On 07/31/2023, 1 made an unannounced on-site inspection at the child care center. I spoke with Child Care Staff Member 8 (CCSM) 8, Child Care Staff Member 3 (CCSM 3), Child Care Staff Member 9 (CCSM 9), and program director Kelly Gilbert. CCSM 8 stated that on 07/27/2023, Child B's Mother dropped off Child B; she commented that normally Child B's Father drops off Child B. Child B's Mother asked her where to put Child B's things. She took the backpack and placed it in the room near her desk. She mentioned that there were some children crying and that Child B (male, age 26 months) has "hard drop offs". She was trying to comfort Child B when she noticed Child C (female, age 29 months) was near the backpack and had started to unzip the backpack. She retrieved the back pack and opened it up to take out Child B's water bottle and lunch. She said she noticed the back pack was half zipped. When she opened the backpack, she saw a large container of marijuana at the top. The container was closed and had child proof cap. CCSM 8 stated when she went to retrieve the backpack, it was only half zipped open, and nothing look disturbed in the back pack. CCSM 8 placed the container in another bag and took it to the office and informed the assistant director about finding the container in the Child B's backpack. The assistant director called the program director, Kelly Gilbert who then called her child care licensing consultant, child protective services, and law enforcement. CCSM 8 said that she is aware law enforcement came to the center and removed the container of marijuana from the center. At approximately noon, Child B's Mother arrived at the center and mentioned to CCSM 8 that she had 2 forgotten something. Child B's Mother looked in Child B's backpack and then left the center. She did not say anything else to CCSM 8. CCSM 8 said she received a text a few hours later from Child B's Mother letting her know that she would be arriving to pick up Child B early. CCSM 8 stated that it is part of the routine that when children are dropped off staff will retrieve the children's lunch boxes and water bottles from their bags. While they are doing this, they are checking the bags to see if anything else is in the bag. CCSM 8 said typically bags are not brought into the classrooms. Parents will hang them up on the hooks and staff check the bags as children are arriving. Program director Kelly Gilbert stated that on 07/27/2023, CCSM 8 was getting Child B's water bottle and lunch box from Child B's backpack when she found a large, sealed container of marijuana in the backpack. None of the children accessed the marijuana and staff ensured it was immediately placed in an area inaccessible to children. Ms. Gilbert said she contacted her licensing consultant, child protective services, and law enforcement. Law enforcement arrived shortly after her call and removed the marijuana from the center. Ms. Gilbert called Child B's Mother while I was at the center to inform her of what they found and steps she took. Ms. Gilbert said that staff are expected to look in children's back at drop off. They do this to gather the children's lunch boxes and water bottles but also to inspect the bags for any other items. Ms. Gilbert stated she has found diaper cream and medications in bags. Note: Ms. Gilbert sent a photograph of the container with incident report to the bureau. The photograph shows the container as a large prescription bottle with a child proof cap. CCSM 3 stated that when children are dropped off at the center, staff are expected to check diaper bags and backpacks. She has found sunscreen, acetaminophen, and diaper cream in bags. When staff find these items, they will store them where they are inaccessible to children. If needed, staff will ask parents to complete the medication form before they leave or when they arrive to pick up the children. On 0411112023, I spoke with Child A's Mother who reported that on 04/06/2023, when she picked Child A up from the center, Child A whispered to her that she had something to tell her when they got home. When they arrived home, Child A did not tell her anything. The next morning Child A told her that the I teacher She thought maybe it was dream that Child A had. She took Child Aloe doctor for a checkup and to see if she had infection. While at the doctor appointment, Child A said that her W and that the teacher and kept sayingssh e wanted to te e'doctor. Child A made a gesture of The doctor said Child A did not have any infections, but they are giving her and she is going back today for a recheck. At home, Child A kept locking the bathroom door on them and saying, MW Child A said that Child Care Staff Member 1 (CCSM 1) Child A's er called the center and left a message requesting an urgent call back from program director Kelly Gilbert. Kelly Gilbert called her back; she told her what Child A was saying. Kelly Gilbert started laughing saying "we don't have a person named [CCSM 1].