While the building itself is enclosed by a fence that exceeds the required height of 4 feet, the educator has designated a separate area as the outdoor play space that is not shared with other residents. However, the fence and gate enclosing this designated play area measure 3 feet in height, leaving surrounding areas accessible to the children and containing multiple safety hazards, including but not limited to: an uncovered grill, large rocks that pose tipping hazard, a large piece of plywood on the ground that can pose tipping hazard, a propane tank, yard tools, pieces of wood, and a motorcycle that could potentially fall on a child.
