R 400.1911 · .................... ............... R 400.1911 Care; supervision; children. (1) A licensee shall ensure appropriate care and supervision of children at all times.
I observed the home. The home has a front porch that leads to an entry hallway and living room. The living room leads to the kitchen. The bathroom is located along one wall of the kitchen. Through the kitchen is a playroom that leads to an enclosed porch surrounded by windows. The enclosed porch leads to a covered open porch connected to the play area, and then the fenced in play area. I observed the street in front of the home. The street has one lane of traffic in each direction. The speed limit is 25 miles per hour. Each side of the street has a wide bike lane between the car travel lanes and the curb. I stood outside for approximately five minutes, and there was no traffic. I interviewed Mrs. Dillon, licensee. She acknowledged that on 6/6/23, that Child A left through the front door of the house alone, and that he was quickly retrieved unharmed. This occurred between 4:30 — 5:00pm. At the time of the incident, Mrs. Dillon, co-licensee Mr. Dillon, and Child Care Staff Member 1 (CCSM 1) were present with six children, three of whom were directly related to them. The children were in the back yard playing. Mr. Dillon was sitting on the enclosed porch in a chair with direct line of sight through the playroom and into the kitchen and living room. The bathroom was not in direct line of sight from where he was sitting. Mrs. Dillon was sitting on the open covered porch attached to the play area supervising the children. CCSM 1 was in the play area with the children. Child A said that he needed to go "potty." Mrs. Dillon sent Child A into the house to use the bathroom, saying that she would be right there to help. Mrs. Dillon took a second to put down a toy and followed Child A inside the house while Mr. Dillon stepped to the covered open porch to help supervise the children in the play area with CCSM 1. Mrs. Dillon followed Child A inside the house a few seconds after he went inside, saying that 3 she "basically" followed right behind him. When she arrived at the bathroom, Child A was not there. She started calling for him while looking under the kitchen table and in the living room. Mrs. Dillon walked to the back porch. By the time she got to the back of the house, CCSM 1 was already on her way to the front of the house. CCSM 1 traveled to the front of the house from outside. Child A was found quickly unharmed. CCSM 1 told her that as she was retrieving Child A, he "bolted" and ran into the street. As CCSM 1 was standing right there, he was quickly stopped and brought back into the house. Mrs. Dillon estimated that Child A was outside of their direct line of sight for less than a minute due to how fast she followed him into the house, and with how fast CCSM 1 responded outside. She stressed that this is an isolated incident and that they provide the children with good care and supervision. I interviewed Mr. Dillon. He verified Mrs. Dillon's statements leading to Child A entering the home. Mr. Dillon observed Child A walk into the house toward the kitchen where the bathroom is located. Mrs. Dillon put down a toy and followed Child A inside the house while Mr. Dillon stepped to the covered open porch to help supervise the children in the play area with CCSM 1. Mrs. Dillon followed Child A inside the house a few seconds after he went inside. A few seconds later, Mr. Dillon heard Mrs. Dillon call for Child A, so he immediately sent CCSM 1 to the front of the house. Child A was found quickly unharmed. Mr. Dillon estimated that Child A was outside of their direct line of sight for less than a minute due to how fast Mrs. Dillon followed him into the house and how fast CCSM 1 responded outside. He also stressed that this is an isolated incident and that they provide the children with good care and supervision. Mr. and Mrs. Dillon both stated that Child A normally can use the bathroom independently, but Mrs. Dillon still followed him inside. Child A has never tried to leave the house before. (8) To comply with section 3c of the act, MCL 722.113c, a licensee shall have a policy and procedure on smoking and vaping that includes all of the following: (a) Ensure that smoking and vaping do not occur in child-use space, on the premises of a child care home while children are in care, and in a vehicle when used to transport children who are in care.
I interviewed Mr. and Mrs. Dillon. They stated that both Mrs. Dillon and Mr. Dillon smoke cigarettes "on occasion." Mrs. Dillon does not smoke while children are in care. Mr. Dillon goes outside to smoke. CCSM 1 does not smoke. They do not smoke inside the house while the children are present for care. Mr. Dillon stated that if the first child arrives before their scheduled time in the morning, that he will immediately put out the cigarette to not smoke in front of the children. They both stated that they are also careful to not smoke inside the house because their own grandson is present, and he struggles with asthma. Mrs. Dillon stated that Mr. Dillon will smoke in the neighbor's yard or on the sidewalk in front of the home. The children do not observe him smoke. While speaking with Mr. Dillon, he admitted that at times, he will smoke outside during child care hours and not actually leave the property. When he does this, he may be standing in the side yard or front yard that is not used by the children. Mr. Dillon stressed that the children in care do not observe him smoking. I interviewed CCSM 1. She stated that she does not smoke. Mrs. Dillon does not smoke cigarettes while the children are in care. Mr. Dillon smokes cigarettes while the children are in care, but he normally stands just inside the neighbor's property line. She has not observed Mr. Dillon smoke in front of the children. CCSM 1 stated that on occasion, Mr. Dillon will smoke inside the house during non-child care hours. If the first child arrives earlier than planned in the morning, he immediately puts out the cigarette as to not smoke in front of the children. I attempted to contact Child A's Mother but was not successful. I interviewed Child B and Child C's Mother. She has no concerns. She has not observed anyone smoking inside the home or on the property. I attempted to contact Child D's Mother but was not successful.