- Kelly Gilbert told her that she knows it hap n and then said that Child A's CCSMs said that Child A told her that Child Child A's Mother said that Child A has two older brdotihdezrst*an"eyo ick her. Child A's Mother said during their conversation, Kelly Gilbert kept laughing and saying that they did not have anyone there by CCSM 1's name. Child A's Mother said that Kelly Gilbert told her the following Monday that Child A could not return to the center. Child A's Mother said that Child A was and „ but started having since she started going to the center in November 2022. Child A moved classrooms in February, and she does not know who Child A's child care staff members (are or their names. Kelly Gilbert sent her photos of the CCSMs that were working with Child A on 04/06/2023. She showed Child A the photos and Child A and said, "she tricked me, ice and then really mean." Child A fied CCSM 2 as the one whi II Child A is now saying that she does not want to go to child cares*ansin*ceThursday has been having Child A's Mother contacted law enforcement and wants to press charges. I talkedto Child A's Mother about the forensic interview process at the and sent her a text message with a link to their website copy of my business card. Child A's Mother sent me screenshots of her conversation with Kelly Gilbert. Kelly Gilbert sent her screenshots of CCSM 2 and CCSM 5's Facebook profiles that included their photos. On 0411012023, Child A's Mother told Kelly Gilbert "...I want [Child A] to return back to daycare as she shouldn't be punished. I just don't want [Child A] having any contact with this teache. And how can we keep her safe." Kelly Gilbert responded, "It's now under 3 investigation with the state licensing of Michigan so I think until the investigation is over it's best if [Child A] doesn't return to daycare." I spoke with who reported that he had just spoke with will schedule a forensic interview for Child A. and I discussed the case and conversations with Child A's Mother. I reviewed the center's child care background check profile and saw that CCSM 1 was connected to the center. I called Child A's Mother back to ask clarifying questions. Child A's Mother clarified that she believes the incident happened on 04/06/2023 and told Kelly Gilbert that. Kelly Gilbert identified the CCSMs who were working by sending her the photos and also told her that no one named CCSM 1 worked at the center. 0 her . She said CCSM 1 said "oops, sorry." She explained there were some days that Lauren Gilbert would text her saying Child B has been crying all morning long or that had been screaming during nap time. Child A and B's Mother stated Child B "never" wanted to go to the center asi would scream and cry and would clothes off not wanting to go. She explained she tried to educate LautraeknR bert on meeting the needs of Child B as she was aware of , but they were viewing behavior has intentional poor behavior. She stated she has sat down with Lauren and Kelly Gilbert about Child B's needs. She stated Kelly Gilbert told her Child B was leaving the classroom with Kelly Gilbert in order to spend certain times with her. She stated she did provide Lauren Gilbert "a lot of things" and spoke with Kelly Gilbert about needs, but she is not sure if she provided a copy of the tha shows what needs to happen to meet the needs of Child B. Child A and B's Mother picke u that day and while she was buckling in car seat, she noticed the top of ear had bruising that looked like a thum mar on the top of. ji ear and bruising was on both sides of the ear. She stated "it literally looks like someone grabbed ear and yanked ear" and the bruising looked to be the size of an adult thumb. She believed this may have been done by a staff member. She stated Lauren Gilbert has five other assistants in that classroom, but she does not know who Child B's primary caregiver is and is unsure of all who may work in Child B's classroom. Child A and B's Mother stated she confronted Lauren Gilbert because she is the lead. Lauren Gilbert replied that she would ask the other child care staff members to determine if anything happened. Lauren Gilbert advised that no one in the classroom could recall a time where Child B was crying or complaining of an injury and Child B did not come to a child care staff member about. ear. No one in the classroom noticed the bruise on ,there was no incident report and no explanation provided about the bruise. She s aced she kept Child B home the next day as she did not feel comfortable sending back to the center. The next day, she also reached out to and was advised to have this injury looked at due to concerns of a 11 possible blood vessel rupture as this could cause cauliflower ear because "it is so much trauma in one spot." She stated Child A and B's Father received text messages from Lauren Gilbert the same day of the injury, reporting that Child B was E crying before lunch, Child B did not eats lunch and had fallen asleep on■ cot quickly. She explained Child B does not normally nap and typically fights with child care staff members during