  R 400.8125 · R 400.8125 Staff; volunteer; requirements. (1) All staff and volunteers shall provide appropriate care and supervision of children at all times.

  Child Care Staff Member 1 stated that at dismissal on Monday, August 28, 2023, Child Care Staff Member 1, and Child Care Staff Member 2 were outside with the children including Child A. Child Care Staff Member 1 stated that when Child A’s Mother came to pick up Child A, Child Care Staff Member 2 picked Child A up and held her up above her head and then brought her down and kissed Child A on the lips. Child Care Staff Member 1 stated that Child A’s Mother was standing right next to Child Care Staff Member 2 at the time of the kiss. Child A’s Mother did not react to the kiss or say anything to Child Care Staff Member 2. Child Care Staff Member 1 stated that Child A was in the preschool class last school year 2 with Child Care Staff Member 1 and Child Care Staff Member 2 so she is familiar with both child care staff members. Child Care Staff Member 1 stated that she has no concerns with the care that Child Care Staff Member 2 provides to children. Child Care Staff Member 2 is great with the children and is passionate about having their best interest. Child Care Staff Member 2 stated that she did not initiate a kiss with Child A. Child Care Staff Member 2 stated that she knows that it would be inappropriate to do this. Child Care Staff Member 2 stated that when children try to kiss her, she says “we save kisses for mommy and daddy” or “we don’t kiss at school”. Child Care Staff Member 2 stated that on Monday, August 28, 2023, during dismissal she lifted Child A up and Child A lunged forward kissing Child Care Staff Member 2 on the lips. Child A’s Mother was standing next to Child Care Staff Member 2 at the time of the kiss but she did not say anything. Child Care Staff Member 2 stated that the kiss happened so fast and Child Care Staff Member 2 did not say anything to Child A. Child Care Staff Member 2 stated that Child A is very excited to be in the preschool class with Child Care Staff Member 1 and Child Care Staff Member 2 again after being their class last school year. Child A’s Mother stated that she did not see Child Care Staff Member 2 kiss Child A on the lips on Monday, August 28, 2023, at dismissal. Child A’s Mother stated that Child A is very affectionate so she was not surprised when she was told about the kiss by licensee designee Mary Bruggenwirth. Child A’s Mother stated that she has no concern that anything inappropriate is going on with Child Care Staff Member 2. Child A’s Mother stated that Child A likes both Child Care Staff Member 1 and 2 very much. Licensee designee Mary Bruggenwirth stated that she has no concerns about Child Care Staff Member 2 being inappropriate with Child A or any other children. Ms. Bruggenwirth stated that she spoke with Child A’s Mother who also has no concerns.

Child Care Staff Member 2 kissed Child A (female, age 3 years) on the lips.
