kept forgetting." On 03/02/2022, Child C and D's Mother reported that on only one occasion was Child D's (30-month-old female) diaper more soggy than usual. On 03/02/2022, Child E's Mother reported that she does not feel as though Child E is cleaned thoroughly. She addressed her concern with Ms. Bradley who said it was another child care staff member who was responsible. After speaking with her two or three times and voicing her concern, it was taken care of. On 03/04/2022, Ms. Harvey reported that she is not aware of any children not having been cleaned appropriately after having a bowel movement and that hand soap has always been available for use. On 03/10/2022, Child F's Mother reported that lately Child F hasn't smelled very good when she has picked him up at the end of the day. She stated, "He doesn't smell clean. His clothes don't smell clean, feces on his clothing, and food on his clothes too." There had been a couple of times when he came home and his bottom hadn't been cleaned well, "I let her [Ms. Bradley] know I was upset. It's been said to me that it's her helpers." On 03/18/2022, Child J and K's Mother reported that Child J is always changed when she picks him up at the end of the day and he has neve come home with any type of diaper rashes or dried feces on his bottom.

On 02/23/2022, the complainant reported that on one occasion when she was at the home during the summer of 2021, the children were outside playing while one of the child care staff member's was on her phone. When the complainant brought it Ms. Bradley's attention, she told her that she would talk to the child care staff members about it. On 02/24/2022, Ms. Bradley reported that there was a concern, brought to her attention about a year ago, regarding Ms. Slates being on her cell phone instead of watching the children. She stated, "I looked out the window and she was on her phone. I didn't like it, so I spoke to her about it. I haven't had an issue since." On 02/24/2022, Ms. Slates reported that she's never really on her cellphone when she is working. She stated, "I don't think Ms. Bradley ever talked to me about my phone." On 02/24/2022, Ms. Peacock reported that Ms. Bradley has a policy that they are not supposed to use their cellphones when watching the children. She does not believe it is a concern that child care staff members are using their cellphones instead of supervising the children. On 03/02/2022, Child A and B's Mother reported that Ms. Bradley spoke to the child care staff members many times about not being on their cellphones. She further reported that she had witnessed Ms. Peacock, Ms. Slates and Ms. Bradley being distracted from providing care and supervision while they were on their cellphones. On 03/02/2022, Child C and D's Mother reported that Ms. Bradley had told her that she had had an issue with a child care staff members and their cellphones. She has 13 never personally witnessed any staff members on their cellphones when they should be supervising the children. On 03/02/2022, Child E's Mother reported that she had never witnessed child care staff members being distracted by their cellphones. On 03/04/2022, Ms. Harvey reported that she has only witnessed Ms. Slates on her cellphone during child care hours. he stated it was not for very long and it did not seem to interfere with the supervision of the children.