nap time. On 04/15/2021 I spoke with Child A and B's Mother. She explained both children began care in and she did not provide a child information card to either child before they started care. She stated for Child B, she completed a child information card roughly five days after Child B began care at the center. Child A started at the center roughly two weeks after Child B did not have an immunization record prior to starting care. On 04/22/2021 , Licensing Consultant Mary Dufon and I made an unannounced visit totth e center. We spoke with Kelly Gilbert and I requested child records for Child A and Child B. Kelly Gilbert stated she did not get the immunization records when Child A and Child B started care. I asked her to email them to me in case she is able to locate them. I obtained the child information cards for Child A and Child B. Child B's date of admission was dated and the parent signature was dated When I asked Kelly Gilbert about the dates, she explained she understood that child care children cannot begin without child information cards and she is not sure why this was dated after Child B began care. On 4/26/2021 Kelly Gilbert sent an email with enrollment paperwork that was signed by Child B's parents with a date of Kelly Gilbert wrote she believed Child B's parents may have wrote the ate when si nin the child information card as she might have mixed up the and the dates.

On 04/15/2021 I spoke with Child A and B's Mother. She explained she did not always receive daily sheets for Child A and when she did, they were not detailed. For example, child care staff members would write "snack" to show ate a snack but would never provide details on what ate. Child A and B's Mot er also reported concerns of lack of daily notes or Child B, however is over 30 because• months in age, the center is not required to provide ■ with daily notes. On 04/22/2021 J,, Licensing Consultant Mary Dufon and I made an unannounced visit to the center. We spoke with Kelly Gilbert and she explained the infants and toddlers have written daily records that document bottles, feeding, diapers and naps. She stated parents get a copy of the daily reports every day and she is not sure why someone would complain about not receiving these. She has no concerns regarding the daily reports not being completed. Kelly Gilbert provided an example of the daily reports that staff members use. and I spoke with Trinda Dejong: she stated Child A does receive daily written reports that discuss what children did during the day, feedings, nap time and diaper changes. She explained she physically hands parents the daily sheet reports and on the days Child A and B's Mother has picked up while she was still working, Child A and B's Mother received these daily reports. Ms. Dejong is the in the classroom and leaves in the afternoon; therefore, she is unable to hand each parent the daily sheet before she leaves for the day, but it is presumed other child care staff members are providing these to parents at the end of the day She stated no parents have ever complained that they were not receiving the daily sheets, she stated they only text parents this information if staff members forget to provide the daily sheets to them. She stated Child A and B's Mother has never complained to her about the center. and I spoke with Samantha Brouwer, an assistant child care staff member in the Wobbler classroom who has been at this center for roughly years. She stated the Wobbler classroom consists of children between the ages of 1 and 2. She stated she helps out in the infant and toddler classrooms. She stated daily sheets are used to record feedings, diaper changes and naps and these are given to parents every day. She stated she has never had anyone complain about not receiving the daily sheets. On 04/28/2021 and I spoke with Child C's Father, he stated when Child C was in the toddler assroom, he received daily sheets and believes this happened every day. On and I spoke with Child D's Mother. She stated Child D _ 04/i2n 8th/2e0 W2o1bMbleerr assroom and she receives daily sheets fore. On 05/04/2021 and I spoke with Child I and J's Mother. She stated she receives daily sheets or Child J every day and there was not a time when she did not receive the daily written reports for Child J. 19

