On September 28, 2022, I spoke with program director Trina Romanowski. Ms. Romanowski reported Child A is in Ms. Purkey's preschool classroom and there was an incident where Child A's pants were wet and when Ms. Purkey noticed it, she asked Child A why his pants were wet. Child A was not sure, and neither was Ms. Purkey. Ms. Purkey took Child A to the restroom and had him change his pants just in case it was not water or from play. Child C's Mother saw this exchange and she stated she was going to call a complaint into the State of Michigan as she felt Child A was shamed for having wet pants. Child C no longer attends the center. Ms. Romanowski stated her child care staff members use positive communication; they are not allowed to yell at children, use negative language, or shame children. On September 28, 2022, I spoke with Sydney Gerig, assistant director. Ms. Gerig stated on September 26, 2022, Child C's Mother reported there was an incident she observed which occurred in the preschool classroom and she felt that a teacher was upset with and shamed Child A because he wet his pants. Ms. Gerig stated she believes the preschool classroom had just returned from outside and they were getting ready for large group when Child A told Ms. Purkey there was something wrong with his pants. Ms. Purkey asked Child A if he needed them fixed or something. Child A reported they were wet. Ms. Purkey took Child A to the restroom, and he was changed and then returned to the group. When this occurred, the entire class was in a group on the carpet they do their group time on and Child A brought this to Ms. Purkey's attention, Ms. Purkey was confused because she was not sure why his pants were wet. However, she was not upset. I requested the video clip of this time when Child A was on the carpet until he returned to the carpet. Ms. Gerig is new to her current position and was unable to pull the video up at the time of the inspection but stated it would be emailed. Ms. Gerig said the child care staff members do not yell at children, speak negatively toward children, shame children, or cause them to develop emotional and mental complexes. Ms. Gerig stated they use Becky Bailey's program Conscious Discipline, they have a cozy corner where children can go and calm their bodies, they have a couch, and they have calming manipulatives children can use if they need to. Ms. Gerig showed me the classroom, and each of these areas as well as the supplies used. Photos were taken. On September 28, 2022, I spoke with child care staff member Kimberly Purkey. Ms. Purkey stated she is the preschool "teacher" and on September 26, 2022, Child A told her there was something wrong with his pants and she told him to go into the bathroom and fix them; she thought he had a wedgie. Child A explained his pants were wet. She looked and the front of his pants and they were dry, but the back of his pants were wet, "this did not make sense." His pants were light grey, and they were not that wet, but she decided to change his clothes anyway. She asked Child A questions trying to figure out why his pants were wet, but they never figured out what happened. Ms. Purkey stated she was not upset; she was confused, and Child A 4 seemed confused by the wet pants as well. Child A did not have tears, he was not crying, and he was not visibly upset by the situation. Ms. Purkey stated she does not and has not heard anyone yelling or speaking negatively to children. They use positive communication and the programs Conscious Discipline and Al's Pals. Al's Pals teaches children social and emotional awareness with the use of puppets. An internet search reveals Conscious Discipline teaches emotional intelligence, conflict resolution, and goal setting/reaching. On September 28, 2022, I spoke with child care staff member Maria Hernandez. Ms. Hernandez stated she has not, nor has she ever heard anyone speaking negatively to children, yelling at or in front of children, or shaming/emotional harming

On September 28, 2022, I spoke with Sydney Gerig, assistant director. Ms. Gerig stated Ms. Gerig stated they do not use timeout for any of the children in their care, and they have not used timeout for children under the age of three. On September 28, 2022, I spoke with child care staff member Kimberly Purkey. Ms. Purkey stated she does not use timeout and she is not aware of anyone using timeout at the center. On September 28, 2022, I spoke with child care staff member Maria Hernandez. Ms. Hernandez stated she is not aware of anyone using timeout for children.

(1) The department may investigate, inspect, and examine conditions of a child care organization and may investigate and examine the books and records of the licensee. The licensee shall cooperate with the department's investigation, inspection, and examination by doing all of the following: (a) Admitting members of the department into the child care organization and furnishing all reasonable facilities for thorough examination of its books, records, and reports. (b) Allowing the department to perform routine investigative functions during the course of an investigation, inspection, or examination. Routine investigative functions include, but are not limited to, interviewing potential witnesses, such as staff and household members, and taking photographs to assess and 4 document the conditions of the child care organization and its compliance with this act and the rules promulgated under this act. (c) Providing accurate and truthful information to the department, and encouraging witnesses, such as staff and household members, to provide accurate and truthful information to the department.
On 3/1/21 I conducted an unannounced onsite inspection to the center. I informed Ms. Kimberly Purkey, program director, of the allegations. Ms. Purkey informed me that all the center staff members have masks; however, admitted that the center had allowed them to choose if they wanted to wear them or not. Ms. Purkey clarified that early on during the pandemic, there was some confusion on the mask requirements and when masks were required to be worn 2 versus when they were only recommended. Ms. Purkey said the staff members are wearing the masks most of the time when there are visitors at the center; however, she informed me that on occasions when there have been no visitors present at the center there have been times when the staff members have been laxed on wearing their masks. I provided Ms. Purkey with a printout of the current face mask requirements and face mask exemptions as found on the department's website. I informed Ms. Purkey of the current face mask requirements and gatherings by the Michigan Department of Health and Human Services (MDHHS) and that all staff members are required to wear a face mask while they are working indoors unless they have a medical condition and cannot tolerate a face mask or are eating or drinking. Regarding children, I informed Ms. Purkey that children ages 5 years and older are required to wear a face mask while inside the center in both common areas and the classroom, during transportation, and outside when proper social distancing is unavailable. Children ages 4 years old should be encouraged to wear to wear a face mask while inside the center classrooms but are required to wear the face mask while traversing in hallways or common areas, during transportation, and outside when proper social distancing is unavailable. Children ages 2 to 3 years old should be encouraged to wear to wear a face mask while inside the center classrooms and while traversing in hallways or common areas. The children are required to wear a face mask during transportation, and outside when proper social distancing is unavailable. Children under 2 years old should not be wearing a face mask. Regarding parents and visitors, both parents and visitors should be wearing face masks while inside the center, during transportation, and outside when proper social distancing cannot occur. Ms. Purkey expressed an understanding to the mask requirements and said she will ensure all staff members are made aware of the current mask requirement guidelines. On 3/4/21, I interviewed Ms. Trina Romanowski, licensee designee via telephone. I informed Ms. Romanowski of the allegation. Ms. Romanowski reiterated Ms. Purkey's statement indicating on most occasions all the staff members are wearing their face masks. Early on, Ms. Romanowski said there was some confusion when a face mask was required to be worn versus only a recommendation; therefore, some staff members chose not to wear them at certain times. Ms. Romanowski gave an example of the staff members in the infant room having a difficult time wearing the face masks due to some of the infant and young toddlers pulling at their masks while they were holding the children. Ms. Romanowski also gave an example of children with hearing and speech issues having a difficult time understanding staff members when they are wearing their masks. Ms. Romanowski said she would remind all her staff members of the current guidelines to assure they are following what is expected of them. On 3/12/21, I conducted a second unannounced onsite inspection to the center and interviewed Ms. Kelly Purkey, Ms. Kennedy Marry, Ms. Nichole Greysinger, Ms. Kaitlyn Warner, Ms. Taylor Coates, Ms. Kendra Huff, and Ms. Sydney Garrig all who are staff members at the center. All the staff members confirmed being made aware of the current mask requirement guidelines and said that they are abiding by the 3 guidelines and wearing their masks the entire time they are working in the classrooms.
