    R 400.8125 · R 400.8125 Staff; volunteer; requirements. (1) All staff and volunteers shall provide appropriate care and supervision of children at all times.

    On 08/11/2023, the allegation was discussed with CCSM 1. CCSM 1 explained that she only took lunches away from the children if they were done. CCSM 1 stated that she never takes the children lunches away while they are eating. CCSM 1 explained how Child A eats one or two bites of his lunch and has a difficult time sitting down for lunch due to his short attention span. On 08/11/2023, the allegations were discussed with CCSM 2. She explained that she only worked with CCSM 1 for a short time but has never witnessed her throwing children’s lunches away before they were finished. 5 On 08/11/2023, the allegations were discussed with CCSM 3. CCSM 3 has never witnessed CCSM 1 throwing the child care children’s food during lunch. CCSM 3 explained that she has been working for a couple of months as a floater, so she was not placed in CCSM 1’s room often if at all. On 08/11/2023, the allegations were discussed with Child A’s Mother. She explained how she has open communication with CCSM 1 and has not seen or have heard CCSM 1 throwing away Child A’s lunch. If there is an issue with Child A, CCSM 1 always came to her with her concerns. On 09/05/2023, a phone call was received from Child B’s Mother. Child B’s Mother stated that she has never seen or have heard of lunch being thrown away by CCSM 1. If there are any issues within the classroom, communication has always been open between herself and CCSM 1. On 09/22/2023, the complainant stated that CCSM 1 threw away children’s lunches if she didn’t like their behavior. The complainant stated that the children should have more time to eat because of their age and the expectations were too high for them. On 09/13/2023, I conducted an exit conference with Program Director Jodi Pinneo. I gave consultation regarding staffing during the day. I suggested that she places extra child care staff members in rooms with children that may have difficulties during times where more staff maybe needed such as lunch time and small group times. Ms. Pinneo reassured me that she has never seen CCSM 1, or any other child care staff members throw away children’s lunches or push/yell at the children. Ms. Pinneo spoke very highly of CCSM 1 and that she is a great lead teacher caregiver.

    On October 3, 2022, I made an unannounced onsite inspection to the childcare center. I discussed the allegations in the complaint with Program Director Jodi Pinneo and assistant director Maria Galarnes. Ms. Pinneo stated that this complaint was made by a disgruntled former employee of the childcare center. She was recently fired because she kept calling off work. She was only worked for 2 the center for two weeks from September 19, 2022, to September 28, 2022. Ms. Galarnes stated that on the second day she worked she started wanting to send children home claiming that they were ill, although they were not. Ms. Pinneo and Ms. Galarnes both agreed that Child A had a fever over 100 degrees Fahrenheit and was given Tylenol to bring her fever down. Ms. Pinneo stated Child A had a fever from teething and did not have any other symptoms, so they did not send her home. I asked to view Child A's Medication Log. The log indicated that Child A was given 2m1 of Tylenol on September 19th, September 20th, and September 27, 2022, for teething. During the onsite inspection I interviewed childcare staff member Dawn Griewahn. I made Ms. Griewahn aware of the allegations in the complaint. Ms. Griewahn stated that she works in the infant room, and they do not keep children in the classroom with they are ill. They once had an infant who had green mucus coming out of their nose, but they were sent home. Ms. Griewahn stated that she gave Child A Tylenol for a fever when she was teething, but aside from the fever from teething Child A was not ill. On October 31, 2022, I called Child A's Mother and left a voicemail message requesting a return phone call. On October 31, 2022, I called and left a voicemail message for the complainant. On October 31, 2022, I received a return phone call from the complainant. The complainant stated that Child A was allowed to stay at the center when she had a fever. Child A played with toys and other children played with these toys spreading her illness. I asked the complainant if she was referring to the diaper changing area when she stated the "infant island" was not cleaned properly, she stated the infant island is the entire infant area of the center. The complainant did not believe the fever was caused by teething. On November 23, 2022, I received a phone call from Child A's Mother. I made Child A's Mother aware of the allegations in the complaint. Child A's Mother stated that Child A never caused anyone to get sick in childcare and never was sent to childcare when she was ill. Child A's Mother stated that Child A did receive Tylenol to assist with a fever when she was teething. 3