On 04/15/2021 I spoke with Child A and B's Mother. She explained when Child B received a bruise on ear, she spoke with Kelly Gilbert about this. She stated Kelly Gilbert reporte w enever a child falls down or receives a scratch an incident report is made, and she was surprised an incident report was not completed for Child B's ear. Child A and B's Mother reported another incident when Child A fell and got a scratch while at the center. Child A and B's Father picked up that day and Ms. Dejong verbally told him about the incident, but never provided an incident report. Child A had a scratch on the corner of eye, and she believes that Child A likely fell, but she does not understand why chi care staff members are not documenting these with incident reports. On 04/16/2021 I received a phone call from who was present with Child A and B's Mother and Father. They reported they do not have any concerns for Child A's classroom, other than incident reports. Child A and B's Mother reported the other day, 4/15/21, Child A received a bump on ■ face and Ms. Dejong only verbally reported to the parents what happened. There are concerns with lack of administration. On 04/16/2021 I received a text from Child A and B's Mother with photos of Child A's injury at the center that occurred on 4/15/2021 There is a mark near Child A's eye, and she reports she did not receive an incident report for this injury. On 04/22/2021 , Mary Dufon and I made an unannounced visit to the center. We spoke with program director Kelly Gilbert about the allegations of lack of incident report writing. Kelly Gilbert explained there was no incident report written for the injury on Child B's ear because this incident did not occur at the center and she was unsure if Child B went to seek medical care because the parents never told her Child B went to the Consultant Mary Dufon looked though the centers carbon copy of incident reports and only one incident report was documented for Child A, which was dated 4/12/21 for climbing on the outside playset and hit his face as. fell on the steps. Mrs. Dufon and I spoke with Lauren Gilbert explained she did not write an incident report for Child B because she did not see the incident happen and she was not "going to make stuff up" for Child B. She stated the classroom always writes incident reports any injuries that occur while in care. " , Mrs. Dufon and I spoke with Danyn Huist who stated the classroom staff 0 ave ways documented incident reports when injuries are observed at the center. She explained no one observed Child B hurting ear, which is why Child B did not have an incident report. All staff write incident reports "religiously." She stated the center keeps a yellow copy of all the incident reports written and the white page is sent home to parents. Mrs. Dufon and I spoke with Trinda Dejong who stated she does not recall a time when Child A was hurt and an incident report was not written. She explained a few weeks ago, Child A was carrying a toy and fell, ■ face bumped the toy, and she is unsure if an incident report was completed. She notified Child A and B's Father of this injury verbally. She stated the white copy of the incident report goes to the parents and the yellow copies stay at the center and staff members are responsible for bringing the yellow copes into the office. She stated Child A has bumped ■ head before and she has told parents this verbally. ■ falls often, but she is unsure how often Child A gets hurt or how many incident reports. has. On 04/15/2021 I spoke with Child A and B's Mother. She stated for the duration that Child B was in attendance at the center, . has never gone outside. She stated i did not have winter gear as the child care staff members would not ask for winter gear. She stated child care staff member, Trinda Dejong, told her not to worry about sending in winter gear for Child 23 A because the do not spend time outside in the winter. She stated Child B has also told her that never went outside. On 04/22/2021 Mary Dufon and I spoke with Kelly Gilbert and she explained child care c i d, 'ren do go outside every day, but when "it's too snowy" and if the classrooms do not have the proper gear for each child, then classrooms do not go outside. She stated instead, the classrooms will utilize the gym when they do not go outside. She explained she tried to purchase snow gear for children who did not bring them in and spent roughly $1,000 on this and parents were not returning the gear back to the center. She stated she will make the call if weather is an issue and they try to go outside whenever they can, but "I can't tell you every day because of inclement weather". _ Mrs. Dufon and I spoke with Lauren Gilbert. She stated the classroom tries to go outside in the winter and they have been outside "a few times", however the temperatures would prevent them from doing so. However she was unable to report what temperature would be considered too low. She stated if not all child care children in her classroom brought their snow gear then her classroom did not go outside that day as they do not have enough extra gear to cover the children that did not bring in winter gear. She stated the goal of the classroom was to go outside "once per week" but this was difficult to achieve due to the lack of winter gear for the children. , Mrs. Dufon and I spoke with Danyn Huist; she stated in the winter the ~Ca=ssroom does not go outside everyday as it is too cold. She stated typically 30 degrees or below is considered too cold and they do not go out under these temperatures. She stated the classroom usually goes outside in the spring, summer and fall, but "I would say we don't go outside in the winter; we like to stay inside." She explained it is too cold