It was observed that there were two educators with thirty-seven students. The licensee must maintain sufficient numbers of qualified staff to promote the health, safety, growth and development of each child. The program must have the number of educators necessary to ensure adequate supervision of the group at all times.

At the time of the visit, it was observed that one student was permitted to walk to a bubbler, that was out of the cafeteria and around the corner, within the elementary school. The student went by themself and were not properly supervised by educators on site. Educators must be positioned to maximize their ability to see and/or hear children in their care.

It was later identified by EEC that at the time of the accident the driver had not yet participated in the proper orientation or EEC training. It was also identified that the driver was an employee/driver of the contracted bus company, but was not driving their 'normal' route. The driver was not an assigned substitute driver for FSA. Whenever transportation is provided or contracted by the licensee the licensee must ensure that: the driver and any other attendants on the vehicle have received an orientation to the transportation plan; one particular driver must be regularly assigned to each route, there must be a plan for the use of substitute drivers when the regularly assigned driver is unavailable.