    On October 3, 2022, I made an unannounced onsite inspection to the childcare center. I made the program director Jodi Pinneo and assistant director Maria Galnares aware of the allegations in the complaint. Ms. Pinneo and Ms. Galnares denied any children being allowed to remain in the center when they are ill, however the childcare staff always clean the toys after they have been put into a child's mouth. They clean the diaper changing areas with the three-step process or wash, rinse, and sanitize. During the onsite inspection I viewed the infant are of the center. The classroom appeared clean and well maintained. The diapering area was equipped with three spay bottles containing a soapy water bottle, clear water, and a sanitizing solution. During the onsite inspection I interviewed childcare staff member Dawn Griewahn I made Ms. Griewahn aware of the allegations regarding the infant are of the center not being cleaned. Ms. Griewahn stated that they clean the diapering area with the three-step process of washing, rinsing, and sanitizing. Ms. Griewahn went on to say that when the infants put things in their mouths, they take those toys and put them in the "yuck bucket" until end of the day when they wash and sanitize all of the toys. During the onsite inspection I viewed the infant area of the center. The infant room appeared clean and well maintained. The diapering area contained a three-step process for cleaning the diapering area. 4

    On 3/2/22, 1 made a telephone call to the complainant to gain further information regarding the allegation. On 3/2/22, I interviewed Child A & B's Mother via telephone. Child A & B's Mother informed me on 1/25/22, Child A awoke in the middle of the night saying, "his mouth hurt." When Child A & B's Mother inquired as to why Child A's mouth hurt, Child A informed her that it was from his new "teacher" who returned from maternity leave. Child A & B's Mother said when she asked Child A for further details regarding his mouth hurting, Child A only responded by saying the word "pumping." Child A & B's Mother said there were no markings or injuries observed by her on Child A. Since making this comment, Child A & B's Mother said that Child A's behavior hasn't been good as he has been acting aggressive toward others while in care. Child A & B's Mother said the center had informed her that Child A was spitting, hitting, and throwing toys at the child care staff members and the child care children. Child A & B's Mother said she and Child A & B's Father had a meeting with the center regarding Child A's behaviors while in care. Child A & B's Mother said Child A does not display this type of behavior when he is at her home. On 3/3/22, I conducted an unannounced onsite inspection to the center and interviewed Ms. Jodi Pinneo, license designee. I informed Ms. Pinneo of the allegations. Ms. Pinneo said Child A has been attending care at the center for approximately 10 months and is currently attending care in the discovery drive preschool room. Ms. Pinneo said she was made aware of the allegation from Ms. Maria Galnares, assistant program director as Child A & B's Mother called the center on 1/26/22 to inform them of what Child A said to her on 1/25/22. Ms. Galnares informed Child A & B's Mother that she would look into the matter and inform the center administration staff of what Child A said. Ms. Pinneo spoke with the child care staff members from the discovery drive preschool room along with Ms. Reanna Crites, an additional child care staff member who just returned from maternity leave. Ms. Crites works in the infant room. She does not work in the discovery room which Child A attends for care. Ms. Pinneo said none of the child care staff members were aware of any incident occurring when Child A had his mouth hurt by a child care staff member. Regarding the word "pumping" Ms. Pinneo confirmed Ms. Crites taking time out of her workday to "pump," as she breastfeeds her newborn. Ms. Pinneo 3 said Ms. Crites does not "pump" around the child care children as she has a designated room located on the upper level of the center. Ms. Pinneo said the space is not approved child care use space therefore no child care children are present in the same area with Ms. Crites. Ms. Pinneo informed me that she recently had a meeting with Child A & B's Parents regarding Child A's aggressive behaviors. Over the past three months, Ms. Pinneo said that Child A's behaviors escalated within the classroom when he gets upset that include hitting, spitting, and throwing items at the child care staff members and children each day. Ms. Pinneo said some of the child care staff members have told her they have considered quitting due to Child A's aggressive behaviors. Ms. Pinneo said the child care staff members kept a behavior log on Child A and showed it to Child A & B's Parents during the meeting. Child A & B's Mother said that Child A does not display these behaviors while he is in her care. Child A & B's Father said on occasions he has seen Child A display some "rough house" behaviors while in his care. Ms. Pinneo explained to Child A & B's Parents that she wants to work with them on preventing Child A's aggressive behaviors. Ms. Pinneo explained to Child A & B's Parents that the center cannot afford to staff one-on-one care with Child A as the center has an obligation is to assure for the child care children and child care staff's members safety each day.
