During a tour of the home at approximately 2:25PM, the surveyor observed the provider's adult male son come out of his bedroom and enter the bathroom area. A couple minutes later, a four-year-old child was heard telling the provider that she needed to use the bathroom. The provider told the child that she would need to wait until her son came out of the bathroom and commented that the child should know that he goes in there daily around the same time. The provider further told the child that she needed to start going to bathroom before nap like she is told too. Over the next 30 - 40 minutes, the child repeatedly checked the bathroom door, told the provider that she really needed to go and was observed holding her private area and jumping up and down. The provider knocked on the bathroom door a couple of times and told her son that the child needed to go. The surveyor asked the provider if there was another bathroom available in the home. The provider stated that there is a second bathroom in the basement level of the home; however, stated that the children do not go down there and the space is not heated. Each of these containers bore the label, "Keep Out of Reach of Children." The provider acknowledged the presence of the items in the drawer, the cabinet, the front porch and in the toy room.

The basement was found to be flooded with several inches of black, foul smelling water; 2) the weed guard was found to be pulled through the ground covering in several areas, creating a tripping hazard; 3) the ground covering around the large climbing structure was found to be pea gravel. Pea gravel is not an approved ground covering for areas used by children under the age of three (3) years; 4) a lawn mower, wheel barrow and a metal fire pit with a sharp metal poker were found to be accessible to the children. The lawn mower and wheel barrow were located by the shed. The fire pit was located directly on the playground area; 5) a metal garage door was found to be folded up on the grass next to the playground area. The metal sides of the door were sharp; 6) two (2) metal tomato cages were found to be on the ground in the outdoor play area. The metal stakes of the cages were found to be sharp and rusty.