in the winter and the child care children do not like putting their snow gear on as it becomes "too much" and the classroom likes to go outside in the morning, which is usually colder. Mrs. Dufon and I spoke with Trinda Dejong; she explained in the fall, summer and spring child care children do go outside, however in the winter they do not. She stated trying to get snow gear on in the winter does not work in the Wobbler classroom as this is too much and too stressful on the children therefore, they do not go out in the winter and instead, utilize the gym. , Mrs. Dufon and I spoke with Samantha Brouwer who stated the Wobbler ~Ca=ssroom does not go outside at all in the winter as it is a lot of work to keep their gloves on and there are times when parents don't bring in all the winter gear needed. It would not be fair to take everyone outside and leave a few children behind. She also stated they have a child care child who was recently- 24 therefore they will wait until the temperatures are 50 "egg es or higher. On and I spoke with Child D's Mother. She explained children do n0o4t g/o2 o8u/t2sid0e2 in"te winter, unless it is a nice winter day. She stated they will go outside in the spring and summer. On 04/28/2021 and I spoke with Child C's Mother. She stated children do not go outside in the winter, ever. She explained she really likes the center but this has been an issue because they never go outside in the winter. She stated if the weather is nice out, then they will take the children outside, however she believes Child C has never been outside. On 04/15/2021 I spoke with Child A and B's Mother. She stated Child A is in the classroom and is not old. She stated child care staff members do not allow C i d A to sleep on demand. She explained a time when lead child care staff member, Trinda Dejong, sent her a video on of Child A falling asleep at the meal table and is nodding off so badly, at Child A almost "slams ■ face" on the table. Child and B's Mother stated she is concerned that instead of moving to nap, the staff member recorded. She stated Ms. E Dejong will not allow C i A to sleep until it is nap time. On 02/04/21 Ms. Dejong sent another video to her of Child A falling asleep and reported did not eat anything for lunch and fell asleep at the meal table. She explain Child A still takes two naps while at home and this is compromising ■ well being when is not being allowed to nap while in care at the center. She stated Ms. Dejong has to d her multiple times that she will only allow Child A to take one nap. , Mrs. Dufon and I spoke with Trinda Dejong, who is the in wobbler I RaMssroom with ages between and years old. Child A is old as of We& however since being in this classroom, does not steep on demand as "te in this classroom are all over a year ol.She explained all of the children in this classroom begin nap time between 12:30pm and 1:00pm. Once children move into this classroom staff members start transiting them to a toddler schedule, which includes no more bottle usage, one nap time a day and learning to self-feed. She stated if children appear tired, she will allow children to lay on her and cuddle. If child care children have a "rough night" they will crawl into staff members laps and "take a cat nap on us". She stated Child A would take some "cat naps" on 0 her lap and .0 is usually sitting on her lap as is well bonded to her. She stated Kelly Gilbert is aware that when children come into her classroom staff members begin that transition into one nap and they stop sleeping on demand. She stated this is recorded on the daily sheets and parents receive a copy of the schedule. Mrs. Dufon and I spoke with Samantha Brouwer, she stated the children start their naps after lunch time and they typically allow them to sleep on demand. She explained if the children fall start to fall asleep before this time, staff members will allow them to sleep on their laps and the children do not sleep on their cots for "these little naps". She stated Child A would sleep on the laps of staff members during the mornings sometimes and staff members would not allow them to rest on O their cots or mats. She stated typically, staff members "would try to keep them awake" by reading a book, playing with toys that sing songs or asking the children what songs they would like to hear on Alexa.

On 04/15/2021 I spoke with Child A and B's Mother. She stated in the Wobbler classroom they have a TV right above the sensory table and the cords are hanging down, accessible to child care children. She stated the cords are held down with packaging tape and are tapped to the wall, however she is concerned that children can pull the cord down causing the TV to possibly fall on top of a child. On 04/22/2021 , Mary Dufon and I made an unannounced visit to the center. I went insid"te Wobbler classroom and observed the TV to be mounted to the wall above the sensory table, however the TV cords were inaccessible to child care children as they were too high for the children to reach.
