A review of the daily attendance was conducted at approximately 2:49pm reflecting documentation of arrival time for two out of twenty-eight children present, remaining attendance was taken via the use of check marks and did not reflect each child’s arrival time. 2. At approximately 3:03pm an assistant staff member was caring for fourteen children in a space located between the cafeteria and gym. At approximately 3:14pm, the assistant staff member had a total of fifteen children who were then taken to the gym to combine with a second assistant staff and an additional twelve children, totaling twenty-seven children with two assistant staff. 3. At approximately 3:10pm, a review of a group's attendance reflected thirteen children marked in, however fourteen children were present in the group. A review of a second group's attendance reflected a child was checked in but not yet physically present at the time. The staff reported they were accidentally marked in. 4. At approximately 3:17pm, two groups combined outside with ratios of 2:31 (Site Coordinator and an assistant and thirty-one children) exceeding the maximum group size ratio by five children. 5. At approximately 3:17pm, the program's daily attendances added up to a total of fifty-eight children being cared by the program's Site Coordinator and three assistant staff.

During the visit at approximately 3:03pm, a staff member left a group of fourteen children unsupervised in the room located between the cafeteria and gym to retrieve a snack from a fridge located in the cafeteria. 2. Two assistant staff were unaware of how many children were present in their group and when questioned, they proceeded to count the number of children and then verified on their written attendance. 3. EEC observed a child using the climbing structure in an unsafe manner, as the child climbed on the edge of the spiral shaped slide to then climb through an opening near the twin flyer board located on top of the elevated surface, other children followed the same approach unnoticed.

During the visit, the Licensor and {REDACTED} observed a child using the climbing structure in an unsafe manner when they climbed on top of the elevated crawling tube and stradded the top. 2. A group of 18 children were left completely unsupervised with no staff attending the group when one of the two staff left the playground and came into the school building. At the same time, a child hit a ball which landed in the parking lot. The remaining staff person left the fenced playground to go retrieve the ball. During this brief period, no staff was supervising a group of 18 children.
