On 03/25/2021 I spoke with Program Director Janis Lutz, who stated that on 03/24/2021 Child A inappropriately exposed himself to Child B (male, 10 years) in the classroom. "It was right after breakfast. I was talking to the two of them then turned and walked away for only a minute to help someone else when Child A said something to Child B and then flashed him under the table." Ms. Lutz said she spoke to Child A's parents and they told her that he did admit to doing it. Child A will be suspended. On 03/29/2021 I completed an unannounced on-site inspection. The program provides before and after school programming for the district, and children come from a variety of other schools to participate. Ms. Lutz stated that on the morning of 03/24/2021 there were 3 child care staff members present and 34 school aged children. Ms. Lutz was over near the table where Child A and Child B were sitting, and they had just finished breakfast. She spoke to them and walked away for what "must have been only minutes. They were sitting next to each other at the table talking and then Child A flashed Child B. I had just walked away, was still nearby." Ms. Lutz did not find out about the incident until later in the day. During the after school portion of the day, Child B told her about the incident. "I felt really bad that he had to go all day before telling someone." Child care staff member Nancy Kadzban said she did not see the incident. She was sitting at a table not far from where Child A and Child B were sitting. "I was at the front table because I check kids in and keep an eye on those arriving through the monitor." Due to COVID restrictions parents stay outside of the building and child care staff members monitor who is arriving to make sure the children get safely to their classroom. She was nearby but was not specifically watching Child A and Child B. "It just happened so fast, right in front of us. It was in the probably two seconds after Janis walked away from them. My heart hurts that it happened." Child care staff member Elizabeth Gross was in the classroom at the time of the incident but was on the other side of the classroom. "I helped serve breakfast over on the side of the room, and then I cleaned it up and several girls helped me update the bulletin board. I didn't see it happen." Ms. Gross said she has never seen Child A do anything inappropriate at school and was surprised. "All three of us teachers were in the room, probably within 10 feet." On 03/29/2021 and 03/31/2021 I called Child A's Mother and Child B's Mother. At this time, neither have returned my call. This is the second incident of this nature in the past 5 months. Special Investigation SIR2020D0604002 involved a different child exposing himself to Child B in the bathroom. At that time the center was cited for R400.8125(1) for not providing appropriate care and supervision. They made many policy changes at that time regarding the supervision of children, specifically when they enter the bathrooms at the center. Ms. Lutz stated that she was appalled about these incidents, as nothing 4 like this had occurred at their program before this year. She requested resources and training opportunities for child care staff to figure out how to properly address these situations and stop them from happening in the future.

On 10/06/2020 Program Director Janis Lutz left a voicemail for the Department, stating that an incident had occurred at the center on 10/02/2020 that she needed to report. I spoke to her over the phone on 10/07/2020. Ms. Lutz reported that on the afternoon of Friday 10/02/2020, she had left the center for the day and child care 2 staff members Lisa Gross and Sylvia Stokes were present. Child A asked to use the restroom, and the child care staff members allowed him to do so. Child B was working on a craft and became covered in glue. Ms. Gross told him he needed to go clean himself up in the bathroom. Ms. Lutz stated, "Our normal process is not to allow two boys to be in the bathroom at the same time." Due to Child B's mess, the child care staff members did not think about the boys being in the bathroom unsupervised. "She just knew he needed to get cleaned up." Child A and Child B were down the hall in the bathroom for an extended period of time, so the child care staff members sent a third boy down to the bathroom to check on them. He came running back several minutes later and said one of the boys told him the other had "shown him his junk." Ms. Gross went down to the bathroom to get the boys. The boys were embarrassed and at that time denied that it had happened. "It was clear to Lisa though, she knows them well enough. She knew something had happened." On Saturday, Oct. 3, Child A's Mother called Ms. Lutz and told her that Child A had told her what happened. Child A stated that he was in the bathroom washing his hands when Child B came in and exposed himself. He told Child A to do the same, but he refused. Child B continued to ask Child A to do it, and Child A said he then did because "he felt pressured into it." Child B later finally admitted that it had happened, but that he did not remember "pressuring" Child A. Both boys were suspended from the child care for a day as a result. Ms. Lutz sent an incident report on 10/08/2020. On 10/12/2020 I completed an unannounced on-site inspection at the center. I interviewed child care staff member Lisa Gross. She said that at the time of the incident they had around 10 school aged children in care. Child A asked to use the restroom and she let him go. Child B had glue covering his hands and was "a mess" so she told him "to go wash up, and I didn't think about it." A few minutes later, child care staff member Sylvia Stokes "noticed it had been awhile" and they sent another child down to check on Child A and Child B. "It had been about 5 minutes, but not longer." The third child came back and told Ms. Gross that Child A had said Child B exposed himself to him. "We brought them right back, but they denied it and said it was a joke. They were really embarrassed, and I thought it was probably true. I spoke to Child A's mom and told her they said it didn't happen, but I wanted her to know." I asked Ms. Gross what the usual practice is for children in care to use the restroom. She showed me a white board near the door and said before COVID, they would have the children write their name on the board and if another child asks to go, they look to see if anyone's already in the restroom. They only let one child go at a time. Because of COVID, the children have just been asking to go and the child care staff members try to remember to write it down so that children aren't sharing markers. The after school program has groups of children from a variety of schools, so they have been concerned about them sharing utensils. I asked Ms. Gross if there is a new process since the incident occurred with Child A and Child B. She said they have gone back to the children writing their names on the board, since they are all familiar with that process, and have a designated marker for each school cohort.
